Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Jim Houlihan, Deputy Public Works Director/City Engineer JHoulihan@newportbeachca.gov TITLE: Ocean Boulevard Bluff Park — Professional Conceptual Design Services Contract ABSTRACT: At the February 14, 2023 City Council meeting, staff provided a study session presentation for the Ocean Boulevard Bluff Park. The Council asked staff to solicit a request for proposals (RFP) to identify a consultant to develop the concept and design the project. The RFP process has concluded and staff requests City Council approval to enter into a professional services agreement with Rabben/Herman to conduct public outreach, concept development, and prioritization of proposed improvements. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; b) Approve Budget Amendment No. 23-035 transferring project savings from the Civic Center Park Improvements — Transportation Center Pickleball project and appropriating $109,680 in increased expenditures in Account No. 53601-980000- 231-01; and c) Approve Professional Services Agreement with Rabben/Herman of Newport Beach, for conceptual design services of the Ocean Boulevard Bluff Park for a total not -to -exceed amount of $109,680, and authorize the Mayor and City Clerk to execute the Agreement. DISCUSSION: At the February 14, 2023 City Council meeting, staff provided a study session presentation for the Ocean Boulevard Bluff Park. Council voted unanimously, via a straw poll, in favor of staff soliciting a request for proposals for the concept and design of the project. 14-1 Ocean Boulevard Bluff Park — Professional Conceptual Design Services Contract November 14, 2023 Page 2 The discussion regarding the multiple parks and scenic points/lookouts along Ocean Boulevard began at the June 8, 2021 City Council meeting. Former Councilmember Joy Brenner requested (and the City Council unanimously approved) that the City Council direct the Parks, Beaches & Recreation Commission (PB&R) to agendize an Ocean Boulevard Bluff Walk presentation from the residents' community group which had proposed to enhance the walkways and viewpoints with an emphasis on the pedestrian experience, and forward a recommendation to the City Council for an action plan for its consideration. After many meetings in 2021 and 2022 with PB&R and an ad hoc committee of PB&R commissioners, staff brought forth the PB&R recommendations for City Council consideration on February 14, 2023. Staff presented the list of recommended landscape and park improvements for the public areas along Ocean Boulevard in Corona del Mar between Poppy Ave. and Carnation Ave. The recommendation also included a request for the City Council to allocate funds to solicit a professional engineer or landscape architect to develop concepts and prepare Plans, Specifications and Cost Estimates (PS&E) for construction, including holding at least three noticed public workshops. Staff recently issued a Request for Proposals (RFP) for professional design services and received eight proposals. The proposals were reviewed by a three -person panel and evaluated on a Qualifications Based Selection process including execution and conformance to the RFP, project understanding, firm capability, experience and expertise, and listed project experience. All eight proposers demonstrated their ability to complete the scope of services as outlined in the RFP, but Rabben/Herman received the highest score based on the RFP evaluation criteria. In addition, Rabben/Herman has successfully completed many significant projects for other local agencies and has provided the City of Newport Beach excellent service on past projects. Rabben/Herman's rates and fees are also reasonable and within expectation for such design services. Therefore, staff recommends approving a professional services agreement with Rabben/Herman to conduct public outreach, provide concept development, and prioritize proposed improvements for the project. At the conclusion of the conceptual phase, staff will return to City Council for review and approval of the concepts, phasing and funding to move forward with the final PS&E. The next phase involves initial conceptual development, public community meetings, and a bluff tour. The team will have discussions with stakeholders and the PB&R Ad Hoc Committee to obtain a mutual understanding of the project's scope and objectives. Once objectives are defined and generally agreed upon, the project will proceed into the conceptual/schematic design phase where concept design elements will be developed. Input will continue from the community and ad hoc committee and will be incorporated into the design. Within this phase, Rabben Herman will develop project phasing and cost estimates for elements of construction work. Staff will bring the final concepts and phasing to PB&R for review and to develop recommendations of which elements should proceed forward to the City Council for review and possible approval for further funding and design. Upon the City Council's review, and receiving its direction of the conceptual design elements and phasing to move forward on, staff will return with the necessary additional funding and contract authority request to move forward with the final PS&E package. FISCAL IMPACT: The Budget Amendment appropriates $109,680 in increased expenditure appropriations to Account No. 53601-980000-23L01 from the Civic Center Park Improvements — Transportation Center Pickleball project, which is on hold at this time, in the Neighborhood Enhancement Fund. The Neighborhood Enhancement Fund is used for projects that enhance neighborhood aesthetics and functionality and is funded via surplus general funds. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. NOTICING - The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
