Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer, tandefur@newportbeachca.gov, 949-644-3321 TITLE: Utilities Yard Office Remodel (Project No. 23F13) — Notice of Completion for Contract No. 7908-1 ABSTRACT: On January 10, 2023, the City Council awarded Contract No. 7908-1 for the Utilities Yard Office Remodel project to JT Construction Group, Inc. The project renovated an existing, underutilized garage and workshop into offices for Utilities Department staff. The work is now complete and staff requests City Council acceptance and close out of the contract. RECOMMENDATIONS: a) Accept the completed work and authorize the City Clerk to file a Notice of Completion for the project; b) Authorize the City Clerk to release the Labor and Materials Bond 65 days after the Notice of Completion has been recorded in accordance with applicable portions of Civil Code; and c) Release Faithful Performance Bond one year after acceptance by the City Council. Work included a new concrete slab and polished floor, new walls with insulation, new lighting, a new kitchenette, and new Heating, Ventilation, and Air Conditioning (HVAC) equipment and ducting. The existing roll -up garage door was removed and replaced with a storefront window system. Also, a new fire -rated door and wall was created between the office space and the adjacent storage room. On the exterior, a new accessible parking space was provided with an Americans with Disabilities Act compliant path of travel, along with new sheet metal awnings constructed above the exterior windows and storefront to provide protection from the sun and rain. While the contracted work was completed to the satisfaction of the Public Works and Utilities Departments, JT Construction's performance was not satisfactory. The office addition was not completed on time and throughout construction JT Construction failed to complete basic tasks of construction such as providing submittals in a timely manner, providing supervision to workers, clearly communicating with the City of Newport Beach staff, and updating project schedules. JT Construction would arrive on -site without the personnel or materials to properly complete the daily scheduled work. The contractor also failed to report to the project site on several occasions without noticing the City or providing any explanation. JT Construction failed to perform any work on multiple working days and consistently did not utilize each working day to its fullest. City staff proactively offered JT Construction to work extended hours and weekends to get the project back on schedule, but this was not fully taken advantage of by the contractor. A summary of the construction cost is as follows: Original Bid Amount: $ 370,906.00 Actual Cost of Bid Items Constructed: $ 370,906.00 Liquidated Damages (54 days at $1,000/calendar day) $ -54,000.00 Total Change Orders: $ 25,155.50 Final Contract Cost: $ 342,061.50 The final total contract amount was $342,061.50, which was approximately 7.8 percent lower than the original bid amount. This cost decrease was primarily due to the $54,000 dollars of liquidated damages assessed at $1,000 per calendar day resulting from the project being completed 54 calendar days after the approved contract days ended. Approved change orders, totaling $25,155.50 for various items of additional work such as the construction of a new roof system and replacement of additional windows, reduced the decrease in the contract cost from $54,000 to $28,844.50. Funds for the construction contract were expended from the following account: Account Description Utilities Yard Facilities Improvements Account Number i srewIS 70101-980000-23F13 $ 342,061.50 Total: $ 342,061.50 Because the office space is fully utilized by the Water Division, the funds were expensed from Water Enterprise Funds, which generates revenue primarily through water rates collected by service users. ENVIRONMENTAL REVIEW: On January 10, 2023, the City Council found this project exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2 Section 15301(a) (minor interior or exterior alterations involving such things as partitions and plumbing) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential to have a significant effect on the environment. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
