TITLE: Fiscal Year 2022-23 Restroom Rehabilitation — Award of Contract
No. 8905-2 (23F02)
ABSTRACT:
The City of Newport Beach has received construction bids for the Fiscal Year 2022-23
Restroom Rehabilitation project and requests City Council approval to award the
construction contract to iBuild Spectrum, Inc. of Santa Ana. This project rehabilitates four
deteriorated restrooms located at Orange Street, 58th Street, Port Carney Place, and
Port Westbourne Place with new roofing systems, plumbing fixtures, Light Emitting Diode
lights, and autolocking doors.
RECOMMENDATIONS:
a) Find this project exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15301(d), Class 1 (restoration or rehabilitation of deteriorated
facilities involving negligible or no expansion of existing use) of the CEQA Guidelines,
because this project has no potential to have a significant effect on the environment;
b) Approve the project plans and specifications;
c) Award Contract No. 8905-2 to iBuild Spectrum, Inc. for the bid price of $1,200,000 for
the FY 2022-23 Restroom Rehabilitation, and authorize the Mayor and City Clerk to
execute the contract; and
d) Establish a contingency of $180,000 (approximately 15% of total bid) to cover the cost
of unforeseen work not included in the original contract.
DISCUSSION:
As part of the annual Facilities Maintenance Master Plan (FMMP) program, staff identified
the restrooms at Orange Street, 58th Street, Port Carney Place, and Port Westbourne
Place as needing repairs. These facilities are between 35-50 years old and are
experiencing deterioration due to their age.

This project will upgrade the roofing systems to better protect the buildings from potential
water damage, upgrade the lights to Light Emitting Diodes (LED) fixtures, and update the
plumbing fixtures to meet American with Disabilities Act (ADA) standards. Additionally, in
accordance with recent City Council direction, an addendum was issued to the bid
package to install automatic locking systems on all the entry doors.
At 2 p.m. on November 1, 2023, the City Clerk opened and read the following bids for this
project:

The City of Newport Beach received eight bids for this project. The apparent low bidder,
LOENGREEN, Inc., was deemed non -responsive since the contractor did not submit the
necessary bid documents as required in the Instructions to Bidders and would not
self -perform more than half the contract work. The second lowest bidder, A 2 Z Construct,
Inc., was deemed non -responsive due to the lack of listed subcontractors and lack of
appropriate licensure to accomplish the work.. The third lowest bidder, iBuild Spectrum,
Inc., possesses a California State Contractor's License Classification "B", as required by
the project specifications. A review of references for iBuild Spectrum, Inc. shows
satisfactory completion of similar contracts for other municipalities.
iBuild Spectrum's bid came in at approximately 4% below the Engineer's Estimate of
$1,250,000.
Pursuant to the contract specifications, the contractor will have 120 consecutive working
days to complete the project. Work is scheduled to start in January 2024.
The project plans and specifications will be available for review at the November 28, 2023
City Council meeting or upon request.
FISCAL IMPACT:
The adopted budget includes sufficient funding for this contract. It will be expensed to the
Facilities Maintenance Master Plan (General Funds) accounts in the Public Works
Department, 01201925-19F02 and 57101-23F02.

Staff recommends establishing $180,000 (approximately 15% of total bid) for contingency
purposes and unforeseen conditions associated with construction.

this project has no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
