The area surrounding Hoag Hospital has now become extremely congested due to the high -density development of the land. Hospital Road was recently widened to help expedite the flow of traffic, yet at the same time, the City of Newport Beach removed all street parking on both Placentia and Hospital Roads. The present Hoag Hospital Building Program has added to the congestion of this area as construction personnel compete for full -day parking wherever it is available. As a result, those living or doing business in Hoag Hospital - Park Lido area must now totally rely on the off-street parking facilities that are supposed to be provided for them. When a commercial building's parking facilities are not adequate and fail to provide the minimum off-street parking spaces that the City requires, then unnecessary hardships are imposed upon those people who cannot find parking available when needed. The Park Lido Professional Building, of which I am a tenant, has been found to be in violation of the City's Building Department off-street parking code. I understand that you, as the City Attorney, have advised the William Messenger Corporation of this law infraction, and have instructed them to bring it up to code. However, as of this date, there has been no correction made nor does it appear that any effort is being made to remedy this problem. Your help in getting this problem corrected will be greatly appreciated by the tenants and patients of the Park Lido Professional Building. There is certainly no question that the present parking facilities are greatly inadequate and even if brought up to what I understand is the requirement of the city building code at the time the building was built it would still be less than desirable. I have only second hand information but I am told that the parking spaces required by city ordinance at the time the building was built was not met by the number of spaces provided. If this is in fact true, I would be very anxious to learn how such a situation can come about knowing that each phase of construction requires an inspection. The parking in the lot has become atrocious. I have started a petition in my office of people who have had difficulty finding parking areas. During the past week I have had more than fifty complaints live with this office about the lack of adequate parking facilities; often times people have to drive around five to ten minutes awaiting someone else to move their automobile so that they have a place to .park their car. Approximately two weeks ago while arriving at the Hoag Memorial Hospital at 7:15 in the morning I found approximately sixty-two cars already parked in the parking lot which obviously were not patients, doctors or clients of the building, but actually nurses and attendants at Hoag Hospital parking in the parking lot. We have repeatedly expressed our extreme displeasure to the Bill Messenger Company regarding the very limited parking with absolutely no results. During a time interval that there was a Guard on each entrance into the parking lot there was at least one-fourth of the lot empty at all times and there was never a complaint. Once the Guards fulfilled their temporary obligation and left the parking lot immediately filled up with the Hoag Hospital employees again. Therefore, I rather vehemently complain that the area needs to be poi iced either in the manner of further guards or gates on the parking area or a double decking must be made for the hospital parking area. In my own mind I am sure that people will be leaving this building shortly to find other Physicians where there are adequate parking areas which in turn will markedly hurt the practices within this building area. I strongly urge you to take severe legal action against the Bill Messenger Company to provide 1) additional parking area for the Park Lido Medical Building or 2) limitation of the parking spaces for patients and doctors and assistants of the building only. I have contacted Mr. Foley in the Planning Department, and he stated that he turned our problem over to you. The physicians in this building are in a very difficult position. The owner of the building, The William Messenger Corporation, has over the past several years reduced the parking spaces provided to the point where patients are unable to find adequate parking, or are late for their appointments because they cannot find a parking space. I would not be surprised if some of them might well be seeking medical care elsewhere because of this problem. I have been told by Mr. Foley that the Planning Commission has notified the Messenger Corporation last June that the number of parking spaces had been reduced below the"number of spaces required by the City Code at the time the building was constructed. Since the situation is critical and since we have no legal recourse other than turning to the City for help, I hope that you can persuade the Messenger Corporation to correct this deficiency as soon as possible. I understand that the parking spaces are below city code in number, and that the Wm. Messenger corp. was so informed last June. For a short period the Wm. Messenger Corp. placed parking guards in the parking lot entrances to help the over parked situation. However, at this time we no longer have guards and no promise of the resumption of control of parking bringing back over population•ofthe parking. Since last June there has been no action on the part of the Wm. Messenger Corp. to comply with the parking code and therefore I'm sure the city will have to take steps to enforce its laws. My patients complain every day that they have difficulty finding a parking place to keep their appointments. They tell me they must drive around and around and around, and sometimes cannot find a place at all within our assigned parking lot. This is affecting my practice. It is my understanding that the owner of this building is not complying with a City Ordinance concerning the amount of park- ing available in public buildings. Since this has been of such concern to all the tenants in this building, it is my hope that anything at all that can be done to improve our parking facilities will be taken bare of with the utmost priority. Lundell of the William Messenger Corporation concern- ing the deficiency in parking spaces provided to the Park Lido Professional Building, as outlined in your letter of June 27, 1973 addressed to Mr. Lundell. It is our understanding that during the ensuing period the William Messenger Corporation has taken no action indicating an intention on its part to find a solution to the problem. The effect of the shortage of parking spaces has grown more acute with the passage of time. The tenants of the building now are experiencing regularly late arrivals by a substantial number of their patients, who have had to circle through the parking lot several times before being able to find a parking space, or failing to find any parking space within the lot at all have gone elsewhere to park, necessitating a walk of some distance back to the building. These late arrivals disrupt each physician's work schedule for the rest of the day, causing inconvenience to patients who themselves have been late and patients who have managed to arrive on time alike. This is not to mention the hardship suffered by some patients who have to walk to the building from some remote parking space. Occasion- ally a patient is unable to make this walk, due to the condition for which he is consulting the doctor, and these patients do not arrive for their appointments at all. Many of the patients who do arrive have made the extra effort while undergoing pain, discomfort and other symptoms of their present illness. The Park Lido Professional Building Tenants Association feels that some positive action needs to be taken by the City in order to induce any response by the owner of the building. Although your letter states that the parking lot serving the building presently provides 250 parking spaces, Dr. Skinner tells me that 240 spaces is the actual number. You may wish to correct your file in that respect. The use of some compact car parking spaces in the enlarge- ment of the existing parking lot has been given preliminary consideration, and in response to your inquiry as to the views the Association would have on this I must state that there would appear to be serious reservations about it. The biggest problem is that no one knows any way to be sure that compact cars will use the compact car spaces, and it would be likely that on some occasions all of the regular sized spaces would be filled, some with compact cars, while there would be empty spaces in the compact car section. What this means in my mind is that a parking lot offering compact car spaces together with regular sized car spaces must have a larger number of spaces in the aggregate than a parking lot offering only regular sized spaces in order to do the same job. I suspect that this aspect will be considered one of the more important matters to be considered in de- termining whether or not an amendment to the existing park- ing ordinance will be proposed to allow a certain percentage of compact car spaces. In view of the fact that no amend- ment to the parking ordinance has as yet been proposed, and it is not now known whether such an amendment will be pro- posed, the additional fact that the present parking code Page 2 July 13, 1973 Mr. William R. Foley • • would require a larger number of automobile parking spaces to serve the building than was required by City ordinance at the time the building wasconstructed, and also that the re- quired additional number of standard car spaces can be pro- vided on the site as it now exists, I believe the Association will feel that the enlargement of the parking lot should be in terms of standard auto obile parking spaces only. Every tenant has been besieged with com- plaints. It was only by delivering an ultimatum recently to Mr. Messenger that guards have been posted at the two driveways who daily turn away hundreds of people who desire to use the lot to visit other buildings, especially Hoag North Unit. It has been our contention for a long time that the parking lot does not meet the code. We have requested Mr. Messenger to remedy the situation and he has refused. I have been instructed by the board of the Tenants Association to bring this matter to your attention and request an investigation of the existing lot and a determination as to whether it is in code conformity. According to our own research, the building is in noncon- formity with the code requirements since construction of the Park Lido South Building in 1970. The corporation responsible for construction of the Park Lido Building in 1963 presented the following information to the City Planning Commission: The calculated net floor area of the Park Lido Building is 64,830 square feet. It was the intention of the builder to provide 240 parking spaces in the large parking lot adjacent to the building, and another 80 parking spaces across the street. (The area across the street is now in use by the Park Lido South Building.) With application for a building permit for the Park Lido South Building, Mr. William Foley of the City Planner's office states that the Messenger Corporation maintained that it could provide adequate parking in the main lot. February 9, 1970. • As you will recall, your letter raised four problems and the disposition of these is as follows: Dana Road Landscaping Maintenance. Your letter indicates that the parkway on the north side of Dana Road adjacent to the Hughes Aircraft Company Plant is constantly littered and does not receive regular cleaning. The letter also suggests that because 'the City owns a one, foot strip of land.at the parkway between Superior Avenue and Flagship Road, that the parkway be maintained by the City. 'This mat ter was also raised in a March .16, 1970 letter to the City of Newport Beach from Mr. Mike Schloessman of Harbor Manage- ment Company, Inc. It is true that the City does own a one foot strip on Dana Road. However, although it was cleaned by City forces this time, the parkway itself does not qualify for maintenance by City forces under City Council arterial highway landscaping policies. Rather, it is the responsibilitybf the abutting property owner - in this case, Hughes Aircraft - to maintain" this area. This matter has been discussed with Mr. D. G. Grose of Hughes by the City Parks, Beaches $ Recreation Director, and Hughes has agreed to assume this responsibility. ,2.' Dana Road'Parking Problems. You request that the north side of Dana Road be posted for restricted parking between'6:00 a:m. and 9:00 a.m. daily. Upon the recommendation of the City Traffic Engineer, the City Council at their meeting of Feb- ruary 24, 1970, has prohibited parking on the northerly side of Dana Road between Orion Way and Superior Avenue from 6:00.a.m. to'9:00:aan. except Saturdays, Sundays and holidays.. Mr: Daren Groth March 24, 1970 . 3. Police Patrol on Dana"Road. Your letter alleges that Dana Road has become a "drag strip" over the past two years. Dana Road is a fairly heavily traveled street in the Park Lido homes area because it is one of two streets that provide a direct route through the tract. A check of Police Depart- ment records discloses that since February, 1968, there has been only one traffic accident reported and that occurred, in May of 1968. There is also no evidence to indicate the fact that the Police Department has been apprised of a continuing problem on Dana Road over the past two years. Patrol and traffic officers, however, have been instructed to give additional attention to this section of street and speed enforcement, perhaps through the use of radar, will be attempted. A. 'Noise'Problem at Hughes Industrial'Plant. Your letter comments on an alleged disruptive noise problem emanating from the Hughes Industrial Plant. Mr. D. G. Grose, Administrative Manager for Hughes, Newport Beach, was contacted regarding this problem, and, as the attached letter indicates, he has reaffirmed the.commitment of the company last made on Sep- tember 9, 1969, to "again take corrective action as soon as possible." The staff also contacted the Park Lido Convalescent Hospital, however, and we find no report of complaints from either patients.or staff members on the 11:00 p.m. to•7:00 a.m. shift of a noise problem from the plant as it relates to the hospital. We would hope this report will meet with the satisfaction of the Park Lido Association. There is, however, one small matter yet to be resolved. When the Parks, Beaches, and Recreation Director met with Mr. D. G. Grose of Hughes to discuss landscaping maintenance responsibilities on Dana Road, neither party was able to locate a sprinkler control valve for the sprinkler system that has been installed in the parkway. The Hughes landscape gardener was also in attendance at this meeting. There is a possibility that this system and, in fact, the landscaping, may have been installed some time ago by the Park Lido Community Association and that the controls for this sprinkler installation and the water meter are located somewhere on your community association property. If it would meet with the approval of the association, the Hughes gardener could come on to community associ- ation property to water the parkway on a regular basis, or it could be watered by association maintenance personnel. Our records indicate that deliveries made between 10:00 p.m. and 7:00 a.m. have been minimal and that the vendor did utilize gravity feed rather than an auxiliary motor. We were not aware of excess noise and again must take steps to determine the cause of these further complaints. We have instructed our guards to log the time of all water and gas deliveries during the off -hours and to. report any excess noise. Buck, Jr., Rejac Corp., Park Lido Association, Inc. , et al, were acquired in September of 1964. 2. Prior to acquisition of the property by this corporation, the property had been landscaped and maintained by Buck, et al. 3. Upon acquisition of this parcel of property by our corporation, Buck, et al, refused to continue maintenance of the landscaped area and said it was of no importance to their development. 4. The property has primarily been used by the residents of the Park Lido homes as a play yard, putting green, etc. 6. Pursuant to a letter dated November 23, 1965, from Mr. Carl M. Buck, Jr. , and our letter of November 29, 1965, copies of which are enclosed, we agreed to permit Buck, et al, to use the adjacent parking area pursuant to the provisions of said letters. We have received no rental payments as set forth therein. Needless to say, the rental set forth therein is ridiculously low and the arrangement was effected purely as an accommodation to Mr. Buck and the Park Lido residents. 7. Prior to these letters of November, 1965, we had closed the parking area to all but tenants of the Park Lido Professional Building, their guests and invitees. The tone and subject matter of Mr. Buck's letter is apparently based upon the telephone conversation between Mr. Buck and the undersigned. In this conversation, we advised Mr. Buck that payments had not been made on the parking lot agreement. We also advised that in our opinion the Park Lido Association, Inc., should maintain the landscaped area since it is primarily used for their benefit. We advised that we may not continue such landscape maintenance. Mr. Buck declined on behalf of the Park Lido Association, at which point we advised that we would write the association and request that they assume the maintenance obligation on this property.
