Regarding the handicap parking requirements for Newport Lido, Philip Scarpine has spoken with
both John DePietro (concerned citizen) and the state (Paul Smith, Caltrans). I also was privy to a
conversation with Mr. Smith to clarify the requirements for disabled access to our project.
In addition to the new handicap accessibility ramp to be installed in front of the 361 building, Mr.
Smith confirmed that a total of fifteen (15) handicap spaces were required, seven (7) at the 351
building and eight (8) at the 361 building. Therefore, Philip is submitting to you for city approval
a revised drawing showing the new layout There will be seven (7) spaces in front of 351 and seven
(7) in front of 361, with one (1) additional space, for a total of eight (8), at the rear entrance to the
building (and near the Newport Beach Surgery Center's rear entrance).
Faysal, as a point of reference only, I am sure you are aware that the Newport Beach Surgery
Center utilized three (3) parldng spaces in the parldng structure (Level 3B) to locate their emergency
generator set-up.
The original calculations done (and city approved) for the project indicated a requirement of 648
total parking spaces. A total of 666 spaces were actually installed/constructed. The above -
referenced revisions reduces this amount to a new total of 657 spaces, including the 15 handicap
spaces. This is still over and above the minimum requirment of 648 total spaces.

(c) Parking Space Size. Physically handicapped/disabled parking spaces shall be located as near as
practical to a primary entrance. Where single spaces are provided, they shall be 14 feet wide and
outlined to provide a 9-foot parking area and a 5-foot loading and unloading area on the passenger
side of the vehicle. When more than one space is provided in lieu of providing a 14-foot-wide space
for each parking space, two spaces can be provided within a 23-foot-wide area lined to provide a 9-
foot parking area on each side of a 5-foot loading and unloading area in the center. The minimum

FINAL FINDINGS AND CONDITIONS OF APPROVAL
FOR TRAFFIC STUDY NO, 51 AND USE PERMIT NO. 3279
APPROVED BY CITY COUNCIL
OCTOBER 10, 1988
A, Environmental Document
Findings:
1. That an Initial Study and Negative Declaration were prepared and
adopted for an essentially identical project in compliance with the
California Environmental Quality Act, and that their contents have been
considered in the decisions of this project.
2. That based on the information contained in the Negative Declaration,
the project incorporates sufficient mitigation measures to reduce
potentially significant environmental effects, and that the project
will not result in significant environmental impacts.
B. Traffic Study
Findings:
1. That a Traffic Study has been prepared which analyzes the impact of the
proposed project on the circulation system in accordance with Chapter
15.40 of the Newport Beach Municipal Code and City Policy S-1.
2. That the Traffic Study indicates that the project generated traffic
will be greater than one percent of the existing traffic during the 2.5
hour peak period on any leg of the critical intersections, but will not
add to an unsatisfactory level of traffic service at any critical
intersection which will have an Intersection Capacity Utilization of
greater than .90.
Use Permit No. 3279
Findings:
1. That the project will comply with all applicable City and State
Building Codes and Zoning requirements for new building applicable. to
the district in which the proposed project is located, except those
items requested in conjunction with the proposed modifications,
2. That the proposed use is consistent with the Land Use Element of the
General Plan, and is compatible with surrounding land uses.
3. The project lot size conforms to the Zoning Code area requirements.
4. That adequate off-street parking and related vehicular circulation will
be provided in conjunction with the proposed development.
5. That the proposed number of compact car spaces constitutes 25 percent
of the parking requirement which is within limits generally accepted by
the Planning Commission relative to previous similar applications.
6. That the increased building height will result in more public visual
open space and views than is required by the basic height limit.
7. That the increased building height will result in a more desirable
architectural treatment of the building and a stronger and more
appealing visual character of the area than is required by the basic
height limit.
8. That the increased building height will not result in undesirable or
abrupt scale relationships being created between the structure and
existing developments or public spaces.
9. That the structure will have no more floor area than could have been
achieved without the use permit for the building height.
10. That the proposed use permit to exceed the basic height limit will not,
under the circumstances of the particular case, be detrimental to the
health, safety, peace, comfort and general welfare of persons residing
or working in the neighborhood of such proposed use or be detrimental
or injurious to property and improvements in the neighborhood or the
general welfare of the City and further that the proposed modification
is consistent with the legislative intent of Title 20 of this Code.
11. That adequate security is necessary to insure use of the parking
structure.
12. That the design of the proposed improvements will not conflict with any
easements acquired by the public at large for access through or use of
the property within the proposed subdivision.
13. That public improvements may be required of a developer per Section
20.08.060 of the Municipal Code.
14. That under the previously approved project and development agreement,
the developer was required to construct traffic mitigation improvements
at the intersection of Hospital Road and Newport Boulevard. The City
constructed those improvements in anticipation of the previously
approved development on the site and incurred construction costs in
excess of $90,000, and in view of previous agreements, it would be
reasonable for the developer to contribute a proportionate share of

21. That the structure and parking lot lighting system shall be designed
and maintained in such a manner as to conceal the light source and to
minimize light spillage and glare to the adjacent residential and
convalescent home uses. The plans shall be prepared and signed by a
licensed Electrical Engineer with a letter from the engineer stating
that, in his/her opinion, this requirement has been met.
22. Should any significant historical or scientific resources be uncovered

that all work on the site be done in accordance with the City Council's
Policies K-5 and K-6.

Limitation District. The proposal also
includes a modification to the Zoning
Code so as to allow the use of compact
size parking spaces for a portion of the
required off-street parking, and the
acceptance of an Environmental Document.
Located on property at 351 Hospital
Road on the northeasterly corner of
Hospital Road and Placentia Avenue,
across from Hoag Memorial Hospital.
Report from the Planning Department, was
presented.
Letters from Darel, Martha, David and
Hansel Benvenuti requesting denial of

Jerry King, No. 1 Civic Plaza, Newport
Beach, representing the applicant,
addressed the Council and described the
proposal as exhibited in a model on
display.
He stated that the project includes 80
additional offices and comprehensive
remodeling of the existing structure,
and a three level subterranean parking
garage which will house 648 vehicles.

Dr. Norman W. Specht, 351 Hospital Road,
addressed the Council and stated that he
has had his practice in the Park Lido
building for over 10 years, and is very
concerned about the proposed
construction, particularly the noise,
and the loss of parking during the
construction period. He stated he felt
some type of safeguards should be
imposed to protect the patients that use
their building for medical treatment and
service.
Dr. Arthur Strick, 351 Hospital Road,
addressed the Council and stated that he
has had his office in the Park Lido
building for over 16 years, and that he
was also very concerned about their
parking lot being "torn up" during the
construction period. He stated that
many of their patients are very old and
should not be subjected to the
inconvenience the proposed project will
bring. He does not feel that the
patients will appreciate parking away
from and being "shuttled" to their
office, and then back to their cars
again. He also stated he did not feel
that all the doctors in the Park Lido
building were in agreement with the
proposal. He further felt the
construction will affect the normal
course of business and the practices of
every tenant in the building, in
addition to increasing the cost of
medical care.
Mr. King addressed the Council again and
stated that they are cognizant of the
concerns of the medical professionals in
the Park Lido building; however, it will
take a cooperative effort of all parties
concerned to minimize the problems and
speed the development of the project.
They are taking what steps they feel are
necessary to make it a smooth
transition.
Hearing no others wishing to address the
Council, the public hearing was closed.

and $6.i0 per mile or fraction thereof.
It is th- opinion of the staff that the
rate increase is justified; however, as
noted in a memo from the Fire
Department, it has become necessary to
open ambulan e services to more
competition. The exclusive arrangement
now enjoyed b Seal's will be bid for by
other provider within the next few
months, and if e Council desires, the
present request :n be disapproved at
this time until a ew rate structure
will be considered fter the completion
of the competitive . ocess.
Larry Seal of Seal's ..bulance,
addressed the Council . d stated that
their basic rate for ci es other than
Newport Beach is $96.00, nd $6.00 per
mile. The City of Newpor Beach is
presently being charged $7 .00 for the
basic rate and $5.00 per mi e. He
stated that his insurance pr miums have
doubled, rent has increased, mployee
wages have increased, and they fore, he
needs to increase his rates in rder to
continue providing quality servi e. He
added that the City of Newport Be ch's
ambulance rates are the lowest in range
County.
