On January 15, 1987 , the California Coastal Commission granted to
Hoag Memorial Hospital Presbyterian
this permit for the development described below, subject to the attached
Standard and Special Conditions.
DESCRIPTION AND SITE:
Construction of a three -floor; 50,000 square -foot Cancer Center to Hoag
Memorial Hospital. The project includes a pedestrian walkway system, a
service road at the proposed third floor level and extension of the main
hospital access road with 98-space parking lot. The project also includes
approximately 57,500 cubic -yard excavation of the bluff and on -site deposition
of the cut material.
Site: 4000 West Pacific Coast Highway, Newport Beach, Orahge County.

STANDARD CONDITIONS:
1. Notice of Receipt and Acknowledgement. The permit is not valid and
development shall not commence until a copy of the permit, signed by the
permittee or authorized agent, acknowledging receipt of the permit and
acceptance of the terms and conditions, is returned to the Commission
office.
2. :Expiration. If development has not commenced, the permit will expire two
years from the date on which the Commission voted on the application.
Development shall be pursued in a diligent manner and completed in a
reasonable period of time. Application for extension of the permit must
be made prior to the expiration date.
3. Compliance. All development must occur in strict compliance with the
proposal as set forth below. Any deviation from the approved plans must
be reviewed and approved by the staff and may require Commission approval.
4. Interpretation. Any questions of intent or interpretation of any
condition will be resolved by the Executive Director or the Commission.
5. Inspections. The Commission staff shall be allowed to inspect the site
and the development during construction, subject to 24—hour advance notice.
6. Assignment. The permit may be assigned to any qualified person, provided
assignee files with the Commission an affidavit accepting all terms and
conditions of the permit.
7. Terms and Conditions Run with the Land. These terms and conditions shall
be perpetual, and it is the intention of the Commission and the permittee
to bind all future owners and possessors of the subject property to the
terms and conditions.
SPECIAL CONDITIONS:
1. Deposition of Excavated Material.
Prior to the transmittal of this permit, the applicant shall submit for
the Executive Director's approval a plan for the on —site storage of any
excavated material. Such plan shall insure that the material is
stabilized to prevent any movement of material into any on or off —site
wetlands and shall not cover any on —site areas supporting marsh or wetland
vegetation.
2. Future Development.
By acceptance of the permit, the applicant acknowledges that the
Commission will not approve any further expansion of the hospital facility

until' a Master Plan is completed for the entire area under the control of
the applicant and such Master Plan is supported by a Final Environmental
Impact report. In addition, such Master Plan must make provisions for
-those non —institutional uses identified in the City's Certified Land Use
Plan, and identified as high priority use in the Coastal Act for upland
•areas and as designed to accommodate public access to shoreline areas.
3: 'Landscaping Plans.
Prior to transmittal of the plan the applicant shall submit for the
Executive Director's review and approval a landscape plan for the entire
site. Only drought resistant plant material shall be used for slope area
landscaping. The approved landscaping shall be to minimize the visual
impact of all existing and proposed structures when viewed from Pacific
Coast Highway.
4. Archaeological and Paleontological.
Prior to issuance of permit, applicant shall agree in writing that should
archaeological and/or paleontological resources be disclosed during any
construction phase of the project, all activity which could damage or
destroy these resources shall be temporarily suspended until the site has
been examined by a qualified archaeologist and/or paleontologist, and
mitigation measures have been developed and implemented to address the
impacts of the project on archaeological and/or paleontological
resources. Such mitigation measures shall be reviewed by the State Office
of Historic Preservation and approved by the Executive Director of the
Commission prior to the implementation•.
5. Bicycle Trail.
Prior to transmittal of the permit, the applicant shall submit for the
Executive Director's review and approval a plan and agree to construct a
bike trail connecting the bike trail along the Pacific Coast Highway and
the bike trail easement located on the adjacent property running along the
northerly property line.
6. Assumption of Risk.
•
Prior tp transmittal of the permit, the applicant shall execute and record
a deed restriction, in a form and content acceptable to the Executive
Director, which shall provide: (a) that the applicant understands that
the site may be subject to extraordinary hazard from methane gas and the
applicant assumes the liability from such hazards; and (b) that the
applicant unconditionally waives any claim of liability on the part of the
Commission and agrees to indemnify and hold harmless the Commission and
its advisors relative to the Commission's approval of the project for any
damage due to natural hazards.

The California Coastal Commission approval (Application No. 5-86-866)
stipulates under condition. No. 3:
"Landscaping Plans.
Prior to transmittal of the plan the applicant shall
submit for the Executive Director's review and
approval a landscape plan for the entire site. Only
drought resistant plant material shall be used for
landscaping. The approved landscaping shall be
installed and maintained by the applicant. The goal
of such a plan shall be to minimize the visual
impact of all existing and proposed structures when
viewed from Pacific Coast Highway."
The condition requires that a landscape plan be prepared for the entire
20.6-acre site owned by Hoag Hospital. However, the Coastal Development
Permit request was for the development of a Phase One, 2+ acre area only.
The landscape plan should be considered an "interim" landscape plan,
reflecting the understanding that those portions of the site which are out-
side of the Phase One 2+ acre area will certainly be modified as further
development phases occur. It should also be noted that development 'of
subsequent phases will be the subject of future Coastal Development Permit
requests (see condition #2 of this CDP). The future Coastal Development
Permit application may be conditioned upon the provision of landscape and
re -landscape plans.
One difficulty encountered in the attempt to prepare landscape plans for
the entire 20.6-acre site is that major Caltrans and sewer easements exist
onsite parallel and adjacent to Pacific Coast Highway. Those who hold
title to those easements indicate that there will be activity within those
easements. The most significant will be the proposed widening of Pacific
Coast Highway. Thus, when preparing the attached interim landscape plan,
it did not make sense to propose landscaping within the easements. The
landscape plan divides the site into six zones as described below:
Zone 1 Development Area
A. Landscaping of cancer center site, access roadways, parking lots
and walkways. Salt -tolerant ornamentals are appropriate.
B. Landscaping of slope areas created by cut/fill conditions.
Drought -tolerant plant materials are highly recommended.
C. Landscaping of slope between the cancer center physician/ staff
access road and Villa Balboa condominiums. Low growing, drought -
tolerant plant materials are required. Ocean and turning basin
view blockage from Villa Balboa is not permitted.
D. Landscaping of any required repair of existing facilities damaged
by construction.
Zone 2 Bluff Top
A. Dry broadcasting of seeds along the tops of the cut slope, to be
watered by natural rainfall only.
Zone 3 Slope Face
A. Maintenance of slope stability through non-interference.
Zone 4 Existing Vegetation
A. Existing plant materials to remain undisturbed.
Zone 5 Level Area
A. This area (Zone 5A) to be utilized for temporary storage of con-
struction equipment and materials.
B. Dry broadcasting of seeds in Zone 5B, to be watered by natural
rainfall only.

A. Existing vegetation not to be removed until Caltrans drainage/
widening construction commences.
