R E C I T A L S: A. Declarant is the owner of certain real property located in the City of Newport Beach, County of Orange, State of California, described as Lots 1 through 6, inclusive, of Tract No. 12873, as per map recorded in Book J'-", Pages z Z through 2�1, inclusive, of Maps, Records of Orange County, California (the "Properties"). B. Declarant has deemed it desirable to impose a general plan for the improvement and development of the Properties, the adoption and establishment of covenants, conditions and restrictions on the Properties and each and every lot and portion thereof and the use, occupancy and enjoyment thereof, all for the purpose of enhancing and protecting the value, desirability and attractiveness of the Properties. C. Declarant will convey title to all of the lots in the Properties subject to this Declaration as set forth below. NOW, THEREFORE, Declarant hereby covenants, agrees and declares that all of the Properties shall be held, sold and conveyed subject to these covenants, conditions and restrictions which are hereby declared to be for the benefit of the entire tract and all of the Properties and owners thereof, their 87-60510 successors and assigns. These covenants, conditions and restrictions shall run with the Properties and shall be binding on all parties having or acquiring any right, title or interest in the Properties or any part thereof and shall inure to the benefit of each owner thereof and are imposed upon the Properties and every part thereof as a servitude in favor of each and every parcel thereof as the dominant tenement or tenements. -2- s 10,2,87 * 87-60529P indicated: I DEFINITIONS The terms set forth below shall have the meaning 1.01 "Building Envelope" shall mean that portion of a Lot in which a home may be constructed as defined by the applicable setback requirements and height limits set forth herein and in the governing documents. 1.02 "City" shall mean and refer to the City of Newport Beach, California, a municipal corporation. 1.03 "Covenants" shall mean and refer collectively to the covenants, conditions, restrictions, reservations, easements, liens and charges imposed by or expressed in this Declaration. 1.04 "Declarant" shall mean and refer to PARK PLACE, a California general partnership, its successors and assigns, if such successors and assigns should acquire more than one undeveloped Lot from Declarant for the purposes of development. 1.05 "Lot" shall mean and refer to Lots 1 through 6, inclusive, of Tract No. 12873, as shown on the recorded subdivision map of the Properties, with the exception of all public streets and alleys, if any. 1.06 "Owner" shall mean and refer to the record Owner, whether one or more persons or entities, of a fee simple title to any Lot which is part of the Properties, including contract purchasers, but excluding those having such an interest merely as security for the performance of an obligation. 1.07 "Project" shall include the Properties and all improvements located thereon. 1.08 "Properties" shall mean and refer to that certain real property located in the City of Newport Beach, County of Orange, State of California, described as Lots 1 through 6, -3- 88-081982 ' 10/2/87 87-605290 inclusive, of Tract No. 12873, as per map recorded in Book r93 , Pages Z�?-through inclusive, of Maps, Records of Orange County, California. -4- 10/2/87 87 5-60190 88-08198'2 NATURE AND PURPOSE OF COVENANTS The covenants, conditions and restrictions set forth in this Declaration constitute a general scheme for the development, protection and maintenance of the Properties to enhance the value, desirability and attractiveness of the Lots for the benefit of all Owners. These covenants, conditions and restrictions are imposed on Declarant and upon the Owners of all Lots. Said covenants, conditions and restrictions are for the benefit of all Lots and shall bind the Owners thereof. Such covenants, conditions and restrictions shall be a burden upon, and a benefit to, not only the original Owner of each Lot but also his successors and assigns. All of such covenants, conditions and restrictions are intended to be and are hereby declared to be covenants running with the land or equitable servitudes upon the land, as the case may be. -5- . . _.- ""-." _..._ ...___. ��. J I ! 8715290 88-081982 10/2/87 III RESTRICTIONS 3.01 Use of Lots. No Lot shall be used for anything other than residential purposes. No building shall be erected, altered, placed or permitted to remain on any Lot other than one detached single-family dwelling, and shall conform to the City's set -back and height restrictions and those additional building restrictions as set forth in Exhibit "A" attached hereto. 3.02 Easements. Easements for installation and maintenance of utilities and drainage facilities are created as shown on the recorded tract map of the Properties or as otherwise granted to utility companies or to Owners of Lots within the Properties. Within these easements, no structure, planting or other material shall be placed or permitted to remain which may damage or interfere with the installation and maintenance of utilities, or which may change the direction or flow of drainage channels in the easements, or which may obstruct or retard the flow of water through drainage channels in the easements. The easement area of each Lot and all improvements in it shall be maintained continuously by the Owner of the Lot, except for those improvements for which a public authority or utility company is responsible. 3.03 Nuisances. No noxious or offensive activity shall be carried on upon any Lot, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. 3.04 Temporary Structures. No structure of a temporary character, trailer, basement, tent, shack, garage, barn, or other outbuilding shall be used on any Lot at any time as a residence either temporarily or permanently. -6- 10/2/87 87-A90 88-081982 3.05 Parking and Vehicular Restrictions. No Owner shall park, store or keep any vehicle, except wholly within the parking area designed therefor, and any inoperable vehicle shall be stored only in enclosed garages. No Owner shall park, store or keep on any property, street (public or private), unenclosed parking space or driveway within the Properties any large commercial -type vehicle (including, but not limited to, any dump truck, cement mixer truck, oil or gas truck or delivery truck), any recreational vehicle (including, but not limited to, any camper unit or motor home), any bus, trailer, trailer coach, camp trailer, boat, aircraft, mobile home, inoperable vehicle or any other similar vehicle or any vehicular equipment, mobile or otherwise. The above excludes camper trucks and similar vehicles up to and including three-quarter (3/4) ton when used for everyday -type transportation. No Owner of a Lot shall conduct repairs or restorations of any motor vehicle, boat, trailer, aircraft or other vehicle upon any portion of any Lot, except wholly within the Owner's garage, and then only when the garage door is closed. Garage doors shall remain closed except for reasonable periods while the garages are being used. 3.06 Oil and Mineral Extraction. No oil drilling, oil development -operations, oil refining, quarrying or mining operations of any kind shall be permitted upon or in any Lot, nor shall oil wells, tanks, tunnels, mineral excavations or shafts be permitted upon or in any Lot. No derrick or other structure designed for use in boring for oil or natural gas shall be erected, maintained or permitted upon any Lot. 3.07 Animals. No animals, livestock, or poultry of any kind shall be raised, bred or kept on any Lot, except that dogs, cats or other usual household pets may be kept provided that they are not kept, bred, or maintained for any commercial purpose. -7- 10 /a 87 ` 87-6000 86-081982 3.08 Rubbish Disposal. No Lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be kept in sanitary containers and must be screened from view. All containers for the storage or disposal of refuse shall be kept in a clean and sanitary condition and in accordance with all requirements of the City of Newport Beach. 3.09 Commercial Use. No Lot or portion thereof shall ever be used or caused to be used for any business, commercial, manufacturing, mercantile, storing, vending or other nonresidential purposes, except that Declarant, its successors or assigns may use the Properties for a model home site, and display and sales and rental office during the construction and sales period. Nothing herein shall be deemed to prevent the leasing of any Lot or any dwelling units thereon from.time to time by the Owner thereof for residential purposes only. 3.10 Party Walls and Fences. Fences and walls shall be constructed of stucco, concrete or masonry finish material. Those Owners who have a common wall or fence adjoining their Lots and such a wall or fence dividing the Lots upon which their homes are constructed, shall equally have the right to the use of such wall or fence. Neither Owner shall use any portion of the wall or fence so•as to interfere with the use and enjoyment of the other Owner. In the event that any portion of such wall or fence, except the interior surface of one side, is damaged or injured from any cause, other than the act or negligence of either party, it shall be repaired or rebuilt at their joint expense in substantial conformance with the original design and materials used for such wall or fence. 3.11 Damage to or Destruction of Improvements. As soon as reasonably possible following damage or destruction by fire or casualty affecting any improvement upon a Lot, the Owner thereof shall reconstruct the same in accordance with the conditions and restrictions contained in this Declaration and the requirements -8- • - �190 1O/2/87 87 605 88-081982 of the City of Newport Beach, so that the improvement substantially resembles the quality as prior to such damage or destruction. 3.12 Drainage. Each grantee of a Lot in the Properties agrees for himself and his assigns that he will not in any way interfere with the established drainage pattern over his Lot from adjoining or other lots in said tract, or that he will make adequate provision for proper drainage in the event it is necessary to change the established drainage over his Lot. For the purpose hereof, "established" drainage is defined as drainage which occurred at the time the overall grading of said tract, including the landscaping of each Lot in said tract, was completed by the undersigned grantor. 3.13 Building Envelope and Height Restrictions. Construction, exterior additions, reconstruction or alterations shall be constructed within the Building Envelope as depicted in Exhibit "A" attached hereto. The building envelope serves to preserve outward oriented ocean and bay views. Some Lots vary from required setbacks, heights and Building Envelope to allow for view corridors as depicted on Exhibit "A" attached hereto. 3.14 View Obstruction. No vegetation shall be planted' anywhere on -,a Lot if to do so may interfere with the ocean or bay view from any Lot within the Project. Fences must comply with the requirements of the City of Newport Beach. Lot 3 shall have a maximum three foot (3') high fence on the easterly side of the building envelope to the curb. In the event of a dispute between Lot Owners as to the obstruction of a view, such dispute shall be submitted to binding arbitration, which decision in such matter shall be binding. 3.15 Solar Equipment. Solar panels are to be integrated into the roof design or screened from view. Panels and frames shall be bronzed, anodized or colored to match roof. -9- 10/2/87 87lb5290 3.16 Antennas. All antennas ate restricted to within the Building Envelope and shall not extend beyond the roof line. 3.17 Accessory Structures and Decks. Patio structures, gazebos, trellises and sun shades are not permitted on some Lots to protect view corridors as shown and defined in Exhibit "A". Decks are not allowed outside the Building Envelope except at pad levels or less than pad levels, with railings three feet or less in height, with the following exceptions: (a) Lots 1 and 2 - deck in all areas; (b) Lot 3 - deck off the north, west and south sides of the house; deck on east side may be one foot above pad elevation; (c) Lots 4 and 6 - deck in all areas except adjacent to Lot 5 driveway; and (d) Lot 5 - deck off the south side of the house. 3.18 Paving. Driveway and other flat paved areas may be concrete, exposed aggregate concrete, stamped concrete, quarry tile, brick or paving blocks. Asphalt paving within the Lot is prohibited. 3.19 Pools and Spas. Heaters and pumps must be screened from view and sound insulated from neighboring houses. 3.20 Chimneys. Chimneys shall not be allowed on the east side of Lots 2 and 3 outside of the Building Envelope. 3.21 Park View Obstruction. No landscaping or hardscape shall be planted or constructed on the lower portion of Lot 5 at a height which will restrict or interfere with bay or ocean views from the adjacent park. 3.22 Notification Regarding Theater Arts Center. Each Owner of a Lot within the Properties hereby acknowledges the fact that the Newport Beach Theater Arts Center may, at times, have an adverse impact affecting purchasers, tenants and occupants of the Properties due to increased traffic on public streets in the -10- J 1o/2/a7 87-6R290 88-081982 vicinity of the Properties, use of night lighted parking lot, and noise associated with the use of these facilities. Nothing in this section shall be construed to grant to the public access or right of public use for parking or any other purpose over the private street within the Properties. -11- 10/2/87 • 80605290 - 86-081982 IV EASEMENTS 4.01 Utilities. The rights and duties of the Owners of Lots within the Properties with respect to sanitary sewer and water, electricity, gas and telephone and cable television lines and drainage facilities shall be governed by the following: (a) Wherever sanitary sewer house connections and/or water house connections or electricity, gas, or telephone and cable television lines or drainage facilities are installed within the Properties, which connections, lines or facilities, or any portion thereof, lie in or upon Lots owned by persons other . than the Owner of a Lot served by said connections, the Owners of any Lots served by said connections, lines or facilities shall have the right, and are hereby granted an easement to the full extent necessary therefor, to enter upon the Lots or to have utility companies enter upon the Lots within the Properties in or upon which said connection, lines or facilities, or any portion thereof, lie, to repair, replace and generally maintain said connections as and when the same may be necessary. (b) Wherever sanitary sewer house connections and/or water house connections or electricity, gas or telephone or cable television lines or drainage facilities are installed within the Properties, which connections serve more than one Lot, the Owner of each Lot served by said connections shall be entitled to the full use and enjoyment of such portions of said connections as service his Lot. 4.02 Reciprocal Easements for Access. There is hereby created over each of the Lots, for the benefit of all of the Lots and the Owners, reciprocal appurtenant easements ("Easements") over that portion of the Properties shown as a private street ("Private Street") on the recorded final subdivision map for Tract 12873. Such reciprocal Easements shall be for the purpose -12- 10j2/87 0 8P605290 88-081982 of providing pedestrian and vehicular ingress and egress to all of the Lots and all uses reasonably related thereto. Declarant intends that the scope of the Easements shall be interpreted in a broad manner for the purpose of allowing all activity consistent with providing street access to the Properties. (a) All of the Owners shall have the affirmative obligation, at all times during the period of their ownership of their respective Lots, to cause the Private Street to be maintained in a safe condition according to reasonable street maintenance standards as maintained by the City of Newport Beach, State of California. (b) No Owner of any Lot nor any other person, shall erect any structure or conduct any activity, or otherwise cause to permit any activity or situation to exist which will unreasonably impede or impair the use of the Easements granted in this Declaration. (c) The cost of maintenance of the Private Street shall be borne equally by all Lot Owners. In the event there arises any dispute concerning the maintenance of the Private Street or the apportionment of the cost thereof, such dispute shall be subject to binding arbitration under the commercial arbitration -rules of the American Arbitration Association. (d) In addition to the maintenance of the Private Street, all Owners shall equally share in the cost of maintaining other areas which benefit the overall project which shall include adjacent walks, parkways, slopes, fences and retaining walls, as depicted on Exhibit "B" attached hereto. 4.03 Liability for Damage. Each Buyer, by acceptance of a deed to a Lot in the Properties, agrees that the Buyer shall be responsible for all damage to any improvements within the Properties caused by any action of Buyer, Buyer's employees, agents or subcontractors. If, after ten (10) days prior written notice to Buyer from Declarant or any other Owner in the -13- 10/2/87 • 8*05290 88-081982 Properties, Buyer fails to timely repair any damages for which Buyer is responsible, any other Owner shall have the right, but not:the obligation, to enter upon the property if necessary and complete the necessary repairs. The completion of such work by such other shall be at competitive rates and prices and the costs so incurred by such Owner in performing such work shall be due and payable by Buyer to such Owner within fifteen (15) days of a written request therefor by Owner. Any amounts due under this paragraph which Buyer fails to pay within such fifteen (15) day period shall not be deemed a loan or forbearance, and shall bear interest from the date such Owner delivers its request for payment to the date such payment is made at the maximum rate permitted by law. 10/2/87 87-60 5290 u MISCELLANEOUS 5.01 Enforcement. Any Owner or the successor in interest of any Owner, shall have the right to enforce, by proceedings at law or in equity, all restrictions, conditions, covenants and reservations now or hereafter imposed by the provisions of this Declaration or any amendment thereto, including the right to prevent the violation of any such restrictions, conditions, covenants or reservations and the right to recover damages for such violation. Failure by any Owner to enforce any covenant, condition or restriction herein contained shall in no event be deemed a waiver of the right to do so thereafter. 5.02 Severability. Should any provision of this Declaration be held to be unenforceable by a court of competent jurisdiction the remaining provisions of this Declaration shall nevertheless remain in full force and effect. 5.03 Amendments. This Declaration may be amended only by the affirmative assent or vote of not less than a majority of the Owners of Lots in the Properties. Further, this amendment provision shall not be amended to allow amendments by the assent or vote of less than a majority of the Owners. Any amendment or modification must be properly recorded. Notwithstanding the foregoing, this Declaration cannot be terminated or substantially amended without the approval of the City of Newport Beach. Notwithstanding any provisions of this Declaration to the contrary, neither this Declarant nor the recorded Owners may make any amendments to this Declaration which would alter, defeat or render invalid Section 4.02 without the written approval of the City of Newport Beach. -15- 10/2/87 • 0-605290 88-081982 5.04 Construction; Governing Law The provisions of this Declaration shall be liberally construed to effectuate its purpose of creating a uniform plan for the development of a residential community or tract. The Article and Section headings have been inserted for convenience only, and shall not be considered or referred to in resolving questions of interpretation or construction. 5.05 Number and Gender. Whenever the context of this Declaration so requires, the singular shall include the plural and the masculine shall include the feminine. 5.06 Binding Effect. This Declaration shall be binding upon Declarant and all Owners and their successors, assigns and heirs. 5.07 Attorneys' Fees. Should any action be brought to enforce any of the provisions of this Declaration, the prevailing party shall be entitled to a reasonable attorneys' fee in addition to such other relief as may be granted. 5.08 Term. These covenants are to run with the land and shall be binding on all parties and all persons claiming under them for a period of fifty (50) years from the date this Declaration is recorded, after which time this Declaration shall be automatically extended for successive periods of ten (10) years unless an instrument signed by all of the then Owners of the Lots has been recorded, agreeing to change this Declaration in whole or in part. 5.09 Insurance Obligations of Owners. Each Owner shall be solely responsible for insuring the dwelling unit on their Lot, including, without limitation, the structural portions of such dwelling unit against loss or damage by fire or other casualty. Each Owner shall also be solely responsible for obtaining adequate comprehensive public liability insurance, -16- 7.0/2/87 • 0605290 88-081982 including, medical payments and malicious mischief, insuring against liability for bodily injury, death, and property damage arising from his activities on their Lot. -17- 10/2/87 8T-s•290 VI MORTGAGE PROTECTION No breach of the covenants, conditions or restrictions contained in this Declaration, nor the enforcement of provisions herein, shall affect, impair, defeat or render invalid the lien of any mortgage or deed of trust made in good faith and for value, but all of said covenants, conditions and restrictions shall be binding upon and effective against any Owner whose title is derived through foreclosure or trustee's sale, or otherwise, with respect to a Lot. That the map meets the requirements of Title 19 of the Newport Beach Municipal Code, all ordinances of the City, all applicable general or specific plans, and the Planning Commission is satisfied with the plan of subdivision. 2. That the proposed subdivision presents no problems from a planning standpoint. 3. That the site is physically suitable for the type of development proposed. 4. That the site is physically suitable for the proposed density of development. 5. That the design of the subdivision or the proposed improvements are not likely to cause serious public health problems. 6. That the design of the subdivision or the proposed improvements will not conflict with any easements, acquired by the public at large, for access through or use of property within the proposed subdivision. 7. That the environmental document has been prepared in compliance with the California Environmental Quality Act (CEQA), the State EIR !uidelines and City Policy. B. That the contents of this environmental document have been considered in the various decisions on the project. 9. That in order to reduce adverse impacts of the proposed project, all feasible mitigation measures discussed in the environmental document have been incorporated into the proposed project. 10. That the approval of a retaining wall which exceeds 3 feet in height within the required 10 foot front yard setback adjacent to Cliff Drive would interfere with the sight distance of a private drive on the adjoining property to the northwest, and therefore would be detrimental to persons, property and improvements in the neighborhood, and that the applicants' request would not be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code. 11. That the approval of a proposed 10 foot front yard setback on a portion of Lot 6 would not be detrimental to persons, property and improvements in the neighborhood, and that the request would be consistent with the legislative intent of Title 20 of the Newport Beach Municipal Code because of the' unusual shape of the lot. /01 Conditions: 1. That a Final Map be recorded. 2. That all improvements be constructed as required by ordinance and the Public works Department. 3. That a standard subdivision agreement and accompanying surety be provided in order to guarantee satisfactory completion of the public improvements if it is desired to record a final map or obtain a building permit prior to completion of the public improvements. 4. That each dwelling unit be served with an individual water service and sewer lateral connection to the public water and sewer systems unless otherwise approved by the Public Works Department. 5. That the design of the private street and drives conform with the City's Private Street Policy (L-4), except as approved by the Public Works Department. The basic roadway width shall be a minimum of 32 feet. The location, width, configuration, and concept of the private str et and drive system shall be subject to further review and approval by the City Traffic Engineer. G. That the intersection of the private street and drives including the private drive northwesterly of the site, be designed to provide sight distance for a speed of 35 miles per hour. Slopes, landscaping; walls and other obstructions shall be considered in the sight distance requirements. Landscaping or retaining walls within the 'sight distance line shall not exceed twenty-four inches in height above curves. The sight distance requirement may be approximately modified at non -critical locations, subject to approval of the Traffic Engineer. To obtain sight distance it may be necessary to regrade a small portion of the City Park. The grading and re -landscaping will be the developer's responsibility. 7. That landscape plans shall be subject to review and approval of the Parks, Beaches and Recreation Department and Public works Department. 8. That street, drainage and utility improvements be shown on standard improvements plans prepared by a licensed civil engineer. 9. That a hydrology and hydraulic study be prepared and submitted for approval by the Public Works Department, along with a master plan of water, sewer and storm drain facilities for the on -site improvements prior to recording of the Final Map. Any modifications or extensions to khe existing storm drain; water and sewer systems shown to be required by the study shall be the responsibility of the developer. Top and toe of slope drains adjacent to the park site shall be on the developer's parcel. -4, I/ 10. That prior to issuance of any grading or building permits for the site, the applicant shall demonstrate to the satisfaction of the Public Works Department and the Planning Department that adequate sewer facilities will be available for the project. Such demonstration shall include verification from the city's Utilities Department. 11. That County Sanitation District fees be paid prior to issuance of any building permits. 12. That the curb returns at the intersection of Cliff Drive and the private street have a minimum 20-foot radius; that the slopes adjacent to the proposed sidewalk along the private street be set back two (2) feet from back of walk or three (3) feet from back of curb) that a 5 foot wide concrete sidewalk be constructed adjacent to the private street and that a 6 foot wide concrete sidewalk be constructed along the Cliff Drive frontage; that a 30" wide concrete pad be constructed adjacent to the curb on the private street where on -street parking is to be provided; and that the drive apron for the flag lot, Lot 5, provide a 0.7 foot hike up from flow line to back of apron and that the driveway be designed to provide maximum grade breaks of 12% using 6 foot tangents unless otherwise approved by the Public Works Department. The drive access to Lot 1 shall be at least 25 feet from the Cliff Drive right-of-way line. 13. Driveways to Lots 1, 2 and 3 shall have a grade not to exceed 20% with grade breaks of 12% maximum using 6-foot tangents. 14. Garages shall be set back a minimum of 20 feet from curb, or back of sidewalk where a sidewalk is provided. However, garages may be set back 18 feet if roll -up doors are provided. 15. A Traffic Control plan shall be prepared by a registered Traffic Engineer. 16. That the applicable height limits for future development of the subdivision shall be measured from grades as shown on the approved rough grading plan approved by the City Council. 17. That the building envelope on Lot 5 shall be limited to a maximum roof height corresponding to an elevation of 81 feet as shown on the approved grading plan and that any development on Lot 5, beyond 130 feet from the proposed cul-de-sac shall not exceed an elevation of 65 feet. 18. Development of site shall be subject to a grading permit to be Approved by the Building and Planning Departments. 19. That a grading plan shall include a complete plan for temporary and permanent drainage facilities, to minimize -any potential impacts from silt, debris, and other water pollutants. /, %n erosion, siltation and dust control plan, if required, shall De submitted and be subject to the approval of the Building )epartment and a copy shall be forwarded to the California Regional Water Quality Control Board, Santa Ana Region. 21. The velocity of concentrated run-off from the project shall be evaluated and erosive velocities controlled as part of the project design. 22. That grading shall be conducted in accordance with plans prepared by a Civil Engineer and based on recommendations of a soil engineer and an engineering geologist subsequent to the completion of a comprehensive soil and geologic investigation of the site. Permanent reproducible copies of the "Approved as Built" grading plans on standard size sheets shall be furnished to the Building Department. 23. That erosion control measures shall be done on any exposed slopes within thirty days after grading or as approved by the Grading Engineer. 24. That any cul-de-sac, building address, and stre(c name shall comply with City Standards and shall be approved by the Fire Department. 25. The Fire Department access shall be approved by the Fire Department. 26. That all on -site fire protection (hydrants and Fire Department connections) shall be approved by the Fire and Public works Departments. 27. A qualified archaeologist or paleontologist shall evaluate the site prior to commencement of construction activities, and that all work on the site be done in accordance with the City's Council Policies K-5 and K-6. 28. The project should investigate the use of alternative energy sources (i.e. solar) and to the maximum extent economically feasible incorporate the use of said in project designs. 29. Final design of the project shall provide for the incorporation of water -saving devices for project lavatories and other water -using facilities. 30. That this tentative tract map shall expire if the map has not been recorded within 3 years of the date of approval, unless an extension is granted by the Planning Commission. 31. Box 1768 Newport Beach, CA 92658-8915 RE: Archaeological Monitoring at the "Pa-rk Place" Project Site, 2505 Cliff Drive, Newport Beach Dear Mr. Ward: As per city guidelines and mitigation recommendations presented in our survey report (Brock 1987:5), I have conducted "spot check" archaeological monitoring at the "Park Place" property. Monitoring consisted of one hour per day for the first two days of grading (June 24 and 25, 1987). While grading has not been completed to date, I am convinced that no further monitoring is necessary. Results of the monitoring were negative. No prehistoric or historic cultural resources were observed despite the property being very well situated for habitation. The most likely explanation for the lack of prehistoric materials is the absence of nearby fresh water sources. As I pointed out in the survey report, the Newport Heights area is poorly understood from an archaeological viewpoint. I hope that the city will continue to require archaeological/paleontological assessments for development projects in this region.
