CITY OF NEWPORT BEACH TO: Planning Commission DATE: January 8,1998 FROM: Patricia Temple, Planning Director RE: Temporary use of trailer in conjunction with a commercial use, Applicant- Gregory Pitcher, on behalf of the Villa Nova Restaurant LOCATION: 3131 West Coast Highway Approval of a temporary use to allow the retention of a 160 sq.ft. storage trailer for a period of 90 days. The storage trailer will house construction equipment and temporary restaurant storage, pending completion of interior restaurant alterations. The placement will be from approximately January 9, 1998 to April 8, 1998. Said use will be subject to the following conditions of approval: That a building permit shall be obtained from the Building Department and the appropriate clean-up deposit shall be posted to insure maintenance and clean-up of the subject property after removal of the temporary trailer. The applicant shall also obtain approval of the site plan for the location of the trailers from the City Traffic Engineer prior to the issuance of the building permit and installation of the temporary trailers. 2. That all employees shall park on -site. 3. That all patrons and vendors making deliveries shall be directed to park within the subject property and not along the public right-of-way on West Coast Highway. 4. That this temporary use shall terminate upon evidence that the facility is operating in violation of any of the above conditions of approval or upon receipt of unresolved complaints. 5. That the trailer shall be allowed for a period not to exceed 90 days from the date of approval, after which it shall be removed. This approval cannot be extended. Attachments: Appendix Letter from the Applicant with Plot Plan APPENDIX Background and Analysis The Municipal Code (Section 20.60.015B) requires that temporary uses or structures are subject to the approval of a use permit prior to placement. For the past several years, Villa Nova Restaurant has utilized a temporary trailer adjacent to the parking lot to accommodate the storage of restaurant dry goods without the benefit of a use permit. Additionally, a review of City aerial photographs indicates that the size and location of the trailer has changed over the past several years. The current trailer was placed in conjunction with post -fire reconstruction of the restaurant. The Planning Department has attempted to compel the property owner to remove the trailer. The applicant requests to retain the trailer to accommodate displaced storage and equipment in conjunction with interior improvements under construction to satisfy handicap accessibility requirements. The current construction will provide additional interior storage area to accommodate the dry goods stored in the temporary trailer. The applicant has provided the attached letter and plot plan describing the'request. Staff has no objection to the temporary use of the trailer for the following reasons: • The trailer will house construction equipment and the storage of restaurant dry goods only for the duration of construction work. • The trailer will not be utilized by or for restaurant patrons. • Staff has limited the duration of placement of the trailer to coincide with the completion of the construction to satisfy handicap accessibility requirements or 90 days from the date of Us approval, whichever is less. • The Building Department requirement for the current handicap compliance construction will be completed in less than 90 days. I have submitted construction documents to the building department indicating the new enclosed one hour rated space for these appliances as required by the Building Department's Notice to Correct Work dated 12110/97. There is no other storage space on site that would accommodate these appliances or the construction materials necessary for this work .
