HomeMy WebLinkAbout2024-14 - Indefinitely Waiving Section A.1 of Council Policy B-13 to Allow for Alcoholic Beverages at the Annual Charity Polo Event Held at Peninsula ParkRESOLUTION NO. 2024-14 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, INDEFINITELY WAIVING SECTION A.1 OF COUNCIL POLICY B-13 TO ALLOW FOR ALCOHOLIC BEVERAGES AT THE ANNUAL CHARITY POLO EVENT HELD AT PENINSULA PARK WHEREAS, in 2016 and 2023, a charity polo event ("Charity Polo Event") was held at Peninsula Park, providing a memorable event for residents, celebrating the tradition of the sport of Polo, including the artistic expression of fashionable hats, social camaraderie, showcasing the wares of local vendors, and providing a boost to the local economy; WHEREAS, to accommodate the Charity Polo Event, the City Council of the City of Newport Beach ("City") waived Section A.1 of Council Policy B-13, Public Use of City Facilities, which restricts dispensing of alcohol on City property to specific locations ("Council Policy B-13"), so that alcohol could be dispensed at Peninsula Park; WHEREAS, a special event permit application was recently filed by the Newport Beach Foundation, a California nonprofit corporation ("Foundation"), to hold the Charity Polo Event on Saturday, May 4, 2024, at Peninsula Park; WHEREAS, the Charity Polo Event held in 2016 and 2023 at Peninsula Park was a success, with residents requesting the event be held again, and the Foundation now intends to hold the Charity Polo Event on an annual basis; WHEREAS, the Foundation requests the City Council again waive Council Policy B-13 to allow for the dispensing of alcohol at Peninsula Park to accommodate the Charity Polo Event; and WHEREAS, the City Council desires to indefinitely waive Council Policy B-13 for the Chairty Polo Event held at Peninsula Park, provided that that a special event permit is obtained that contains appropriate conditions related to the sale and service of alcohol. Resolution No. 2024-14 Page 2 of 3 NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows.. Section 1: The City Council does hereby indefinitely waive Section A.1 of Council Policy B-13 to allow for the dispensing of alcoholic beverages at Peninsula Park for the Charity Polo Event, provided that a special event permit is obtained that contains appropriate conditions related to the sale and service of alcohol. As part of the special event permitting process, supplemental materials shall be submitted with the special event permit application for City staff review and approval including, but not limited to, an alcohol service plan that sets forth limits on the number of alcohol service locations, alcohol container sizes, and the types of alcohol to be served, as well as information about the security personnel, how the applicant will adhere to California Department of Alcoholic Beverage Control (ABC) restrictions, and required training of alcohol service personnel. Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Resolution No. 2024-14 Page 3 of 3 Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.
