LOCATION: Lot 19, Tract No. 5169, located at 4680 MacArthur Boulevard, on the southwesterly corner of MacArthur Boulevard and Campus Drive, across from the John Wayne Airport. ZONE: M-1-A APPLICANT: Ace Parking, Newport Beach OWNER: The Irvine Company, Newport Beach Application This is a request to permit the installation of a new double faced off -site directional sign for airport parking at MacArthur Court, located on property at the intersection of MacArthur Boulevard and Campus Drive, in the M-1-A District. Section 20.06.060 of The Newport Beach Municipal Code provides that off -site signs are subject to securing the approval of an exception permit by the Planning Commission. Environmental Significance The proposed sign has been reviewed and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 11 (Accessory Structures). Conformance with the General Plan The Land Use Element of the General Plan designates the subject property for "Administrative, Professional and Financial Commercial" uses. The subject off -site sign is a permitted use within this designation and is ancillary to the E-Z Airpark parking lot, TO: Planning Commission - 2 located to the east across MacArthur Boulevard, in the Koll Center Planned Community District. The proposed off -site sign is consistent with the Land Use Element policies and guidelines. $_object Pr ,perty and Surrounding Land Uses The subject property, which is the proposed location for the new off -site sign, is currently a vacant, former service station site and is located on the southwesterly corner of MacArthur Boulevard and Campus Drive. The proposed sign will advertise the E-Z Airpark pay parking lot located in the MacArthur Court office complex, and will be directional in nature. The MacArthur Court complex contains a mixture of professional and business uses, and is located on the southeasterly corner of the intersection of MacArthur Boulevard and Campus Drive (see attached vicinity map). To the north of the subject property, across Campus Drive, is the John Wayne Airport; and .to the south and southwest is the Bircher Building site and related office parking lot. Backizround On April 22, 1993, the Planning Commission approved Traffic Study No. 86, which was a request to allow the conversion of 200 excess parking spaces in the MacArthur Court office complex to a pay parking facility used for John Wayne Airport passengers. Said pay parking facility is the use which is advertised by the subject off -site sign. On March 16,1994, the Code Enforcement Division notified the applicant that the subject off -site, sign was erected without the benefit of proper building permits or Planning Commission approval. The applicant responded, indicating his intention to submit an exception permit application, which was subsequently received. On July 7, 1994, the Planning Commission approved Exception Permit No. 45, which was a request for the retention of an as -built, double-faced, illuminated sign on the subject property, for airport parking at MacArthur Court. An excerpt of the Planning Commission minutes, dated July 7, 1994, is attached for Commission review. Condition No. 5 of said approval stated that, 'The applicant either remove the sign at the end of 90 days or come back to the Planning Commission at the end of 90 days with a redesign of the sign." Inasmuch as this approval was for a period of 90 days, the applicant has redesigned the subject, off -site sign so that it has a more permanent appearance, which is the subject of this application. Analy5i The proposed redesign of the subject sign may be seen on the attached elevations, indicating the dimensions and proposed colors of the sign. The sign is approximately 13 feet in height, with an area of 64 square feet, and will be externally illuminated. The proposed sign will replace the existing off -site directional sign which is located on the southwesterly corner of ! • TO. Planning Commission - 3 Campus Drive and MacArthur Boulevard. The existing sign has an overall height of 13 feet, and has an area of 56 square feet. The existing sign is double-faced and is externally illuminated. It is intended that the sign direct motorists travelling south on MacArthur Boulevard into the MacArthur Court complex, although it may also be viewed by motorists travelling east and west along Campus Drive or north along MacArthur Boulevard. Upon staff inspection of the subject E-Z Airpark site, the applicant has removed the two on -site signs which were located on the MacArthur Court site, and which advertised the E-Z Airpark facility. Said signs were removed in accordance with Condition No. 3 of Exception Permit No. 45, as approved by the Planning Commission on July 7, 1994. The proposed sign is similar to the two Irvine Company "future facility" signs that were removed. Widening of Campus Drive The City Traffic Engineer has indicated that the future widening of Campus Drive will begin as soon as January of 1995. The existing curb along the subject property will be ]elocated' ;approximately 30 feet south of its current -placement. Staff is of the opinion that, should the Commission approve the proposed sign, its location should reflect the proposed Campus Drive widening. Such a condition has been included in the attached Exhibit "A." Applicant's Statement of Support In accordance with Section 20.06.090B of the Newport Beach Municipal Code, in order to grant an exception permit, the Planning Commission must find that the granting of such a permit is necessary to protect a substantial property right, will not be contrary to the purpose of Chapter 20.06, and will not be materially detrimental to the health, safety, comfort or general welfare of persons residing in the neighborhood, or detrimental or injurious to property or improvements in the neighborhood, or to the general welfare of the City. In response to the above requirements, the applicant has submitted the following statements in support of his application: 1. Why will the proposal not be contrary to the purpose of the sign ordinance? 'The sign ordinance allows for directional signs, and the subject sign presents no hazard to the public." 2. What exceptional or extraordinary circumstances are involved? "The advertised site location is not viable from the public right-of-way." 3. Why is an excQtion permit necessary to protect a substantial proper rientr "Without proper signage the subject business would suffer a lack of exposure that other property owners enjoy that have right of way visibility." 4. Why will the proposal not be detrimental to the neighborhood? "It provides better directional information to people looking for airport parking in a busy intersection; thereby enhancing safety." TO: Planning Commission - 4 Specific Findings and Recommendations Should the Planning Commission wish to approve this application, the findings and conditions set forth in the attached Exhibit "A" are suggested. However, should the Commission be of the opinion that adequate signage for the E-Z Airpark could be provided on -site, appropriate findings for denial are set forth in the attached Exhibit "B." William Laycock, Current Planning Manager, replied that the two "future facility" signs that are located on the property should have been removed when MacArthur Court was built, and the signs were not permitted as permanent signs; however, they meet the square footage requirements but exceed the permitted height for ground signs. In response to questions posed by Commissioner Ridgeway, Mr. Laycock replied that the Koll Center Newport Planned Community development standards allow ground signs to be 4 feet high, 150 square feet per face within 20 feet of a property line adjacent to a street. If the sign would be outside of the 20 foot setback adjacent to a street then a ground sign would be allowed to be up to 200 square feet per face. Mr. Laycock further replied that no one from Koll Center management contacted staff regarding the signs. Mr. Tony Actisdano, 4680 MacArthur Boulevard, appeared'before the Planning Commission. Mr. Actisdano stated that the aforementioned "future facility" signs have been removed since the photograph was taken. The existing off -site sign is located on the vacant lot across the street at the southwesterly corner of MacArthur Boulevard and Campus Drive. Chairman Glover suggested that the existing off -site sign be redesigned so as to blend in more aesthetically with the adjacent area. 'Mr. Actisdano confirmed that the sign design would be improved. In response to questions posed by Commissioner Ridgeway and Commissioner Gifford, Mr. Laycock explained that off -site signs require an ExceptionYermit, and a Building Permit is required for the as -built construction. The City does not become involved with the aesthetics of a sign. Mr. Laycock further replied that if it would be the desire of the Planning Commission to request the -3. In response to questions posed by Commissioner Edwards, Mr. Actisdano explained 'that the off -site sign is located on an undeveloped parcel of land that will be removed with the widening of Campus Drive. The intent was to have the temporary sign on the property from six months to one year, and the sign has been on the property since March or April,1994. Mr. Actisdano stated that it would not be a burden to redesign the sign; however, a monument sign would cost approximately $30,000.00. In response to questions posed by Commissioner Ridgeway, Mr. Actisdano explained that the applicant is utilizing the 201 excess parking spaces at MacArthur Court until The Irvine Company constructs additional office space on the property. Commissioner Ridgeway determined that he could not support the existing sign wherein he suggested that the applicant request The Irvine Company to install a monument sign that would benefit the entire project, or he suggested that the applicant come back with a redesign of a cost -efficiency sign that would .have a permanent look. Mr. Actisdano responded that he would agree to meet with the Planning Department to discuss an appropriate temporary design of the off -site sign. Commissioner Pomeroy suggested that the application be continued for 60 to 90 days to allow the applicant additional time to come back with a redesign of the sign, and it is feasible that the widening of Campus Drive would occur. Rich Edmonton, City Traffic Engineer, replied that it is possible that the sign could be relocated on the property inasmuch as after the widening of Campus Drive a small parcel would remain. Robin Flory, Assistant City Attorney, explained that the off -site' sign was installed without the benefit of a building permit or Planning Commission approval, and if the application would be continued, then the Commission would allow a violation for an additional 90 days. She suggested that if it is the desire of the Planning Commission to approve the application, that the temporary sign be approved with a specific deadline for review by the Planning Commission. All we obtain from them are promises that they will soon be pulling a permit and that they are doing the drawings. We are left now with little alternative other than having to refer this matter to the office of the City Attorney for appropriate action. I would like to first thank you for bringing to our attention that our sign vendor has not gone through proper channels in obtaining the necessary Approvals for the installation of this sign. Immediately following our conversation I contacted them and advised them of this. I have been informed that they were not aware of requiring any approvals for the changes made to the two existing signs, and the new sign was an oversight. This of course does not solve your problem, they have informed me that they will be contacting both The Building and The Planning Departments today and file all necessary paperwork required. This has been placed on a priority basis, and I am sure you will be hearing from them post haste.
