Land Use Plan The Land Use Elements of. the General Plan and the Local Coastal Program designate the site for "Retail and Service Commercial' uses. The existing signs are being utili7xd in conjunction with an existing retail business which is a permitted use within such a designation. tject_ Property and Surroundi7g, Lanci_ Uses The applicant's business is one of several businesses located in two buildings within a small commercial center in the Cannery Village/MacFadden Square Specific Plan Area.. The building occupied by the applicant also contains a Wells Fargo Bank and some small^r individual offices. The other building contains an Italian restaurant, a flower shop and a dry cleaners pick-up and drop-off facility. To the north, across 28th Street, are existing single family and two-family residential units; to the; cast, across the southbound leg of Newport Boulevard, is a motel, retail commercial uses and a small bar; to the south, across 26th Street, is a Municipal Parking Lot; and to the west, across West Balboa Boulevard, are several lots with two-family residential units. IVA 4.n'V 11JUJU Wall »18113, - However, only one sign was approved inasmuch as the applicant indicated that there were only two signs currently on the building. Said permit was issued (copy attached) with a special condition that a maximum of three wall signs per building are permitted. Shortly after the issuance of the second building permit, the Planning Department received a complaint regarding the number of signs being installed by the app➢icznt. An inspection by the Planning Department revealed that. in addition to the three signs requested by the applicant, there were two wall signs for the Wells Fargo Bank already on the building. In addition, the applicant had installed the fourth sign that had previously been denied by the Planning Department (Sign "C"). The applicant was informed that his signs were in violation of the Newport Beach .Municipa, Code and that they would have to be removed unless the Planning Commission approved an exception permit so as to allow more than three wall signs on the building. Why will the proposal not be gtrimental to the neighborhood? "Increased visibility of desired commodities, will blend with the existing life styles of this sports oriented section of the community and increase interest in all other retail outlets of the area ... positive stimuli." Spcgific Findings Notwithstanding staffs objections to the manner in which the applicant has in certain instances misrepresented the number of signs on the property and has illegally installed a sign which was previously denied by the Planning Department, it is staffs opinion that the si-e of the development and the double frontage on both Newport Boulevard and West Balboa Boulevard does justify some additional signage on the property. However, it is staffs further opinion that the additional signage being requested should be for the purpose of identifying the business rather than advertising products or brand names of merchandise being sold. For this reason, staff suggests that Sign "C' which advertises "O'Neill" products, should not be permitted. It is staffs 'further opinion that although Sign "D" does identify the business name, it is excessive inasmuch as the larger Sign "A" which fronts on West Balboa Boulevard' is clearly visible for traffic traveling southbound. 'l'tterefore, staff also suggests that Sign "D" also he deleted. Should the Planning Commission wish to approve this application as proposed by the applicant, the findings and conditions set forth in the attached Exhibit "A" are suggested. However, should the Planning Commission wish to approve the application for Signs "A" and "B" only, the findings and conditions of approval set forth. in the attached Exhibit "B" are suggested. Should the Planning Commission wish to deny this application in its entirety, the findings set forth in the attached Exhibit "C' are suggested.
