TITLE: Resolution No. 2024- 40: Authorizing Application for Grant Funding
from the Orange County Enhanced Mobility for Seniors and
Individuals with Disabilities (EMSD) Program
ABSTRACT:
The Recreation and Senior Services Department is seeking authorization to apply for
grant funds under the Orange County Enhanced Mobility for Seniors and Individuals with
Disabilities (EMSD) Grant program, which is administered by the Orange County
Transportation Authority (OCTA). If awarded, EMSD grant funds will be used to replace
two buses and purchase an additional vehicle to enhance the OASIS Senior Center
Transportation Program. The additional vehicle will support the creation of a new
volunteer transportation program and help meet rideshare demand.
RECOMMENDATIONS:
a) Conduct a public hearing;
b) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
c) Adopt Resolution No. 2024-40: A Resolution of the City Council of the City of Newport
Beach, California, Authorizing Application for Grant Funding from the Orange County
Enhanced Mobility for Seniors and Individuals with Disabilities Program.
DISCUSSION:
The OASIS Senior Center's transportation program provides affordable rideshare
transportation for Newport Beach seniors over the age of 60 who are no longer able to
drive. Transportation is available for medical appointments, shopping, essential errands
and OASIS activities. The program averages 400 clients annually and enables Newport
Beach seniors to remain in their own homes for as long as possible and experience a
higher quality of life.

OASIS Senior Center has four full-time drivers and one part-time driver to provide over
11,000 rides each year. The program continues to grow and adds 15 new clients each
month. The program relies on a fleet of six vehicles to carry out services: three,
12-passenger Ford buses; one, 8-passenger Ford Transit van; one, 4-passenger Ford
Transit van; and one, 4-passenger Ford SUV. Vehicles are purchased, serviced and
replaced through the City of Newport Beach's Fleet Services Division.
The EMSD Grant Program, administered by OCTA, provides transportation funding for
seniors and individuals with disabilities where public transportation services may not
appropriately meet their needs. The program administers $8.5 million in local funds to
non-profit organizations and local public agencies for capital (vehicles and equipment)
and operating (mobility management and operating assistance) expenses.
The EMSD Grant Program requires governmental agencies to hold a public hearing and
provide 30-day notice to establish coordination with nonprofits and ensure proposed
projects are not duplicated or overlapping in scope. The program also requires a
resolution from a governing body to confirm legal authority to submit an application and
to meet the required match commitment, which is 10% of the capital or 20% of operating
expenses awarded.
If authorized, City staff will apply and request $285,000 for capital expenses. If awarded,
EMSD grant funds will be used to replace two Ford passenger buses in the fleet that have
exceeded their useful life with two, 8-passenger Ford Transit vans. The grant funds will
also be used to purchase an additional Ford SUV to support the creation of a new
volunteer transportation program to help meet rideshare demand. EMSD grant funds will
be awarded in September 2024.
FISCAL IMPACT:
The EMSD Grant Program requires a resolution to commit to providing a 10% local match
for capital, which may include the purchase and lease of vehicles and equipment, small
capital purchases, and operating expenses for mobility management, and additionally, a
20% local match for operating assistance expenses. City staff's application will request
capital expenses only, requiring a match commitment of 10% or $28,500.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.

Notice of this hearing was published on May 4, 2024, in the Daily Pilot to meet the
30-day notice EMSD program requirement. The agenda item has been noticed according
to the Brown Act (72 hours in advance of the meeting at which the City Council considers
the item).

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, AUTHORIZING
APPLICATION FOR GRANT FUNDING FROM THE
ORANGE COUNTY ENHANCED MOBILITY FOR
SENIORS AND INDIVIDUALS WITH DISABILITIES
PROGRAM
WHEREAS, the Orange County Transportation Authority, through its Enhanced
Mobility for Seniors and Individuals with Disabilities ("EMSD") program, provides grant
funding to nonprofit organizations and qualifying public agencies of up to $1,500,000 per
applicant for projects to meet the transportation needs of seniors and individuals with
disabilities;
WHEREAS, the EMSD program requires local agencies to provide a 10% local
match for capital, which includes the purchase and lease of vehicles and equipment, small
capital purchases, and operating expenses for mobility management, and additionally, a
20% local match for operating assistance expenses;
WHEREAS, the City of Newport Beach ("City"), through its Recreation and Senior
Services Department, maintains a transportation program for seniors to travel from their
residences to places such as medical appointments, shopping, essential errands, and the
OASIS Senior Center;
WHEREAS, there is an on -going need in the City for transportation services for
seniors, and additional funding will aid existing efforts by facilitating the enhancement of
these services;
WHEREAS, a notice of public hearing was published on May 4, 2024, in the Daily
Pilot, a newspaper of general circulation, providing the date, time, location and notice that
a public hearing would be held on June 11, 2024, regarding authorization to submit an
application for grant funding under the EMSD program;
WHEREAS, a public hearing was held by the City Council on June 11, 2024, at
which time all interested parties were invited to speak on the subject; and
WHEREAS, the City desires to apply for the EMSD program grant funding in order
to aid existing efforts by facilitating the enhancement of the City's senior transportation
services.

NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby authorize the Director of Recreation
and Senior Services, or designee, to apply for grant funding from the EMSD program.
Section 2: The City Council hereby commits to providing a 10% local match for
capital, which may include the purchase and lease of vehicles and equipment, small
capital purchases, and operating expenses for mobility management, and additionally, a
20% local match for operating assistance expenses.
Section 3: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 4: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Section 6: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
