A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, CORRECTING
THE RENTAL RATE FOR BALBOA YACHT BASIN
APARTMENTS, GARAGE RENTALS, AND SLIP
RENTALS AND RESIDENTIAL PIERS WITHIN THE
SCHEDULE OF RENTS, FINES AND FEES
WHEREAS, pursuant to the 1978 Beacon Bay Bill, as amended, ("Beacon Bay
Bill") the City of Newport Beach ("City") acts on behalf of the State of California as the
trustee of tidelands located within the City's limits, including Newport Harbor;
WHEREAS, the Beacon Bay Bill and Chapter 17.60 (Harbor Permits and Leases)
of the Newport Beach Municipal Code ("NBMC") allow the City to issue permits and
charge rent for property upon tidelands;
WHEREAS, the City Council adjusted certain rents for Balboa Yacht Basin
apartments, garages and slip rentals pursuant to Resolution Nos. 2010-134 and
residential piers pursuant to 2015-10, which has been adjusted for inflation since then,
and
WHEREAS, the City Council adopted Resolution No. 2024-29 on April 23, 2024,
which amended the FY 2024-25 Schedule of Rents, Fines and Fees ("SRFF") including
certain rents without adjusting for inflation and the City Council desires to correct the
SRFF.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The City Council does hereby amend the SRFF, as set forth in
Exhibit 1, which is attached hereto and incorporated herein by reference for Balboa Yacht
Basin apartments, garage rentals, and slip rentals and residential piers.
Section 2: The portion of the SRFF adopted pursuant to Resolution No. 2024-
29 related to rent for Balboa Yacht Basin apartments, garage rentals, slip rentals as well
as residential piers is hereby repealed and of no further force or effect. Any portion of any
prior resolution or SRFF that conflicts with this resolution is hereby repealed and of no
further force or effect.
Section 3: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.

Section 4: If any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the -validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 5: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.
Section 6: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
