Authorizes Commissioner Di Sano expressed his concern that a temporary structure could become a blight if it would be allowed to continue to be placed on the site. In response to comments by Chairman Gifford, James Hewicker, Planning Director, replied that the Planning Director has the authority to grant the use for ninety days provided that the Director is given the approval of the -28- lir COMMISSIONERS 0 MINUTES Q.! If the request is in excess of ninety days the Planning Director could extend the request for an additional period of time, or the Planning Commission could require the applicant apply for a use permit. A use permit could have a condition requiring a time limit after which time the applicant would have to remove the trailer and restore the premises to its original condition. Director Hewicker stated that the intent of Condition No. 3 is if the request is for more than ninety days, then the applicant should apply for a use permit. William Laycock, Current Planning Manager, stated that there was a fire in one of the buildings and the applicant is waiting for a settlement from the insurance company. Mr. Joe Cain, appeared before the Planning Commission on behalf of Hixson Metal Finishing. He explained that the applicant requested a temporary permit with the intent to apply for a use permit inasmuch as the trailer may be on the site for up to one year. The temporary request allows the to install the trailer immediately as opposed to the time tion * applicant needed to process a use permit. Municipal Code Requirements for Temporary Uses Section 20.33.025 of the Newport Beach Municipal Code establishes a procedure whereby the Planning Director or the Planning Commission may approve reasonable requests for interim or temporary uses of land or buildings when such uses are consistent with the City's General Plan and the health, safety, peace, comfort and general welfare of persons residing or worldng in the neighborhood, and do not violate any other ordinances and regulations of the City. Section 20.33.035 also establishes that the Planning Director may authorize the temporary use of structures and land in any commercial district for a period of time not to exceed 90 days. Prior to approving a temporary use, the Planning Director is required to inform the Planning Commission of the intent to pemrit the temporary use and take whatever steps or precautions are necessary to assure that the use will be consistent with the purpose and intent of the Municipal Code and the land or building will be restored at such time as the use is terminated. The Planning Commission may authorize the temporary use of structures and land in any commercial district for periods of time in excess of 90 days subject to the securing of a use permit in each case. In approving the use permit, the Planning Commission may impose whatever conditions it deems• necessary to assure that the purpose and intent of the Code is carried out and shall establish a specific point in time when the permit is to be terminated and the site restored. The Planning Director and the Planning Commission may authorize extensions of time subject to the procedures specified above. Environmental Significance This project has been reviewed, and it has been determined that it is categorically exempt from the requirements of the California Environmental Quality Act under Class 3 (New construction or Conversion of Small Structures). TO: Piarining Commission - 2 0 nformance with the General PI The Land Use Clement of the General Plan designates the site for "General Industry" uses. The subject metal finishing facility is a permitted use within this category. Subject Properly and Surrounding Land Use The subject property consists of seven adjoining parcels, with a total of approximately 69,412 gross square feet of land and four buildings which house the Mxson Metal Finishing operations. To the north, across Production Place, are office uses; to the east are office and light industrial uses; to the south are mull -family dwellings and a mobile home site; and to the west are office and light industrial uses. Analysis As indicated in the attached letter, the subject metal finishing facility experienced a fire in one of its buildings on January 8, 1995. Since that time, no repair work has been done to the building (which is approximately 2,000 sq.ft. in area), inasmuch as the applicant has not yet received the settlement from his insurance company. In the meantime, the applicant has secured a contract with one of its customers for a project which will require a larger square footage of `operational facility' than is currently available. Said project was scheduled to begin in May. Since the applicant has not yet been able to repair the fire damaged building, he is requesting the temporary use of a trailer for 90 days. As may be seen on the attached Partial Site Plan, the applicant is proposing to locate the temporary trailer between two of the existing metal finishing buildings (Location 'W ). The proposed location area is not required by the City to be maintained for parking purposes. The applicant has indicated that, although the subject approval of the trailer is for an initial period of 90 days, the need for said trailer would extend until such a time that the fire damaged building has been repaired. Therefore, the applicant intends to file for a use permit (m accordance with Chapter 20.33 of the Municipal Code) to allow the temporary trailer to remain until such work is completed. Building Department Considerations The Building Department has indicated that the subject trailer must be located next to the building at 835 Production Place (Location `S" on the attached Partial Site Plan), rather than centered between the two permanent buildings. Condition No. 4 has been included in this report to reflect this requirement. The Building Department has also indicated that the location of the proposed temporary trailer will be in violation of the Uniform Building Code with respect to the protection of openings and the fire rating requirements for exterior walls, due to the proximity of the trailer to the property line between the two 'permanent buildings and its proximity to other existing buildings. Therefore, conditions of approval have been included in this report in order to mitigate the potential fire hazard associated with the proposed location of the temporary trailer. 0 • TO: Planning Commission - 3 Conditions of Approval It is the intention of the Planning Director to approve the proposed use subject to the following conditions: 1. That the development shall be in substantial conformance with the attached location plan and partial site plan, except as noted in the following conditions. 2. That the temporary trailer shall be located next to the permanent building located at 835 Production Place, and that there be a 3 inch separation between the temporary building and the permanent building. 3. That this approval shall be for an initial period of 90 days and that a use permit must be filed with the Planning Department and approved by the Planning Commission for any extension of time beyond 90 days. 4. That the application shall be subject to further review by the Building and Fire Departments, and that all required building and/or electrical, plumbing and mechanical permits shall be obtained. 5. That the temporary trailer shall be anchored to resist seismic forces, as required by the Uniform Building Code. 6. That an automatic sprinkler system shall be provided for the temporary trailer, as required by the Uniform Building Code. That the temporary trailer shall be removed if the adjacent permanent building is sold. 8. That the use of the temporary trailer shall be limited to the manufacturing of parts. No hazardous materials shall be used or contained within the trailer. 9. That the Planning Director may add to or modify these conditions of approval, or recommend to the Planning Commission or the City Council on appeal, the revocation of this permit upon a determination that the use which is the subject of this permit causes injury, or is detrimental to the health, safety, peace, morals, comfort or general welfare of the community. Since then, absolutely no work has been started because the insurance company apparently moves at a different pace than the rest of us - but that's another matter. In that four month period of time we have been negotiating with one of our customer's to be their sole source for plating. We worked out a deal and they will be sending us all of their parts starting this month, May. As a result, we need more room to help process these parts, like masking and unmasking. Getting this account will be the single largest order we have ever received in the 30 years we've been here. So we have to find a way to make it work. The only way we can think of is rent a temporary trailer and Put it outside between two of our four buildings. It would be in an area out of harm's way. It wouldn't take up any of the parking. It would have the necessary 10 foot setback and plenty of room for Edison to access their equipment. We are requesting a 90 day permit in order to expedite things. Then we would pursue a USE permit, for the time it would take to complete the reconstruction of the burnt department. P.O.
