Webb, Public Works Director - 949-644-3311, dawebb@newportbeachca.gov PREPARED BY: Tom Sandefur, Assistant City Engineer - 949-644-3321, tandefur@newportbeachca.gov TITLE: San Miguel Park Accessible Playground Improvements — Reject All Bids for Contract No. 9371-1 (24P01) ABSTRACT: The City of Newport Beach recently received six bids for the San Miguel Park Accessible Playground Improvements. Of the six bids received, the three lowest bidders, representing half of the bids received, were non -responsive bids. Staff recommends that the City Council reject all bids and direct staff to re -advertise the project to provide an opportunity to receive more responsive and competitive bids. RECOMMENDATIONS: a) Find this project exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA guidelines, because this action will not result in a physical change to the environment, directly or indirectly; b) Reject all bids received for Contract No. 9371-1; and c) Direct staff to re -advertise the San Miguel Park Accessible Playground Improvements. DISCUSSION: As part of the FY 2023-2024 Playground Refurbishment Program, staff identified San Miguel Park, located at 2200 San Miguel Drive, as needing additional accessible play equipment. Staff also determined that the park's existing deteriorated play equipment and rubber surfacing need to be replaced. In addition to the playground improvements, the project will also include an accessible path and parking lot improvements to comply with the latest Americans with Disabilities Act (ADA) guidelines. Community Development Block Grant (CDBG) funding became available for the construction of accessibility improvements. With these funds as a supplement, staff recommended a project to update the playground at San Miguel Park with more accessible play equipment and features to remove physical barriers and accommodate disability access. 9-1 San Miguel Park Accessible Park Improvements — Reject All Bids for Contract No. 9371-1 (24P01) August 27, 2024 Page 2 The design of the new play equipment incorporated feedback received from the public from public outreach meetings and includes over 20 ground -accessible components for all ability levels along with additional elevated components accessible by transfer platforms. Staff developed contract documents accordingly and advertised the project for public bids. On July 25, 2024, the City Clerk opened and read the following bids for this project: BIDDER KYA Services LLC Low 2nd R E Schultz Construction, Inc. 3rd Aster Construction Services * 4th California Landscape & Design 5th Asad Holdings LLC 6th MBC Enterprises Inc. *Non -responsive Bid TOTAL BID AMOUNT $ 782,250 $ 782,275 $ 849,149 $ 893,850 $ 989.800 $ 997,103 The low bidder, KYA Services LLC, and the second low bidder, R E Schultz Construction, Inc. both did not submit any of the bid forms required for the CDBG funds allocated for this project. The third lowest bidder, Aster Construction Services, was deemed non -responsive because its required Department of Industrial Relations (DIR) license was expired at the time of the bid. The lowest responsive bid of $893,850, submitted by California Landscape & Design, is approximately 17% higher than the engineer's estimate of $763,480 and significantly higher than the non -responsive bids received. Staff believes that rejecting all bids and re -advertising will provide a better opportunity to receive more complete and responsive bids. In addition, re -advertisement will allow for a more competitive bidding environment. FISCAL IMPACT: There is no fiscal impact related to this item. ENVIRONMENTAL REVIEW: Environmental review will occur as appropriate and will be presented to the City Council at that time. Staff recommends the City Council find this action is not subject to the Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change to the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because this project has no potential for resulting in physical change to the environment, directly or indirectly. 9-2 San Miguel Park Accessible Park Improvements — Reject All Bids for Contract No. 9371-1 (24P01) August 27, 2024 Page 3 NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
