The Legal Framework
Overlapping legal requirements at the federal (Clean Water Act), state (Ocean Plan/Inland Surface Waters, Enclosed Bays, And Estuaries Plan) and local (Orange County MS4 Permit, Order No. R8-2009-0030) levels regulate discharges of pollutants into surface waters.
These include statewide Trash Provisions adopted on April 7, 2015 to address the impacts of trash on surface waters, and in particular trash conveyed to surface waters through municipal separate storm sewer systems (operated by MS4 co-permittees).
Cal. Water Code Section 13383 authorizes the SWRCB to establish certain requirements, including reporting requirements, in this regard, and the SARWQCB issued an order under Section 13383 dated June 2, 2017 to the City to specify a method to comply with the Trash Provisions.
Permittees are required to elect a Track 1 (Full Capture System (“FCS”) for storm drains where not cost-prohibitive) or Track 2 (combination of FCS and/or alternatives) method of compliance; where alternatives are employed, the permittee is to demonstrate equivalency.
Full compliance is required within ten (10) years.
