Archaeological Collection Title Quitclaim/Transfer
In May 1997, California State University, Fullerton ("University") and LSA Associates, Inc. entered a curation
agreement, which is attached, for the collection of archaeological materials from archaeological sites CA-ORA-
167/1117 and CA-ORA-1461 ("Collection"). The terms of that agreement noted that title to the Collection is vested
in the City of Newport Beach ("City") and that possession by the University did not constitute or imply transfer of
ownership.
The Collection is currently housed at the University. The City affirms that, to the best of its knowledge, no portion of
the Collection or associated records are in the possession or physical custody of the City.
The City does hereby quitclaim and transfer its right, title and interest in the Collection to the University. This
quitclaim and transfer includes all material held by the University from sites CA-ORA-167/1117 and CA-ORA-1461.
The University accepts the City's right, title and interest in the Collection for the purposes of facilitating repatriation
in accordance with the Native American Graves Protection and Repatriation Act (NAGPRA) of 1990 (25 USC Ch.
32) and its implementing regulations (43 CFR Part 10) and Ca1NAGPRA (California Health & Safety Code §§ 8010-
30).
The individuals named below represent and warrant that they have full authority to act on behalf of and bind the entity
for whom they are signing this document.

CURATION AGREEMENT*
This agreement is freely entered into this 12th day of May, 1997, by and between LSA Associates,
Inc. (hereinafter, LSA) and the Museum of Anthropology at California State University, Fullerton
(hereinafter, Museum). Both parties agree to be legally bound by the terms and conditions set forth
as follows:
The Museum agrees to provide safe and secure storage at its facilities in Fullerton, California,
for the collection of archaeological specimens from archaeological sites CA-ORA-1461 and
ORA-167/1117.
2. All parties understand that title to the above mentioned collection is vested in the City of
Newport Beach, and that possession of the collection by the Museum does not constitute or
imply transfer of ownership.
3. The Museum agrees to permit reasonable access to the collection by qualified persons for
study purposes. The Museum shall institute reasonable procedures to assure the integrity
and security of the collections during any such study and at all other times.
4. The Museum shall not disclose information about the location of the site from which the
subject collection has been acquired.
5. In consideration of the foregoing, LSA agrees to pay the Museum a one-time curation fee**
of $100.00 (One Hundred Dollars) per cubic foot.

ARCHAEOLOGICAL COLLECTIONS AGREEMENT

The Museum of Anthropology, California State University,
Fullerton, accepts appropriate artifactual collections from
archaeological sites for permanent curation as specified by the
Society of Professional Archaeologists, pursuant to Section l:
Code of Ethics and Standards of Performance subparagraph V. of
said Society.
In giving any collection, the donor understands and agrees
to release all control over said collection. The Museum agrees
to maintain said collection and make it available for study under
the supervision a qualified archaeologist in accordance with
mutually agreed upon conditions between the Museum and the ar-
chaeologist.
In accordance with the provisions set fortk' above, the
