As discussed, we do not see being able to support your application for a variance (Variance No. VA2018- 001/PA2018-022). If you would like to withdraw and obtain a full refund of your Planning Permit Application fee submitted to the City, please provide me a written request to that effect. In reference to what the Zoning Code allows by right, you may find the following Subsection interesting: NBMC 20.30.110(D) (Setback Regulations and Exceptions – Allowed Encroachments into Setback Areas). There are various encroachments allowed within a front setback area or those areas regulated as front setbacks. Also, Section 20.30.040 (Fences, Hedges, Walls, and Retaining Walls) discusses limitations on walls. Specifically Subsection 20.30.040(C)(3) notes that taller fencing is permissible when required by the Building Code for safety purposes.
