TITLE: Resolution No. 2024-92: Certification of General Municipal Election
Results
ABSTRACT:
The General Municipal Election was conducted on Tuesday, November 5, 2024. The
Orange County Registrar of Voters' office has certified the election returns. Pursuant to
California Elections Code Section 10263, the governing body shall adopt a resolution
reciting the fact of the election and the other matters that are enumerated.
RECOMMENDATIONS:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA)
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because
this action will not result in a physical change to the environment, directly or indirectly;
and
b) Adopt Resolution No. 2024-92, A Resolution of the City Council of the City of Newport
Beach, California, Reciting the Facts of the General Municipal Election Held on
Tuesday, November 5, 2024, and Declaring the Result and Such Other Matters as
Provided by Law.
DISCUSSION:
On June 11, 2024, the City Council adopted Resolution No. 2024-33, calling the City of
Newport Beach's General Municipal Election to be held on November 5, 2024, for the
purpose of electing three councilmembers to represent the Second, Fifth and Seventh
Districts for a full term of four years. Council also adopted Resolution No. 2024-34,
requesting the Orange County Board of Supervisors consolidate the City's General
Municipal Election with the November 5, 2024 Statewide General Election and provide
election services through the Registrar of Voters' office.
The General Municipal Election was conducted on November 5 and the Orange County
Registrar of Voters has canvassed the returns and certified the election results. California
Elections Code Section 10262(b) requires the City Council to certify the election results
no later than the next regularly scheduled City Council meeting following the Orange
County Registrar's final canvass of the returns.

Additionally, California Elections Code Section 10263 requires that, upon completion of
the canvass and before installation of the new officers, the governing body shall adopt a
resolution reciting the fact of the election and the other matters that are enumerated. The
City Clerk is submitting Resolution No. 2024-92 (Attachment A) for adoption as required
by the California Elections Code.
The official canvass of the election, which is attached to and referenced as "Exhibit 1" to
Resolution No. 2024-92, contains a report of the number of votes cast for each candidate.
FISCAL IMPACT:
There is no fiscal impact related to this item.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not
result in a direct or reasonably foreseeable indirect physical change in the environment)
and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA
Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no
potential for resulting in physical change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2024-92
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, CALIFORNIA, RECITING THE
FACTS OF THE GENERAL MUNICIPAL ELECTION
HELD ON TUESDAY, NOVEMBER 5, 2024, AND
DECLARING THE RESULT AND SUCH OTHER
MATTERS AS PROVIDED BY LAW
WHEREAS, a General Municipal Election was held and conducted in the City of
Newport Beach, California, on Tuesday, November 5, 2024, as authorized by Section 5'
of Article XI of the Constitution of the State of California, Section 1000 of the Newport
Beach City Charter, Sections 1301 and 10002 of the California Elections Code, and
Resolution No. 2024-33 of the City Council of the City of Newport Beach;
WHEREAS, as authorized by Elections Code Sections 10400 et seq., the general
election was held and consolidated with the Statewide General Election held the same
day;
WHEREAS, the notice of the general election was given in a time, form and
manner as provided by law; voting precincts were properly established; election officers
were appointed; and, in all other respects, the election was held and conducted and the
votes were cast, received and canvassed and the returns made and declared in a time,
form and manner as required by the provisions of the Elections Code of the State of
California for the holding of elections in charter cities; and
WHEREAS, the County Election Department canvassed the returns of the
election and has certified the results to this City Council.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
Section 1: The Certificate of Registrar of Voters to Result of the Canvass of the
Presidential General Election Returns is received, attached hereto as Exhibit 1, and made
a part of and incorporated herein by this reference.
Section 2: That the whole number of Vote Center ballots cast was 10,999 and
the whole number of vote -by -mail ballots cast was 39,939, making a total of 50,938 ballots
cast in the City.

Section 3: That the names of the persons voted for at the election for Member
of the City Council — District Two are as follows:
Michelle Barto
Nancy Scarbrough
That the names of the persons voted for at the election for Member of the City
Council — District Five are as follows:
Noah Blom
Jeff Herdman
That the names of the persons voted for at the election for Member of the City
Council— District Seven is as follows:
Sara J. Weber
Miles Patricola
Section 4: That the number of votes given at each precinct and the number of
votes given in the City to each of the persons above named for the respective offices for
which the persons were candidates are listed in the Certified Statement of the Votes Cast
at the Presidential General Election, attached hereto as Exhibit 2, and incorporated herein
by this reference.
Section 5: The City Council declares and determines that:
Michelle Barto was elected as Member of the City Council — District Two for the
full term of four (4) years;
Noah Blom was reelected as Member of the City Council — District Five for the full
term of four (4) years; and
Sara J. Weber was elected as Member of the City Council — District Seven for the
full term of four (4) years.
Section 6: The City Clerk shall enter on the records of the City Council of the
City, a statement of the results of the election, showing:
1. The whole number of ballots cast in the City;
2. The names of the persons voted for;
3. For what office each person was voted for;
4. The number of votes given at each precinct to each person; and
5. The number of votes given in the City.

Section 7: The City Clerk shall immediately make and deliver to each of the
persons so elected a Certificate of Election signed by the City Clerk and authenticated;
administer to each person elected the Oath of Office prescribed in the Constitution of the
State of California, and have each person so elected subscribe to the Oath of Office and
file it in the Office of the City Clerk. Each and all of the persons so elected shall then be
inducted into the respective office to which they have been elected.
Section 8: The recitals provided in this resolution are true and correct and are
incorporated into the operative part of this resolution.
Section 9: if any section, subsection, sentence, clause or phrase of this
resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not
affect the validity or constitutionality of the remaining portions of this resolution. The City
Council hereby declares that it would have passed this resolution, and each section,
subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or
more sections, subsections, sentences, clauses or phrases be declared invalid or
unconstitutional.
Section 10: The City Council finds the adoption of this resolution is not subject to
the California Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the
activity will not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly or
indirectly.

Section 11: This resolution shall take effect immediately upon its adoption by the
City Council, and the City Cleric shall certify the vote adopting the resolution.
