TITLE: Newport Coast Pickleball Courts (Project No. 22P13) — Notice of
Completion for Contract No. 9018-2
ABSTRACT:
On October 24, 2023, City Council awarded Contract No. 9018-2 for the Newport Coast
Pickleball Courts Project to Green Giant Landscape, Inc. The project constructed eight
new pickleball courts in Newport Ridge Park in accordance with the lease agreement the
City of Newport Beach has with Newport Ridge Community Association (NRCA). The
work is now complete and staff requests City Council acceptance and close out of the
contract.
RECOMMENDATIONS:
a) Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project.

This project constructed eight pickleball courts to industry specifications, and provided a
shaded viewing area, benches, trash cans, a bike rack, and two water fountain/bottle
filling stations.
The contracted work has been completed to the satisfaction of the Public Works
Department. A summary of the construction cost is as follows:

The final total contract amount was $1,129,370.71, which was approximately 3.6 percent
higher than the original bid amount. This cost increase was primarily due to replacing
deteriorated wrought iron fencing and sidewalk along the perimeter of the new pickleball
courts. A portion of the change orders was offset with liquidated damages penalties
assessed against Green Giant for construction completion delays.

The City held a grand opening ceremony for the Newport Coast Pickleball Courts project
on May 20 with City Councilmembers in attendance. Although the pickleball courts have
been completed and opened to the public, the contractor has been working on a short
punch list of items that required addressing, including fence security, gate hardware and
tensioning rods.
The contractor ended up 10 days past the scheduled contract completion date and per
contract specifications was charged $15,000 in liquidated damages.
FISCAL IMPACT:
The Newport Coast Pickle Courts project was included in the FY 2023-24 Capital
Improvement Program Budget. Funds for the construction contract were expended from
the following accounts:

Facilities Financing Plan funds are primarily funded from development impact fees and
the General Fund.
The California Proposition 68 grant (Parks and Water Bond Act of 2018) is a competitive
grant that funds recreation opportunities.

The Building Excise Tax (BET) fund is used to account for property development taxes
imposed on construction and occupancy of all residential, commercial, industrial units,
and mobile home parks for which a building or construction permit is issued. BET funds
are required to be used for acquiring, improving, expanding and equipping City fire
stations, libraries and parks as provided by Chapter 3.12 of the Newport Beach Municipal
Code.
ENVIRONMENTAL REVIEW:
On October 24, 2023, the City Council found this project exempt from the California
Environmental Quality Act (CEQA) pursuant to Sections 15301 and 15303 under Class 1
(Existing Facilities) and Class 3 (New Construction or Conversion of Small Structures) of
the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has
no potential to have a significant effect on the environment.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).
