The existing vehicle is beyond its service life and is scheduled for replacement in the current fiscal year. Selection and pricing for this vehicle are being sourced through a cooperative purchasing alliance known as the Houston Galveston Area Council (H-GAC) and purchased through Braun Northwest, Inc. RECOMMENDATIONS: a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and b) Approve the selection and purchase of a 2025 North Star 234-5 Command Vehicle, from Braun Northwest Inc., using cooperative selection and pricing under H-GAC agreement #AM10-23, and authorize the City Manager to execute a purchase order in the amount of $382,625.42. BACKGROUND AND HISTORY: The Newport Beach Crisis Response Unit utilizes a 2003 Freightliner van, Unit # 2082, as its primary tactical/command vehicle. The van houses all gear and equipment necessary for the CRU team to ensure successful deployment at critical incidents. This equipment includes weaponry and personal gear for the 24 team members and support staff. The existing heavy van was originally purchased and outfitted in 2003 with a service life extension/retrofit completed in 2017. By the time it is replaced, the van will be in service for 22 years, 10 years longer than the replacement threshold in Council Policy F-9, the City's vehicle replacement policy. In addition, this large, cumbersome, and outdated vehicle no longer meets the department's needs for an effective and efficient CRU response vehicle. Unit #2082 meets the City's age and condition requirements and is budgeted for replacement in the current fiscal year. 9-1 Purchase of 2025 North Star 234-5 Command Vehicle December 10, 2024 Page 2 ANALYSIS: CRU supervisors researched the response vehicle market and have selected a much more compact and practical configuration as a replacement vehicle. The smaller platform will provide more maneuverability and a higher level of security for storing the team's unique equipment. The new vehicle is built on a regular heavy-duty truck frame, which allows for similar drivability to a personally operated vehicle. This configuration also allows the department mechanics to conduct routine maintenance and upkeep, unlike the existing heavy van which must be sent out for any maintenance and repairs. The vehicle will store all of the team's special tools and is equipped with a secured armory to store a variety of weapons. An Alcohol, Tobacco, and Firearms (ATF) approved day box, used to store explosives and gas devices per ATF safety regulations, will also be installed. The new vehicle will include an outside command post for dispatchers and incident commanders. This area will assist the administrative side of operations during high -risk tactical situations. The manufacturer, Braun Northwest (NW), is a leader in the field of tactical and command vehicles, and offers one of the industry's best warranties. Several neighboring law enforcement partners use Braun NW. Braun NW offers the vehicle through the Houston -Galveston Area Council of Government's Cooperative Purchasing Program known as HGACBuy. Cooperative Agreement Council Policy F-14 and Section 4.1 of the City's Administrative Procedures related to purchasing (AP-001) allow the use of cooperative purchasing agreements, provided that the goods or materials were originally procured in accordance with the minimum requirements of AP-001. The City has previously relied on other cooperative purchasing alliances, including Omnia Partners and Sourcewell, for the purchase of other vehicles. H-GAC is a political subdivision and the largest of 24 Councils of Government in Texas. H-GAC's Cooperative Purchasing Program, called HGACBuy, and was established pursuant to the Texas Interlocal Cooperation Act, Local Government Code, Title 7, and Chapter 791. Government agencies are eligible to become members of HGACBuy, and City approval is required to participate. Contracts are awarded through a public competitive procurement process. Obtaining goods through a cooperative purchasing process can save staff time and resources and pricing is generally lower due to the multi -agency purchasing power provided through these agreements. On June 9, 2023, HGACBuy opened bidding for Ambulances, EMS and Other Special Service Vehicles, and received a total of 21 responses at closing on August 10, 2023. Per HGAC's contract, these bids are to be honored for four years after the above closing date. Braun NW was one of 21 primary awards with HGACBuy pricing via Contract AM10-23. After careful analysis of the 21 awards, Braun NW was selected for the CRU Truck build. Many factors were considered, such as local customer service and maintenance accessibility. Several local agencies, such as the Orange County Sheriff's Department, Costa Mesa Police Department, Corona Police Department, Pasadena Fire Department, and Newport Beach Fire Department, have utilized Braun NW. 9-2 Purchase of 2025 North Star 234-5 Command Vehicle December 10, 2024 Page 3 FISCAL IMPACT: The adopted budget includes sufficient funding for this purchase. Replacement of the SWAT tactical/command vehicle is budgeted in the current fiscal year. It will be expensed to the Rolling Equipment and Equipment NOC accounts in the Police Department, 75304- 911016 and 75304-911024. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.
