Project site: 14.3 acres Key Words: Newport Dunes, Newport Beach Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx MS-1 Management Summary MANAGEMENT SUMMARY PURPOSE AND SCOPE VCS Environmental (VCS) undertook this project under California Environmental Quality Act (CEQA) requirements for the Newport Dunes Resort Hotel Project (Project). This Phase I cultural resources study was designed to identify cultural resources that may be present on the Project Site, to determine its sensitivity for the presence of buried archaeological material, and to make recommendations for additional cultural resources work as necessary to help reduce the impacts of the project on cultural resources to a less than significant level. This study will be submitted to the City of Newport Beach and used by the City’s CEQA consultant that is preparing an Environmental Impact Report (EIR) for development of the Newport Dunes Resort Hotel Site (Project Site). Because the project is in the coastal zone of the City of Newport Beach and will require an amendment to the existing Coastal Development Permit (CDP), the project must be consistent with the Local Coastal Program (LCP) policies. Coastal Act Section 30244 states that “(w)here development would adversely impact archaeological or paleontological resources as identified by the State Historic Preservation Officer, reasonable mitigation measures shall be required.” Standard conditions (or Policies) related to archaeological and paleontological resources as provided in the Coastal Resource Protection Chapter of the City’s Coastal Land Use Plan are appropriate for the Newport Dunes project and are described in 6.0 Management Recommendations. For the purposes of this report, the Project Site references the 14.3-acre Newport Dunes Resort Hotel site; the Newport Dunes is the 110-acre property that encompasses the entire Newport Dunes resort including the hotel site; and the Study Area is the Newport Dunes site and a one- half mile radius around it. The format of this report follows Archaeological Resource Management Reports (ARMR): Recommended Contents and Format (Office of Historic Preservation 1990). DATES OF INVESTIGATION A cultural resources literature review was completed by staff at the South Central Coastal Information Center (SCCIC) at California State University, Fullerton on July 19, 2018, (Attachment A). A paleontological review request was completed by Samuel McLeod of the Natural History Museum of Los Angeles County (NHMLAC) on July 13, 2018 (Attachment B). Native American consultation was initiated with a Sacred Lands File search (SLF) request to the Native American Heritage Commission (NAHC). The NAHC completed its SLF search and responded on July 25, 2018 (Attachment C). A cultural resources survey of the property was conducted by VCS Director of Cultural Services, Patrick Maxon, RPA on July 31, 2018. This report was completed in May 2019. INVESTIGATION CONSTRAINTS The Project Site, an approximately 14.3-acre parcel west of the Newport Dunes Lagoon, is developed with an asphalt parking lot at its north end, a large area of stockpiled dredge material at the south end, and a dirt boat park lot in between. None of the original ground surface of the bay environment is visible. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx MS-2 Management Summary FINDINGS OF THE INVESTIGATION Historic and Archaeological • The SCCIC records search revealed that no cultural resources have been recorded on the Project Site. One cultural resource (P-30-000098) is recorded on the Newport Dunes, approximately 1,000 feet (305 meters) northeast of the current Project Site—the remnants of a shell midden, mostly destroyed prior to its recordation. Twenty-six other resources are recorded within the Study Area. These resources include shell middens, encampments, lithic scatters, ceramic scatters, and an important village/habitation site. There are also several historic-era resources in the Study Area. • Historic aerials reveal that prior to 1958, the Newport Dunes resort had not yet been created and Bay water extended nearly to PCH on the south and Jamboree Road on the east. Sand and other material dredged from the Back Bay was deposited on the Project Site in the 1980s and 1990s. It remains on site. Prior to the development of Newport Dunes, the Project Site consisted of mudflats and bay habitat. Paleontological • Younger Quaternary Alluvium, that is not paleontologically sensitive, covers the Project Site. More sensitive older Quaternary Alluvium may lie at depth and the marine late Miocene Capistrano Formation may be present at the western margin of the Project Site. Dredged sediments cover much of the Project Site, especially the southern half, south of the boat parking lot. Tribal Cultural Resources • The identification of Tribal Cultural Resources, and whether any may suffer substantial adverse change as a result of the project, will occur during and as a result of tribal consultation under Assembly Bill (AB) 52. The City of Newport Beach is undertaking this consultation independently and it is not a part of this study. CEQA Public Resources Codes (PRCs) §21084.1 and §21084.2 state that a project that may cause a substantial adverse change (i.e., demolition, destruction, relocation, or alteration such that the significance of the resource would be impaired) in the significance of a “historical resource” or a “tribal cultural resource” respectively is a project that may have a significant effect on the environment. With respect to the questions contained in the Initial Study Environmental Checklist Form of Appendix G of the State CEQA Guidelines, the project will not cause a substantial adverse change in the significance of a known historic, archaeological, or paleontological resource; and the project will not disturb any known burial or cemetery. However, such resources could be present below the surface. RECOMMENDATIONS The following cultural resources conditions were developed by the City of Newport Beach in Chapter 4.0 Coastal Resource Protection of its Local Coastal Program Coastal Land Use Plan: LCP Policies 4.5.1-1. Require new development to protect and preserve paleontological and archaeological resources from destruction, and avoid and minimize impacts to such resources. If Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx MS-3 Management Summary avoidance of the resource is not feasible, require an in situ or site-capping preservation plan or a recovery plan for mitigating the effect of the development. 4.5.1-2. Require a qualified paleontologist/archeologist to monitor all grading and/or excavation where there is a potential to affect cultural or paleontological resources. If grading operations or excavations uncover paleontological/archaeological resources, require the paleontologist/archeologist monitor to suspend all development activity to avoid destruction of resources until a determination can be made as to the significance of the paleontological/ archaeological resources. If resources are determined to be significant, require submittal of a mitigation plan. Mitigation measures considered may range from in-situ preservation to recovery and/or relocation. Mitigation plans shall include a good faith effort to avoid impacts to cultural resources through methods such as, but not limited to, project redesign, in situ preservation/capping, and placing cultural resource areas in open space. 4.5.1-3. Notify cultural organizations, including Native American organizations, of proposed developments that have the potential to adversely impact cultural resources. Allow qualified representatives of such groups to monitor grading and/or excavation of development sites. 4.5.1-4. Where in situ preservation and avoidance are not feasible, require new development to donate scientifically valuable paleontological or archaeological materials to a responsible public or private institution with a suitable repository, located within Orange County, whenever possible. 4.5.1-5. Where there is a potential to affect cultural or paleontological resources, require the submittal of an archeological/cultural resources monitoring plan that identifies monitoring methods and describes the procedures for selecting archeological and Native American monitors and procedures that will be followed if additional or unexpected archeological/cultural resources are encountered during development of the site. Procedures may include, but are not limited to, provisions for cessation of all grading and construction activities in the area of the discovery that has any potential to uncover or otherwise disturb cultural deposits in the area of the discovery and all construction that may foreclose mitigation options to allow for significance testing, additional investigation and mitigation. 4.5.1-6. Continue to protect Upper Newport Bay cliff faces to serve as a reference section for micropaleontological studies. Regulatory Requirement Project-related earth disturbance has the potential to unearth previously undiscovered human remains, resulting in a potentially significant impact. If human remains are encountered during excavation activities, all work shall halt and the County Coroner shall be notified (California Health and Safety Code, §7050.5). The Coroner will determine whether the remains are of forensic interest. If the Coroner determines that the remains are prehistoric, s/he will contact the Native American Heritage Commission (NAHC). The NAHC shall be responsible for designating the most likely descendant (MLD), who will be responsible for the ultimate disposition of the remains, as required by Section 5097.98 of the California Public Resources Code. The MLD shall make his/her recommendation within 48 hours of being granted access to the site. The MLD’s recommendation shall be followed if feasible, and may include scientific removal and non-destructive analysis of the human remains and any items associated with Native American burials. If the landowner rejects the MLD’s recommendations, the landowner shall rebury the remains with Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx MS-4 Management Summary appropriate dignity on the property in a location that will not be subject to further subsurface disturbance. DISPOSITION OF DATA This report will be filed with the City of Newport Beach, Newport Bayside Resort, LLC; VCS; and at the SCCIC. All field notes and other documentation related to the study are on file at VCS. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 1 Phase I Cultural Resources Assessment 1.0 UNDERTAKING INFORMATION/INTRODUCTION 1.1 CONTRACTING DATA Newport Bayside Resort, LLC (Applicant) retained VCS Environmental (VCS) to conduct a Phase I cultural resources study for the proposed Project. This report details the findings of the investigation and offers management recommendations and recommendations to evaluate any discoveries and to reduce the impact of the project on resources to a less than significant level. 1.2 UNDERTAKING The Newport Dunes Resort Hotel Project (“Project”) is a proposed 275-room, 201,498-square-foot, hotel. Proposed hotel ancillary facilities include a 917-square-foot coffee shop, gift/sundry shop, business center, approximately 13,000 square feet of meeting space, spa/fitness facilities, 3,190-square-foot restaurant, pool, tennis courts, sand volleyball courts and picnic area. The Project Site is located on 14.3 acres within the Newport Dunes Resort. The Newport Dunes Resort consists of 110 acres of State tidelands property held in trust by the County of Orange and leased to a private operator. The Applicant is a sublessee of the private operator. The cultural resources Study Area includes the Newport Dunes Resort property and a ½-mile buffer around it. 1.3 EXHIBITS Exhibit 1 depicts the location of the Project site on a portion of the U.S. Geological Survey’s (USGS’) Newport Beach 7.5-minute quadrangle, in Township 6 South; Range 10 West, Section 26 (S.B.B.M). Exhibit 2 depicts the Project site in an aerial photograph. 1.4 PROJECT PERSONNEL Patrick O. Maxon, M.A., RPA requested the literature review at the SCCIC, the Native American Sacred Lands File Search at the NAHC, and a paleontological resources literature review at the NHLMAC. He also completed the field survey and authored this report. Refer to Attachment D for personal qualifications. The report is intended to satisfy the requirements of the California Environmental Quality Act (CEQA) regulations (14 California Code of Regulations [CCR] §15064.5 and California Public Resources Code [PRC] §21083.2). At this time there is no federal action under the National Environmental Policy Act (NEPA) and thus this cultural resources analysis does not meet the standards of Section 106 of the National Historic Preservation Act (16 United States Code [USC] 470f) and its implementing regulations at 36 Code of Federal Regulations [CFR] 800, Protection of Historic Properties). 2.1 CALIFORNIA ENVIRONMENTAL QUALITY ACT CEQA requires a lead agency to determine whether a project would have a significant effect on one or more historical resources. According to Section 15064.5(a) of the State CEQA Guidelines, a “historical resource” is defined as a resource listed in or determined to be eligible for listing in the California Register of Historical Resources (CRHR) (PRC §21084.1); a resource included in a local register of historical resources (14 California Code of Regulations [CCR], §15064.5[a][2]); or any object, building, structure, site, area, place, record, or manuscript that a lead agency determines to be historically significant (14 CCR §15064.5[a][3]). Section 15064.5 of the State CEQA Guidelines (14 CCR), and Sections 21083.2 and 21084.1 of the CEQA Statutes were used as the basic guidelines for the cultural resources study. Those sections reference PRC 5024.1, which requires evaluation of historical resources to determine their eligibility for listing in the California Register of Historical Resources (CRHR). The purposes of the CRHR are to maintain listings of the State’s historical resources and to indicate which properties are to be protected from substantial adverse change. The criteria for listing resources in the CRHR, which were expressly developed to be in accordance with previously established criteria developed for listing in the National Register of Historic Places (NRHP) (per the criteria listed at 36 CFR §60.4) are listed below. The quality of significance in the architectural, engineering, scientific, economic, agricultural, educational, social, political, military, or cultural annals of California is present in any object, building, structure, site, area, place, record, or manuscript that possesses integrity of location, design, setting, materials, workmanship, feeling and association and that: (a) Is associated with events that have made a significant contribution to the broad patterns of California’s history and cultural heritage; or (b) Is associated with the lives of persons important in our past; or (c) Embodies the distinctive characteristics of a type, period, region, or method of construction, or represents the work of an important creative individual, or possesses high artistic values; or (d) Has yielded, or may be likely to yield, information important in prehistory or history. According to Section 15064.5(a)(3)(A–D) of the State CEQA Guidelines (14 CCR), a resource is considered historically significant if it meets the criteria for listing in the NRHP (per the criteria listed at 36 CFR 60.4). Impacts that affect those characteristics of the resource that qualify it for the NRHP or that would adversely alter the significance of a resource listed in or eligible for listing in the CRHR are considered to have a significant effect on the environment. Impacts to cultural resources from the proposed project are thus considered significant if the project: (1) physically Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 3 Phase I Cultural Resources Assessment destroys or damages all or part of a resource; (2) changes the character of the use of the resource or physical feature within the setting of the resource that contributes to its significance; or (3) introduces visual, atmospheric, or audible elements that diminish the integrity of significant features of the resource. The purpose of a cultural resources investigation is to evaluate whether any cultural resources are exposed on the surface of the Project site or whether any cultural resources can reasonably be expected to exist in the subsurface. If resources are discovered, management recommendations would be required for evaluation of the resources for CRHR eligibility. Broad mitigation guidelines for treating historical resources are codified in Section 15126.4(b) of the CEQA Guidelines. To the extent feasible, public agencies should seek to avoid significant effects to historical resources, with preservation in place being the preferred alternative. If not feasible, a data recovery plan shall be prepared to guide subsequent excavation. Mitigation for historical resources such as buildings, bridges, and other structures that are consistent with the Secretary of the Interior’s Standards for the Treatment of Historic Properties (Weeks and Grimmer 1995) will generally be considered mitigated below a level of significance. 2.2 ASSEMBLY BILL (AB) 52 This project will be subject to the requirements of Assembly Bill (AB) 52. AB52 is applicable to projects that have filed a Notice of Preparation (NOP) of an Environmental Impact Report (EIR), or notice of a Mitigated Negative Declaration (MND) or Negative Declaration (ND) on or after July 1, 2015. The law requires lead agencies to initiate consultation with California Native American Tribes that are traditionally and culturally affiliated with the geographic area of the project and have requested such consultation, prior to determining the type of CEQA documentation that is applicable to the project (i.e., EIR, MND, ND). Significant impacts to “tribal cultural resources” are considered significant impacts to the environment. For “tribal cultural resources,” PRC §21074, enacted and codified as part of a 2014 amendment to CEQA through Assembly Bill 52, provides the statutory definition as follows: “Tribal cultural resources” are either of the following: 1. Sites, features, places, cultural landscapes, sacred places, and objects with cultural value to a California Native American tribe that are either of the following: (A) Included or determined to be eligible for inclusion in the California Register of Historical Resources. (B) Included in a local register of historical resources as defined in subdivision (k) of Section 5020.1. 2. A resource determined by the lead agency, in its discretion and supported by substantial evidence, to be significant pursuant to criteria set forth in subdivision (c) of Section 5024.1. In applying the criteria set forth in subdivision (c) of Section 5024.1 for the purposes of this paragraph, the lead agency shall consider the significance of the resource to a California Native American tribe. To determine if such resources exist, under AB 52 lead agencies must consult with tribes that request consultation and must make a reasonable and good faith effort to mitigate the impacts of a development on such resources to a less than significant level. AB52 allows tribes 30 days after receiving notification to request consultation and the lead agency must then initiate consultation within 30 days of the request by tribes. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 4 Phase I Cultural Resources Assessment 2.3 HUMAN REMAINS Section 7050.5 of the California Health and Safety Code provides for the disposition of accidentally discovered human remains. Section 7050.5 states that, if human remains are found, no further excavation or disturbance of the site or any nearby area reasonably suspected to overlie adjacent remains shall occur until the County Coroner has determined the appropriate treatment and disposition of the human remains. Section 5097.98 of the PRC states that, if remains are determined by the Coroner to be of Native American origin, the Coroner must notify the NAHC within 24 hours which, in turn, must identify the person or persons it believes to be the most likely descended from the deceased Native American. The descendants shall complete their inspection within 48 hours of being granted access to the site. The designated Native American representative would then determine, in consultation with the property owner, the disposition of the human remains. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 5 Phase I Cultural Resources Assessment 3.0 SETTING 3.1 NATURAL SETTING The 14.3-acre Project Site is part of Newport Bay that was dredged in the early 20th Century. Prior to this time, it consisted of mudflats and bay habitat. This portion of the bay was dredged sometime after 1953 (NETRONLINE n.d.) and it was at this time that the existing sand beaches and lagoon were created. It appears that the parking lots were constructed in the 1970s. The 14.3-acre Project site is a portion of the 110-acre Newport Dunes Resort. It is all State tidelands property held in trust by the County of Orange and leased to a private operator. The Applicant is a sublessee of the private operator. The Project area is located within the Southern Coastline Sub-Province of the Peninsular Range Geomorphic Province, near the northwest edge of the San Joaquin Hills. These rocks that comprise the mountains are composed of pre-Cretaceous (more than 65-million–year-old) igneous and metamorphic rock with limited exposures of post-Cretaceous sedimentary deposits. However, these sedimentary deposits in coastal Orange County are considered to be some of the most important fossil-producing formations in the world (Strudwick & Goodwin 2008). 3.2 CULTURAL SETTING 3.2.1 Prehistoric Two generally accepted schemas for cultural sequences in coastal Southern California are those proposed by Wallace (1955), who interpreted prehistory through temporal horizons, and Warren (1968), who viewed cultural differences not as temporal distinctions, but as local traditions. Wallace (1955) saw four temporal horizons along the Southern California coast: Early Man, Milling Stone, Intermediate, and Late Prehistoric. Early Man Horizon Spanning the period from the end of the Pleistocene to approximately 8,000 years before present (YBP),1 archaeological assemblages attributed to this horizon are characterized by large projectile points and scrapers. The limited data available suggests that prehistoric populations focused on hunting and gathering and moved about the region in small nomadic groups. Milling Stone Horizon Characterized by the appearance of handstones and millingstones, this horizon tentatively dates to between 8,000 YBP and 3,000 YBP. Assemblages in the early Milling Stone Horizon reflect an emphasis on plant foods and foraging subsistence systems. For inland locales, it has been assumed that grass seed exploitation formed a primary subsistence activity. Artifact assemblages include choppers and scraper planes, but generally lack projectile points. The appearance of large projectile points in the latter portion of the Milling Stone Horizon suggests a more diverse economy. The distribution of Milling Stone sites reflects the theory that aboriginal groups may have followed a modified, centrally based wandering settlement pattern. In this semi-sedentary pattern, a base camp would have been occupied for a portion of the year, but a small population group seasonally occupied subsidiary camps in order to exploit resources not generally available near the base camp. Sedentism apparently increased in areas possessing an abundance of resources available for longer periods of time. More arid inland regions would have provided a seasonally dispersed resource base, restricting sedentary occupation. 1 “Years Before Present” assumes that 1950 is “present,” so in this case 8,000 YBP would be 6,050 BCE. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 6 Phase I Cultural Resources Assessment Sutton and Gardner (2010) have more recently proposed the preferred use of the term Encinitas Tradition to replace the term Millingstone Horizon, as a way to better understand it as a local cultural tradition. Intermediate Horizon Dated to between 3,000 YBP and 1,350 YBP, the Intermediate Horizon represents a transitional period. Little is known about the people of this period, especially those of inland Southern California. Sites assemblages retain many attributes of the Milling Stone Horizon. Additionally, Intermediate Horizon sites contain large stemmed or notched projectile points and portable mortars and pestles. The mortars and pestles suggest that the aboriginal populations may have harvested, processed, and consumed acorns. Neither the settlement-subsistence system nor the cultural evolution of this period has been well understood due to a general lack of data. It has been proposed that sedentism increased with the exploitation of storable food resources (acorns); the duration and intensity of base camp occupation increased, especially toward the latter part of this horizon. Late Prehistoric Horizon Extending from the year 750 to Spanish contact in 1763, the Late Prehistoric Horizon reflects an increased sophistication and diversity in technology. This is characterized by the presence of small projectile points that simplified the use of the bow and arrow. In addition, assemblages include steatite bowls, asphaltum, grave goods, and elaborate shell ornaments. Use of bedrock milling stations was widespread during this horizon. Increased hunting efficiency and widespread exploitation on acorns provided reliable and storable food resources. These innovations apparently promoted greater sedentism. By contrast, Warren’s (1968) cultural traditions were more restricted spatially. Warren’s scheme accounted for the cultural variability particularly evident within Wallace’s late Prehistoric Horizon. Warren’s traditions include the San Dieguito, Encinitas, Campbell, Chumash, Shoshonean, and Yuman. The San Dieguito tradition occurs within Wallace’s Early Man Horizon, but is restricted to San Diego County. The Encinitas equated to Wallace’s Milling Stone, but was longer in time, encompassing Wallace’s Intermediate Horizon. Warren saw no new tradition developing in northern San Diego and Orange Counties during this time period. The Campbell and Chumash traditions are farther north in Santa Barbara and Ventura Counties. In Los Angeles, Orange, and North San Diego Counties, the Shoshonean Tradition began about 1300 YBP and represents the intrusion of Shoshonean speakers from the interior (Warren 1968). In contrast, the Yuman Tradition in southern San Diego County, just as the Chumash Tradition to the north, is thought to have developed from previous local traditions, whereas the Shoshonean Tradition is the result of intrusion into a previous tradition (Mason 1991:95). Koerper (1981) and Koerper and Drover (1983) have taken the horizon system proposed by Wallace and have applied it more specifically to the prehistory of Orange County. Koerper (1981) and Koerper and Drover (1983) adapted Wallace’s four horizons using artifacts and associated radiocarbon dates from two Orange County sites: CA-ORA-64 and CA-ORA-119- A. The authors argued that the transition between the Milling Stone and Intermediate Horizons was marked by the appearance of the mortar and pestle. The primary projectile point type changed from the Milling Stone “Pinto Basin” to the stemmed and side-notched forms. The beginning of the Late Prehistoric Period occurred roughly with the appearance of the smaller “Cottonwood” points, suggesting the introduction of the bow and arrow, and also with the abundance of shell beads and ornaments, use of steatite for pipes, bowls, and ornaments and Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 7 Phase I Cultural Resources Assessment arrow shaft straighteners. Pottery may or may not appear at the end of the late Prehistoric Period or the Historic period (Koerper and Drover 1983). Mason and Peterson (1994) have proposed subdividing Wallace’s Milling Stone Horizon into three subdivisions, and the Intermediate, and the late Prehistoric into two. These temporal subdivisions are based entirely on radiocarbon age determinations that correspond to some degree with changes in settlement (Mason and Peterson 1994:58). In contrast, they note that temporal subdivisions traditionally have been defined on supposed differences in cultural content or traits as presented by Willey and Phillips (1958:22). Mason and Peterson found little difference in the cultural content of their three Milling Stone subdivisions (Table 1). During the Newport Coast Archaeological Project, the Intermediate Horizon was not subdivided because only ten radiocarbon dates were available. They were confident that the Intermediate Horizon could also be subdivided once calibrated dates were available from a wider region of the Newport Coast (Mason and Peterson 1994:58), and for that matter, all of Orange County or Southern California. The authors argue that although their temporary subdivisions do not correspond with changes in stylistically defined artifact types, they may correspond with changes in settlement systems (Mason and Peterson 1994:58). The Intermediate Horizon was subdivided in Roger Mason’s report on CA-ORA-225 (Mason et al. 1997). Mason defined 3 periods based on 18 radiocarbon dates. These three divisions are Late Intermediate (1700–1350 YBP), Middle Intermediate (2300–1700 YBP) and Early Intermediate (3100–2300 YBP). Due to the small sample of radiocarbon dates, Mason notes that the Intermediate subdivisions could only be applied to CA-ORA-225 and not regionally. As a result of the Bonita Mesa Archaeological Project (Peterson 2000), the Intermediate Period was redefined. A total of 72 radiocarbon dates from 6 sites were used to redefine the Intermediate. The Intermediate was divided into two periods: the late part of the Intermediate or INT2 (1350–2300 YBP) and the early part of the Intermediate or INT1 (2300–3000 YBP). Sutton (2010) has more recently proposed the Del Rey Tradition replace both the Intermediate and Late Prehistoric Horizons. The Del Rey Tradition exhibits two regional patterns: Angeles and Island. The Tradition is also proposed to represent the arrival, divergence, and development of the Gabrielino in Southern California (Sutton 2009:62-63; 2010:10). Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 8 Phase I Cultural Resources Assessment 3.2.2 Ethnographic At the time of European contact in 1769, the Santa Ana plain was likely occupied by both the Gabrielino and Juaneño Native American populations, so called by the Spanish after the nearby Missions San Gabriel Archangel and San Juan Capistrano, respectively. This designation is in some dispute, but can be thought of as a shared territory. During the early 1900s, important ethnographic studies were conducted by several people including Alfred L. Kroeber, John P Harrington, C. Hart Merriam, W. D. Strong, and J.W. Hudson. Each of these researchers was able to interview members of the Gabrielino who had living experience with the Mission period when the group was in transition. Central Orange County appears to have been shared by both the Juaneño and Gabrielino. The three place names associated with central Orange County are Genga, Pasbengna, and Hutuknga. Genga was located at CA-ORA-58 in what today is Fairview Park in the City of Costa Mesa. Pasbengna was located along the Santa Ana River approximately where the City of Santa Ana is today, and appears on the 1846 map drafted by Alexander Taylor. The third site, Hutuknga, is located where the City of Yorba Linda exists today (Earle and O’Neil 1994). The Gabrielino are frequently thought to have been the dominant ethnohistoric group in Orange County (e.g., Kroeber 1925). Earle and O’Neil have determined that sites along the Santa Ana River afforded pivotal political exchange and social interaction between the Gabrielino and Juaneño (1994). Based on Mission marriage records, the villages along the Santa Ana River apparently consisted of multi-ethnic populations (Earle and O’Neil 1994). Among the more significant sites along the northern coast of Orange County was the complex of sites surrounding Bolsa Chica, including CA-ORA-83, known as the “Cog Stone” site. As with Bolsa Chica, Newport Bay also is surrounded by a number of prehistoric sites. The sites along the southern Orange County coast in the San Joaquin Hills include the multi-component complexes at Bonita Mesa, Pelican Hill, and Shady Canyon. Gabrielino/Tongva/Kizh According to Bean and Smith (1978:538), the Gabrielino are, in many ways, one of the least known groups of California native inhabitants. In addition to much of the Los Angeles Basin, they occupied the offshore islands of Santa Catalina, San Nicolas, and San Clemente. Gabrielino populations are difficult to reconstruct; however, at any one time, as many as 50 to 100 villages were simultaneously occupied. Like the prehistoric culture before them, the Gabrielino were a hunter/gatherer group who lived in small sedentary or semi-sedentary groups, termed Rancherias, of 50 to 100 persons. These Rancherias were occupied by at least some people all of the time. Location of the encampment was determined by water availability. Within each village, houses were circular in form and constructed of sticks covered with thatch or mats. Each village had a sweat lodge as well as a sacred enclosure (Bean and Smith 1978). Their subsistence relied heavily on plant foods, but was supplemented with a variety of meat, especially from marine resources. Food procurement consisted of hunting and fishing carried out by men, and gathering of plant foods and shellfish by women. Hunting technology included bow and arrow use for deer and smaller game, in addition to stick-throwing, snares, traps, and slings. Fishing was conducted with the use of shell fishhooks, bone harpoons, and nets. Seeds were gathered with beaters and baskets. Food was stored in baskets. It was prepared with manos and metates, and mortars and pestles. Food was cooked in baskets coated with asphaltum, in stone pots, on steatite frying pans, and by roasting in earthen ovens (Bean and Smith 1978). Although the earliest description of the Gabrielino dates back to the Cabrillo expedition of 1542, the most important and extensive accounts were those written by Father Geronimo Boscana circa 1822 and Hugo Reid in 1852. Major Gabrielino villages south of the City of Long Beach included Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 9 Phase I Cultural Resources Assessment Lukpa and Kengaa, also known as Gengara or Genga. Moyoonga is another place name cited by Kroeber (1907), but it is unclear if this was a community or a geographical designation (McCawley 1996:72). According to mission records, Genga may have been occupied as late as 1828 or 1829 (Merriam 1968). The place name was still used as late as 1853 identifying Newport Bay as “bolsa de gengara”. Archaeological evidence suggests that CA-ORA-58 may be the remains of this important village. The other village, Lukpa, was, according to one of Kroeber’s Native American informants, located in the City of Huntington Beach. One possibility is the Newland Site excavated by Winterbourne in the 1930s and more recently by other investigators. Juaneño/Acjachemen While Kroeber (1925) and others separated the Juaneño from the Luiseño to the south based on their linguistic differences, Bean and Smith (1978:550) consider them ethnologically and linguistically one ethnic nationality and subsume them under the Luiseño. The Juaneño language, as well as those of the Gabrielino to the north and the Luiseño to the south, was derived from the Takic family, part of the Uto-Aztecan linguistic stock. By contrast, the Chumash language, from north of the Gabrielino, may not be related to any other known Native American language family or stock, representing an origin quite different from that of the Juaneño (Mithun 1999). North of the Chumash and south of the Luiseño are languages considered part of the Hokan linguistic stock, namely the Salinan language to the north and the Yuman family of languages to the south. The Yuman family of languages is derived from the American southwest while the Takic family can be traced to the Great Basin area (Driver 1969). Linguistic analysis has established that the Hokan speakers of San Diego County and those found north of the Chumash were separated sometime after 500 B.C. The implication is that most of the southern California coastal region (excepting Chumash) was once filled with Hokan speakers, who were separated and displaced by Takic-speaking immigrants from the Great Basin area. The timing, extent and impact on local societies of this putative migration are not well understood, and any data related to it represents a contribution to the understanding of local prehistory and history. Juaneño population during the precontact period is not known. It is known that approximately 1,300 Juaneño resided at the Mission in the year 1800 (Engelhart 1922). The Mission death register shows as many as 4,000 Native burials in the Mission cemetery. The Juaneño or Acjachemen resided in permanent, well-defined villages and associated seasonal camps. Each village contained 35 to 300 persons, who for the most part belonged to a single lineage in the smaller villages and a dominant clan joined with other families of multiple lineage background in the larger towns. As Boscana said of the Acjachemen, “all the rancherias were composed of a single relationship” (Harrington 1934:32). Each clan/village had its own resource territory and was politically independent, yet maintained ties to others through economic, religious and social networks in the immediate region. There were three hierarchical social classes -- an elite class consisting of chiefly families, lineage heads, and other ceremonial specialists; a “middle class” of established and successful families; and, finally, people of disconnected or wandering families and war captives (Bean 1976:109-111). Native leadership focused in the Nota, or clan chief, who conducted community rites and regulated ceremonial life in conjunction with a council of elders (puuplem) comprised of lineage heads and ceremonial specialists. The council discussed and decided matters of community import, which decisions were implemented by the Nota and his staff. The hereditary village chief held an administrative position that combined and controlled religious, economic, and warfare powers. While the placement of residential huts in a village was not Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 10 Phase I Cultural Resources Assessment regulated, the ceremonial enclosure (vanquesh) and the chief’s home could generally be found in the center. As Boscana states: The temples . . . were invariably erected in the center of their towns, and contiguous to the dwelling-place of the captain, or chief; notwithstanding their houses were scattered about without any particular regard to order [actually a contemporary census study would likely have shown family groupings], still, they managed to have the location of his house as near the middle as possible. (1933:37) The village chief had a formal assistant, who acted as messenger and had important religious duties. Ritual specialists and shamans, each with his own special area of knowledge about the environment or ritual magic, had hereditary membership on the council and the responsibility for training some successor from his own lineage or family who showed the proper innate abilities. Hence, intra- and inter-lineage affairs dominated the political landscape, both within and between villages, in a manner not unlike that of the Hellenistic city-state or Republican Rome. Father Boscana, a priest at Mission San Juan Capistrano, recorded his observations of the Natives and left a most valuable work. Kroeber (1925) describes Boscana's "Chinigchinich" as, "the most intensive and best written account of the customs and religion of any group of California Indians in the mission days." Kroeber, drawing on Boscana and other sources, describes the Juaneño as having well developed religious, ritualistic and social customs. The center of the Juaneño religion was Chinigchinich, the last of a series of heroic mythological figures. The heroes were originally from the stars and the sagas told of them formed the Juaneño religious beliefs. The most obvious expression of the religion at the time of arrival of the Spanish was the Wankech, a brush enclosed area where religious observances were performed. The Wankech apparently contained an inner enclosure housing a representation of Chinigchinich, a coyote skin stuffed with feathers, horns, claws, beaks and arrows. Both boys and girls were subjected to rites of initiation around the age of puberty. The rites for males included use of datura extract, a hallucinogen, in the search for a spirit helper. Trials of endurance may also have been part of the ritual. Females had to endure being placed in a branch-lined pit containing heated stones. The girl being initiated fasted in the pit for several days. Females also were introduced to tattooing during the initiation period. The Juaneño practiced cremation and burial of the dead. Specific individuals who received compensation for their services managed the cremation. The death of at least those of higher rank was commemorated on the first anniversary. The Juaneño possessed a very accurate calendar. Unfortunately, knowledge of its exact working has been lost. It is known that it combined both lunar and solar elements in a fashion similar to certain Southwestern practices. As a strongly patrilineal society, residence was normatively patrilocal. However, use of the Family Reconstruction methodology with Mission San Juan Capistrano sacramental registers has revealed several births at the mother’s village or third villages, notwithstanding a dominance of patrilocality (O’Neil 2002). Polygyny was practiced, but probably only by chiefs and puuls with ceremonial positions who had larger economic roles within the community (Boscana 1933:44). Sororal polygamy is also seen in the Capistrano records. Divorce was not easy, but possible; divorcees and widows could re-marry, the latter preferably to a classificatory “brother” of her deceased husband. Marriage was used as a mechanism of politics, ecology and economics. Important lineages were allied through marriage. Reciprocally useful alliances were arranged between groups of differing ecological niches. Plant foods were by far the largest part of the traditional diet. The following description is from the summary by Bean and Shipek (1978:552). Villages were situated near reliable sources of abundant water, as was necessary in part for the daily leaching of milled acorn product. As a dietary staple, acorn mush (weewish) was prepared in various ways and served as gruel, cakes, or fried; might be sweetened with honey or sugar-laden berries; and could be made into a stew with added greens and meat. Grass seeds were the next most abundant plant food used, and others included manzanita, sunflower, sage, chia, lemonade berry, wild rose, holly-leaf cherry, prickly pear, lamb’s-quarter and pine nuts. Seeds were parched, ground, and cooked as mush in various combinations (according to taste and availability) much like weewish. Such greens as thistle, lamb’s-quarters, miner’s lettuce, white sage, and clover were eaten raw or cooked, and were sometimes dried for storage. Cactus pods and fruits were also used. Thimbleberries, elderberries, and wild grapes were eaten raw or dried for later cooking. Cooked yucca buds, blossoms, and pods provided a sizable addition to the community’s food resources. Bulbs, roots, and tubers were dug in the spring and summer and usually eaten fresh. Mushrooms and tree fungus provided significant foods supplement and were prized as delicacies. Various teas were made from flowers, fruits, stems, and roots for medicinal cures and beverages. Principal game animals included deer, rabbit, jackrabbit, wood rat, mice, ground squirrel, antelope, quail, dove, duck, and other birds. Most predators were avoided as food, as were tree squirrels and most reptiles. Trout and other fish were caught in the streams, while salmon were available as they ran in the larger creeks. Being predominantly a coastal people, the Acjachemen made extensive use of marine foods in their diet. Sea mammals, fish, and crustaceans were obtained from the shoreline and open, at sea with the use of reed and dugout canoes. Shellfish were the most heavily used resource and included abalone, turban, mussel, and others from the rocky shores; clams, scallops, and univalves from the sandy beaches; and Chione, bubble shells, and others from the estuaries. 3.2.3 History In California, the historic era is generally divided into three periods: the Spanish or Mission Period (1769 to 1821), the Mexican or Rancho Period (1821 to 1848), and the American Period (1848 to present). The Spanish Period (1769-1821) is represented by exploration of the region; establishment of the San Diego Presidio and missions at San Gabriel and San Luis Rey; and the introduction of livestock, agricultural goods, and European architecture and construction techniques. Early exploration of the Riverside County area began in 1772 when Lieutenant Pedro Fages (then Military Governor of San Diego) crossed through the San Jacinto Valley. Permanent settlement began about the turn of the century through the issuance of land grants and grazing permits, and Spanish influence continued to some extent after 1821 due to the continued implementation of the mission system. The Mexican Period (1821-1848) began with Mexican independence from Spain and continued until the end of the Mexican-American War. The Secularization Act resulted in the transfer, through land grants (called ranchos) of large mission tracts to politically prominent individuals. Sixteen ranchos were granted in Riverside County, the first to Juan Bandini in 1838. The Project is located in what was the Rancho La Laguna, also known as Laguna Grande and La Laguna de Temecula. It was confirmed in 1844 in an official land grant to Julian Manriquez by the Mexican governor of California. The rancho consisted of three leagues that included the lake bed and the shoreline (Hampson 1991). At that time, cattle ranching was a more substantial business than agricultural activities, and trade in hides and tallow increased during the early portion of this period. Until the Gold Rush of 1849, livestock and horticulture dominated California's economy. The American Period (1848-present) began with the Treaty of Guadalupe Hidalgo, and in 1850, California was accepted into the Union of the United States primarily due to the population increase created by the Gold Rush of 1849. The cattle industry reached its greatest prosperity during the first years of the American Period. Mexican Period land grants had created large Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 12 Phase I Cultural Resources Assessment pastoral estates in California, and demand for beef during the Gold Rush led to a cattle boom that lasted from 1849–1855. However, beginning about 1855, the demand for beef began to decline due to imports of sheep from New Mexico and cattle from the Mississippi and Missouri Valleys. When the beef market collapsed, many California ranchers lost their ranchos through foreclosure. A series of disastrous floods in 1861–1862, followed by two years of extreme drought, which continued to some extent until 1876, altered ranching forever in the southern California area. Newport Dunes Prior to 1958, the natural bay or cove that existed around the current Project Site extended nearly to Pacific Coast Highway on the south and Back Bay Drive on the east. In 1958 the bay was partially filled in by depositing sand around the margins of the entire cove and creating a beach encircling the inside of the cove. The Marina, to the north of the Project site was also built during this time. After 1980, North Bayside Drive was constructed in the northwestern portion of the Project site, which includes a large parking lot, a boat storage area, and a large stockpile of sand created from the dredged material. The sediment is dredge material from the bay, deposited after 1980 (Susan Hori, Manatt, Phelps, and Phillips, personal communication 2018). The dredged sand remains on the western portion of the Dunes today and is the location of the proposed hotel. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 13 Phase I Cultural Resources Assessment 4.0 METHODS 4.1 CULTURAL RESOURCES RECORDS SEARCH A literature review of documents on file at the South Central Coastal Information Center (SCCIC) at California State University, Fullerton was completed by SCCIC staff on July 19, 2018 (Attachment A). The review consisted of an examination of the U.S. Geological Survey’s (USGS) Newport Beach 7.5-minute quadrangles to evaluate the Project Site and Study Area for the presence of any cultural resources sites recorded or cultural resources studies conducted on the Project and the Study Area (one-half mile radius). The SCCIC is the designated branch of the California Historical Resources Information System (CHRIS) and houses records concerning archaeological and historic resources in Orange, Los Angeles, Ventura, and San Bernardino Counties. The records search provided data on known archaeological and built environment resources as well as previous studies within one-half mile of the Project site. Data sources consulted at the SCCIC included archaeological records, Archaeological Determinations of Eligibility (DOE), historic maps, and the Historic Property Data File (HPDF) maintained by the California Office of Historic Preservation (OHP). The HPDF contains listings for the CRHR and/or NRHP, California Historical Landmarks (CHL), and California Points of Historical Interest (CPHI). 4.2 HISTORIC AERIAL REVIEW An examination was made by Patrick Maxon of the historic aerial photographs at HistoricAerials.com (NETRONLINE n.d.). 4.3 PALEONTOLOGICAL RESOURCES RECORDS SEARCH A paleontological records search for the proposed project was requested from the Natural History Museum of Los Angeles County. A response was received from Samuel McLeod, Vertebrate Paleontologist, on July 13, 2018 (McLeod 2018). (refer to Attachment B). 4.4 NATIVE AMERICAN SACRED LANDS FILE REVIEW An inquiry was made of the NAHC on July 25, 2018, to request a review of the Sacred Lands File database regarding the possibility of Native American cultural resources and/or sacred places in the project vicinity that are not documented on other databases. The NAHC completed its Sacred Lands File search on the same day. The NAHC contacts list, SLF search, and Project site figures were emailed to Patrick Alford at the City of Newport Beach on August 1, 2018. Consultation under Assembly Bill (AB) 52 will be undertaken by the City of Newport Beach independently of this study. Information regarding the results of the Native American coordination/consultation is provided in Attachment C. 4.5 FIELD SURVEY A cultural resources survey of the Project Site was conducted by VCS Archaeologist Patrick Maxon, RPA on July 31, 2018. The entire Project Site was examined for the presence of cultural resources. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 14 Phase I Cultural Resources Assessment 5.0 RESULTS 5.1 CULTURAL RESOURCES RECORDS SEARCH 5.1.1 Resources The SCCIC reveals that no known cultural resources are present on the Project Site. One previously recorded resource (P-33-000098) is within the Newport Dunes, a shell midden on a rock outcrop approximately 1,000 feet northeast of the Project Site. There are 26 additional resources recorded within the Study Area (one-half mile beyond the Newport Dunes) consisting mostly of shell middens and a few larger habitation sites (Attachment A). Table 1 lists and briefly describes the known cultural resources within one-half mile of the Project site. (2006) Hyatt Regency Hotel The recorded cultural resource within the Newport Dunes Resort, 1000 feet northeast of the Project Site is P-30-000098. The site was located on top of a bedrock outcrop known as Coney Island, at the end of a spit of land that extends into the bay in the northeast portion of the Study Area. It consisted of just of a few scattered pieces of marine shell at the top of the outcrop; however, it was obvious to the recorder (Chase 1965) that roadway grading and other land modification at the top of the outcrop probably removed whatever cultural material had been there, leaving only sparse shell. There are several such shell middens in the Study Area. One of the sites in the Study Area—CA-ORA-64—is one of the most important village sites in Orange County with a time depth of nearly 10,000 years. 5.1.2 Studies SCCIC information notes that five cultural resources studies were conducted at least partially within the Project Site. 23 additional cultural resources studies have been conducted within the Newport Dunes Study Area (Attachment A). Table 2 identifies the previous cultural resources studies undertaken within the Study Area. (2004) Archaeological Monitoring Bayview Park OR-03372 Sinopoli (2003) Archaeological Research OR-03996 Johnson (2007) Archaeological Survey OR-04163 Wlodarski (2011) Archaeological Survey OR-04597 Duke (2017) Cultural assessment *Located on Project Site 5.2 HISTORIC AERIAL REVIEW An examination of the historic aerial photographs at HistoricAerials.com (NETRONLINE n.d.) revealed that sometime after 1953 but before 1963, the natural bay or cove that extended nearly to Pacific Coast Highway on the south and Back Bay Drive on the east, was partially filled in by depositing sand around the margins of the entire cove to shrink its size by half, creating a beach encircling the inside of the cove, and installing minor amenities. The Marina, to the north of the Project site was also built during this time. Before 1980 the Newport Dunes Bridge is extended across the mouth of the cove. After 1980, North Bayside Drive is constructed in the northwestern portion of the Project Site, which includes a large parking lot, a boat storage area, and a large stockpile of sand. That sand remains on the western portion of the site today and is the location of the proposed hotel. By 1995 the site looks essentially as it does today, with the construction of the clubhouse and parking lots that support visitors as well as the RV park. 5.3 PALEONTOLOGICAL RESOURCES RECORDS SEARCH A paleontological resources records search for the proposed project was requested from the Natural History Museum of Los Angeles County (LACM). A response was received on July 13, 2018, from Samuel McLeod, Vertebrate Paleontologist (see Attachment B). McLeod’s response indicates that no vertebrate fossil localities are recorded on the Project site, but there are nearby localities from the same sedimentary deposits that occur in the Project site. Most of the proposed project area has surface deposits of younger Quaternary Alluvium, derived as coastal dune sands, fluvial and tidal deposits from the San Diego Creek that flows into Newport Back Bay, or as colluvial deposits from the slightly elevated terrain on three sides. These deposits are unlikely to contain significant vertebrate fossils in the uppermost layers, but older sedimentary deposits occurring at depth may well contain significant fossil vertebrate remains. On the western margin of the proposed project area there are exposures of the marine late Miocene Capistrano Formation. On the little spit in the northeastern portion of the proposed project area, and on the southern and eastern margins of Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 17 Phase I Cultural Resources Assessment the proposed project area, there are exposures of the older marine late Miocene Monterey Formation. Our closest vertebrate fossil locality from the Capistrano Formation is LACM (CIT) 580, north-northeast of the proposed project area on the north side of the mouth of Big Canyon, that produced a fossil specimen of sperm whale, Physeteridae. Our next closest vertebrate fossil localities in the Capistrano Formation are LACM 4911-4912, east-northeast of the proposed project area along Ford Road near MacArthur Boulevard, that produced fossil specimens of white shark, Carcharodon. Our closest vertebrate fossil localities from the Monterey Formation are LACM 1160 and 7139, northeast of the proposed project area in cliffs along Backbay Drive on both sides of San Joaquin Hills Road south of Big Canyon, that produced fossil specimens of bony fish, Osteichthyes, and baleen whales, Mysticeti. We also have locality LACM 6370 from the Monterey Formation due west of the northern-most portion of the proposed project area, in the cliffs on the north side of the Pacific Coast Highway (Highway 1) between Superior Avenue and Newport Boulevard, that produced specimens of undetermined fossil marine mammals. The NHMLAC recommends that shallow excavations in the younger Quaternary alluvium exposed on most of the Project site are unlikely to uncover fossils; however, deeper excavations into older sediments and any excavations into the Capistrano or Monterey Formations may encounter fossils. Any substantial grading on the Project site should be closely monitored. Sediment samples from finer-grained deposits should also be collected and processed to determine if small fossils are present (McLeod 2018). 5.4 NATIVE AMERICAN SACRED LANDS FILE REVIEW The NAHC Search of the Sacred Lands File was completed on July 25, 2018, with negative results for the presence of Native American Sacred Lands on the Project site. However, the area is sensitive for cultural resources. The NAHC provided a list of Native American tribes and individuals that are culturally affiliated with the Project area. The NAHC lists nine tribes and individuals comprising the Juaneño and Gabrielino. The NAHC contacts list, SLF search, and Project site figures were emailed to Patrick Alford at the City of Newport Beach on August 1, 2018. Consultation under Assembly Bill (AB) 52 will be undertaken by the City of Newport Beach independently of this study. The Native American contacts list and correspondence are in Attachment C. 5.5 FIELD SURVEY VCS Archaeologists Patrick Maxon completed the pedestrian survey of the Project site on July 31, 2018. The site was surveyed on foot utilizing north-south trending survey transects spaced no more than 10 meters apart where possible. Mr. Maxon examined the dunes stockpile, boat parking, and car parking lot, as well as the beach area adjacent the Project Site. Ground visibility was very good. No significant cultural resources were noted during the survey. 6.0 MANAGEMENT CONSIDERATIONS Appendix G of the State CEQA Guidelines contains the Initial Study Environmental Checklist Form, which includes, for Section V. Cultural Resources, questions relating to cultural resources, including the historic built environment, historic and prehistoric archaeology, and human remains. The issues presented in the Initial Study Checklist have been used as significance criteria. Accordingly, a project may result in a significant environmental impact if: Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 18 Phase I Cultural Resources Assessment • The Project would cause a substantial adverse change in the significance of a historical resource pursuant to §15064.5. • The Project would cause a substantial adverse change in the significance of an archaeological resource pursuant to §15064.5. • The Project would disturb any human remains, including those interred outside of formal cemeteries. Appendix G of the State CEQA Guidelines Section VII. Geology and Soils includes a question related to the presence or absence of fossils on the Project site. It is as follows: • The Project would directly or indirectly destroy a unique paleontological resource or site or unique geologic feature. Appendix G of the State CEQA Guidelines Section XVII. Tribal Cultural Resources includes additional questions related to the presence or absence of Tribal Cultural Resources on the Project site. They are as follows: • Would the project cause a substantial adverse change in the significance of a tribal cultural resource, defined in Public Resources Code section 21074 as either a site, feature, place, cultural landscape that is geographically defined in terms of the size and scope of the landscape, sacred place, or object with cultural value to a California Native American tribe, and that is: o a) Listed or eligible for listing in the California Register of Historical Resources, or in a local register of historical resources as defined in Public Resources Code section 5020.1(k), or o b) A resource determined by the lead agency, in its discretion and supported by substantial evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public Resources Code Section 5024.1. In applying the criteria set forth in subdivision (c) of Public Resources Code Section 5024.1, the lead agency shall consider the significance of the resource to a California Native American tribe. Historic and Archaeological • The SCCIC records search revealed that no cultural resources have been recorded on the Project Site. One cultural resource (P-30-000098) is recorded on the Newport Dunes, approximately 1,000 feet (305 meters) northeast of the current Project Site—the remnants of a shell midden, mostly destroyed prior to its recordation. Twenty-six other resources are recorded within the Study Area. These resources include shell middens, encampments, lithic scatters, ceramic scatters, and an important village/habitation site. There are also several historic-era resources in the Study Area. • Historic aerials reveal that prior to 1958, the Newport Dunes resort had not yet been created and Bay water extended nearly to PCH on the south and Jamboree Road on the east. Sand and other material dredged from the Back Bay was deposited on the Project Site in the 1980s and 1990s. It remains on site. Prior to the development of Newport Dunes, the Project Site consisted of mudflats and bay habitat. Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 19 Phase I Cultural Resources Assessment Paleontological • Younger Quaternary Alluvium, that is not paleontologically sensitive, covers the Project site. More sensitive older Quaternary Alluvium may lie at depth and the marine late Miocene Capistrano Formation may be present at the western margin of the Project Site. Dredged sediments cover much of the Project Site, especially the southern half, south of the boat parking lot. Tribal Cultural Resources • The identification of Tribal Cultural Resources, and whether any may suffer substantial adverse change as a result of the project, will occur during and as a result of tribal consultation under Assembly Bill (AB) 52. The City of Newport Beach is undertaking this consultation independently and it is not a part of this study. CEQA Public Resources Codes (PRCs) §21084.1 and §21084.2 state that a project that may cause a substantial adverse change (i.e., demolition, destruction, relocation, or alteration such that the significance of the resource would be impaired) in the significance of a “historical resource” or a “tribal cultural resource” respectively is a project that may have a significant effect on the environment. With respect to the questions contained in the Initial Study Environmental Checklist Form of Appendix G of the State CEQA Guidelines, the project will not cause a substantial adverse change in the significance of a known historic, archaeological, or paleontological resource; and the project will not disturb any known burial or cemetery. However, such resources could be present below the surface. RECOMMENDATIONS The following cultural resources conditions were developed by the City of Newport Beach in Chapter 4.0 Coastal Resource Protection of its Local Coastal Program Coastal Land Use Plan and are appropriate for this project: LCP Policies 4.5.1-1. Require new development to protect and preserve paleontological and archaeological resources from destruction, and avoid and minimize impacts to such resources. If avoidance of the resource is not feasible, require an in situ or site-capping preservation plan or a recovery plan for mitigating the effect of the development. 4.5.1-2. Require a qualified paleontologist/archeologist to monitor all grading and/or excavation where there is a potential to affect cultural or paleontological resources. If grading operations or excavations uncover paleontological/archaeological resources, require the paleontologist/archeologist monitor to suspend all development activity to avoid destruction of resources until a determination can be made as to the significance of the paleontological/ archaeological resources. If resources are determined to be significant, require submittal of a mitigation plan. Mitigation measures considered may range from in-situ preservation to recovery and/or relocation. Mitigation plans shall include a good faith effort to avoid impacts to cultural resources through methods such as, but not limited to, project redesign, in situ preservation/capping, and placing cultural resource areas in open space. 4.5.1-3. Notify cultural organizations, including Native American organizations, of proposed developments that have the potential to adversely impact cultural resources. Allow Newport Dunes Resort Hotel U:\Projects\Newport Dunes\Reporting\Newport Dunes ARMR 050719 Final.docx 20 Phase I Cultural Resources Assessment qualified representatives of such groups to monitor grading and/or excavation of development sites. 4.5.1-4. Where in situ preservation and avoidance are not feasible, require new development to donate scientifically valuable paleontological or archaeological materials to a responsible public or private institution with a suitable repository, located within Orange County, whenever possible. 4.5.1-5. Where there is a potential to affect cultural or paleontological resources, require the submittal of an archeological/cultural resources monitoring plan that identifies monitoring methods and describes the procedures for selecting archeological and Native American monitors and procedures that will be followed if additional or unexpected archeological/cultural resources are encountered during development of the site. Procedures may include, but are not limited to, provisions for cessation of all grading and construction activities in the area of the discovery that has any potential to uncover or otherwise disturb cultural deposits in the area of the discovery and all construction that may foreclose mitigation options to allow for significance testing, additional investigation and mitigation. 4.5.1-6. Continue to protect Upper Newport Bay cliff faces to serve as a reference section for micropaleontological studies. Regulatory Requirement Project-related earth disturbance has the potential to unearth previously undiscovered human remains, resulting in a potentially significant impact. If human remains are encountered during excavation activities, all work shall halt and the County Coroner shall be notified (California Health and Safety Code, §7050.5). The Coroner will determine whether the remains are of forensic interest. If the Coroner determines that the remains are prehistoric, s/he will contact the Native American Heritage Commission (NAHC). The NAHC shall be responsible for designating the most likely descendant (MLD), who will be responsible for the ultimate disposition of the remains, as required by Section 5097.98 of the California Public Resources Code. The MLD shall make his/her recommendation within 48 hours of being granted access to the site. The MLD’s recommendation shall be followed if feasible, and may include scientific removal and non-destructive analysis of the human remains and any items associated with Native American burials. If the landowner rejects the MLD’s recommendations, the landowner shall rebury the remains with appropriate dignity on the property in a location that will not be subject to further subsurface disturbance. 7.0 CERTIFICATION I hereby certify that the statements furnished above and in the attached exhibits present the data and information required for this archaeological report, and that the facts, statements, and information presented are true and correct to the best of my knowledge and belief. Maxon, Director, Cultural Services re:Vertebrate Paleontology Records Check for paleontological resources for the proposed Newport Dunes Project, in the City of Newport Beach, Orange County, project area Dear Patrick: I have conducted a thorough search of our paleontology collection records for the locality and specimen data for the proposed Newport Dunes Project, in the City of Newport Beach, Orange County, project area as outlined on the portion of the Newport Beach USGS topographic quadrangle map that you sent to me via e- mail on 29 June 2018. We do not have any vertebrate fossil localities that lie directly within the proposed project area boundaries, but we do have localities nearby from the same sedimentary deposits that occur in the proposed project area, either at the surface or at depth. Most of the proposed project area has surface deposits of younger Quaternary Alluvium, derived as coastal dune sands, fluvial and tidal deposits from the San Diego Creek that flows into Newport Back Bay, or as colluvial deposits from the slightly elevated terrain on three sides. These deposits are unlikely to contain significant vertebrate fossils in the uppermost layers, but older sedimentary deposits occurring at depth may well contain significant fossil vertebrate remains. On the western margin of the proposed project area there are exposures of the marine late Miocene Capistrano Formation. On the little spit in the northeastern portion of the proposed project area, and on the southern and eastern margins of the proposed project area, there are exposures of the older marine late Miocene Monterey Formation. Our closest vertebrate fossil locality from the Capistrano Formation is LACM (CIT) 580, north-northeast of the proposed project area on the north side of the mouth of Big Canyon, that produced a fossil specimen of sperm whale, Physeteridae. Our next closest vertebrate fossil localities in the Capistrano Formation are LACM 4911-4912, east-northeast of the proposed project area along Ford Road near MacArthur Boulevard, that produced fossil specimens of white shark, Carcharodon. Our closest vertebrate fossil localities from the Monterey Formation are LACM 1160 and 7139, northeast of the proposed project area in cliffs along Backbay Drive on both sides of San Joaquin Hills Road south of Big Canyon, that produced fossil specimens of bony fish, Osteichthyes, and baleen whales, Mysticeti. We also have locality LACM 6370 from the Monterey Formation due west of the northern-most portion of the proposed project area, in the cliffs on the north side of the Pacific Coast Highway (Highway 1) between Superior Avenue and Newport Boulevard, that produced specimens of undetermined fossil marine mammals. Shallow excavations in the younger Quaternary Alluvium exposed in almost all of the proposed project area are unlikely to uncover significant vertebrate fossils. Deeper excavations that extend down into older sedimentary deposits, and any excavations in the exposures of the Capistrano Formation or the Monterey Formation, however, may well encounter significant fossil vertebrate remains. Any substantial excavations in the proposed project area, therefore, should be monitored closely to quickly and professionally recover any fossil remains discovered. Also, sediment samples from the finer-grained deposits should be collected and processed to determine the small fossil potential in the proposed project area. Any fossils recovered during mitigation should be deposited in an accredited and permanent scientific institution for the benefit of current and future generations. Mr. Maxon has 24 years of experience in all aspects of cultural resources management, including prehistoric and historic archaeology, paleontology, ethnography, and tribal consultation. He has expertise in compliance with NEPA, CEQA, the National Historic Preservation Act (NHPA), the Archaeological Resources Protection Act, and the Clean Water Act, among others. Mr. Maxon has completed hundreds of cultural resources projects that have involved (1) agency, client, Native American, and subcontractor coordination; (2) treatment plans and research design development; (3) archival research; (4) field reconnaissance; (5) site testing; (6) data recovery excavation; (7) construction monitoring; (8) site recordation; (9) site protection/preservation; (10) mapping/cartography; (11) laboratory analysis; and (12) report production. He has managed a number of projects within the jurisdiction of the USACE, the Bureau of Land Management, the Bureau of Reclamation, and other federal agencies that require compliance with Section 106 of the NHPA. He has also completed projects throughout Southern California under CEQA for State and local governments and municipalities, including Caltrans, the Department of General Services (DGS), the California Energy Commission, the California Department of Water Resources, the Los Angeles County Department of Public Works (LACDPW), the Los Angeles Department of Water and Power, the Los Angeles Unified School District, and others. SELECT EXPERIENCE/PROJECTS Newport Banning Ranch Cultural Resources Services, Newport Beach, CA: Cultural Resources Manager for the ongoing Cultural Resources services for the Newport Banning Ranch Project which would have initially allow for the development of hundreds of residential dwelling units; thousands of square feet (sf) of commercial uses; a resort inn; and public parks on the 401-acre site. A large portion of the site was proposed for permanent open space including restored habitat, public trails, and consolidated oil production facilities. Cultural resources studies conducted included archaeological, historical, and paleontological investigations to support the project's EIR. Initial investigations consisted of (1) a Phase I reconnaissance of the Project site to confirm that the existing conditions of the site were the same as found during the previous survey in 2008; (2) Phase II test-level excavation of eight prehistoric and three historic archaeological sites present on the site to characterize the sites and determine eligibility for listing on the California Register of Historical Resources; (3) an assessment and evaluation of the built-environment resources associated with the West Newport Oil Company development on site; and (4) a paleontological assessment of the project site's potential for the presence of sensitive rock formations and fossil resources. Three archaeological sites were deemed significant as a result of the study, and the project site’s paleontological significance was deemed “high”. However, no historical resources associated with oil extraction operations were identified. Mr. Maxon oversaw the completion of fieldwork, the preparation of archaeological, historical and paleontological technical reports, and subsequently prepared the cultural resources section of the EIR for the project. After the CCC denied the residential project in late 2016, we were retained by Armstrong Petroleum to assist with the cultural resources investigations necessary to facilitate the planned consolidation of the oil production facilities on site. This included the development of an Archaeological Research Plan to guide boundary studies at the site, an Archaeological Mitigation and Monitoring Plan to guide monitoring during ground disturbing activities at the site and an Archaeological Avoidance Plan to facilitate the avoidance of one known archaeological site that lies near the planned development. These plans were approved by the California Coastal Commission and are in place when project activities commence. Future work will include data recovery excavations and/or site protection/preservation of significant cultural and paleontological resources impacted by the proposed project. Archaeological/Paleontological monitoring will be undertaken during grading of the project site. Sunset Ridge Park Project Phase I Cultural Resources Study, Newport Beach, CA: Mr. Maxon was the Cultural Resources Manager for the Sunset Ridge Park Project located in Newport Beach. The project proposes to develop active and passive recreational uses on an approximate 18.9-acre site. The project site is located on the northwestern corner of Superior Avenue and West Coast Highway within the coastal zone, and a park access road would be constructed from West Coast Highway to Sunset Ridge Park through the adjacent private Newport Banning Ranch property. Mr. Maxon conducted a Phase I cultural resources study for the property, which consisted of cultural and paleontological records searches, Native American consultation, and a pedestrian survey. Four cultural resources (CA-ORA-1600, CA-ORA-1601H, CA-ORA-1602H, and CA-ORA-1610H) are recorded on the project site and five cultural resources studies have included the project area. The four sites were evaluated as part of the adjacent proposed Newport Banning Ranch development and were found not to be significant; however, monitoring of grading for the development was recommended. Subsequent monitoring of grading yielded a host of fossil specimens, included Pleistocene vertebrate species such as bison, camel, and horse; as well as invertebrate species including fish, crustaceans, and shell, recovered from the mechanical screening machine employed during grading. All specimens were cleaned, identified and evaluated, then were submitted to the Cooper Center in Santa Ana for permanent curation. Cultural Resources Assessment Orange County Sanitation District 6 Trunk Sewer Relief Project, Newport Beach, CA: Cultural Resources Manager for the cultural resources technical report prepared for the trunk relief project that would modify the existing trunk sewer to prevent future sewage spills. Mr. Maxon completed a Phase I cultural resources assessment of the project site to determine if cultural resources would be impacted by the proposed project and to prepare a cultural resources sensitivity map depicting the relative cultural resources sensitivity of different segments of the pipeline alignment. Lido House Hotel, Newport Beach, CA.: Mr. Maxon was the project manager during grading for the Lido House Hotel, a Cape Cod style boutique hotel at the former location of Newport Beach City Hall. All grading related to development of the hotel was monitored. No cultural or paleontological resources were recovered. Orange Coast College Maritime Academy, Newport Beach, CA.: Mr. Maxon was the project manger during a Phase I cultural resources study for the new building project on PCH. The project anticipates construction of a new building on the inland side of the PCH to complement the main location of the college’s School of Sailing and Seamanship. No resources were discovered. Newport Dunes Resort Hotel Project, Newport Beach, CA: Mr. Maxon is currently the project manager for the cultural resources study of the Newport Dunes project in Newport Beach. The project plans include the construction of a hotel and other amenities to complement the existing amenities on site. The Phase I study consists of a records search and literature review, Native American scoping, a pedestrian survey, and preparation of a technical report. The entire Newport Dunes site, initially constructed around 1958, is a historic landscape. Poseidon Resources Desalination Plant Project Cultural Phase I Identification Studies, Huntington Beach. Mr. Maxon was the Cultural Resources Manager for the Poseidon Resources Desalination Plant Project. He conducted cultural Phase I identification studies of two parcels for the project. The first parcel, consisting of three existing fuel oil tanks and their infrastructure that will become the desalination plant, is located within the existing Huntington Power Generation Plant facility in Huntington Beach. The second parcel is located in unincorporated Orange County immediately adjacent to the City of Newport Beach. It consists of an existing pump station site that will be expanded as part of the current project. Because they are nearly 50 years old, the fuel oil tanks were recorded on California Department of Parks and Recreation (DPR) Series 523 forms and evaluated for eligibility for listing in the California Register of Historical Resources (CRHR). They were found not eligible. Noppenberger Work/Live Development Phase I Cultural Resources Assessment, Laguna Beach, CA: Mr. Maxon was the Cultural Resources Manager for the project which consisted of a plan to raze existing structures on site in order to build a combined Work/Live development for the owner’s business. He completed a cultural resources literature review of the project site at the SCCIC located at California State University, Fullerton, and examined the Historic Resource Inventory (HRI) maintained by the California Office of Historic Preservation (OHP) for Orange County. The results of this research were used to help guide the subsequent field survey and were compiled and summarized in the Cultural Resources Technical Report. Mr. Maxon also contacted the California Native American Heritage Commission (NAHC) for a review of its Sacred Lands File and obtained a list of Native American contacts for the project area. He then prepared and sent informational letters to all NAHC-listed contacts in order to ensure a good-faith effort of participation. Additionally, an intensive cultural resources field survey of the project site was conducted for prehistoric (Native American) or historic (non-Native American) archaeological and other potential historic resources (e.g., buildings, structures). A historic evaluation of the existing structures found that the existing bungalow cottage on the property is eligible for listing in the California Register of Historical Resources (CRHR) and mitigation measures including preserving the site or documenting it under the Historic American Building Survey (HABS, Level III) was recommended. The results of the study were presented to the City of Laguna Beach in a CEQA-compliant technical letter report.
