The Newport Beach City Planning Commission held a Special Meeting Thursday,
January 3, 1946, at 7 :30 p.m,, in the Council Chamber, City Hall, called by
Chairman-Allen.
Commissioners presents Allen, Baltz, Ellerbroek, Isbell, Johnson, Longmoor,RALL.CALL
Nelson, an7l Patterson.
Commissioners absents Seeger.
Public hearing on the application of Louis N. Spielberger, duly advertised PUBLIC
for this date, was declared, and heard, for a change of rear yard setback �NGS
from 3 feet to li feet, and a change of front yard setback from 33 feet to
25 feet for Lot 69 Block, 637, Canal Section, Newport. No protests were
heard or received, and Commissioner Longmoor made the motion, seconded by
Commissioner Ellerbroek, that the Commission recommend to the City Council
the approval of the application.

Ayes: Allen, Baltz, Ellerbroek, Isbell, Johnson, Longmoor, Nelson, and VOTE
Patterson.
Noes: None. 'Motion carried, and so ordered.
Public hearing on the application of Max R. Hann, Corona Del Mar, duly
advertised for this date, was declared and heard, for a change of setback
line from 20 feet to 114 feet for..Lots 1, 3, and 5. Block 231, Corona Dal
Mar. No protests were heard or received, but after considerable considera-
tion, Commissioner Patterson made the notion, seconded by Commissioner John-
son that the hearing be continued to the'next meeting for action, and.that
' the Secretary notify all adjacent property owners by card to give them an
opportunity to be heard. Motion carried.
Public hearing on the application of W. G. Cartter, duly advertised for this
date was declared and heard, for a change of setback line from 20 feet to
114 feet for Lots 2, 4, and 6. Block 231, Corona Del Mar. No protests were
heard or reciived' but this being the property immediately adjacent to, and
west of Mr. Max R. Harm's, and applied for in connection with Mr. Hann, Com-
missioner Patterson made the motion, seconded by Commissioner Johnson, that
the hearing be continued to the next meeting, and adjacent property owners be
notified. Motion carried, and so ordered.
Also scheduled for this meeting was the proposed lease`to T. Kilkenny, and OLD BUSINESS
the land use of the City owned property on Coast Highway. Chairman Allen
stated that the Commission has no jurisdiction over the lease, but does
have on the`land use, and Commissioner Longmoor, that "the financial arrange-
ments are up to the City Council." Commissioner Patterson stated that the
only reason that the matter was referred to the Commission was for consider-
ation of the land use, while Commissioner Isbell stated that the Commission
should recommend to the Council what should be done with the property,
"should be used for slips and revenue for the City". Commissioner Patterson
said that a public hearing should be held to get public opinion. Mr. L.
Loveland, representative of the Kilkenny interests, was present, and stated
that they had waited long for action on their proposition, the matter having
been before the Commission for six months, and that they would appreciate as
' soon as possible to get some idea of what can be done. "Anything that looks
like action will be welcome." After discussion, Commissioner Longmoor made
the motion, seconded by Commissioner Johnson, that the Commission recommend
that the water front of the property be used for yacht moorings, and/or slips
and that the ground in back for uses complimentary and accessory to the yacht
slips, but not industrial uses, subject to the approval of the Commission)
and not recommending any particular application, but further recommendingthat
the land use be on a revenue producing basis for the.City of Newport Beach,

and that the matter be set for public hearing for the next regular meet-
ing, Thursday, January 17, 1946.

Noes; 1 +one. Motion carried, and so ordered.
NERD BUSINESS Discussion was given at the request of Commissioner Nelson, to plans for a
proposed motor court (Ogden) on San Bernardino Avenue, and also a proposed
apartment boil ing at 23d Street and Ocean Boulev$rd (Heinz Kaiser). On
the motor court,.Commissioner Nelson made the motion, seconded by Commiss-
ioner Baltz, that same be submitted to the Architectural Committee. Mo-
tion carried. Considerable discussion was given the proposed apartment
building, said plans ealled for eight apartments, but no provision had been
made for garages to comply with the Ordinance, therefore Commissioner John-
son made the motion, seconded by Commissioner Ellerbroek, that the plena be
returned to Mr.Kaiser, to work out some plan for incorporating garages.
Motion carried,.and so ordered.
ADJOUR MEP'f Commissioner Isbell made the motion, seconded by Commissioner Longmoor that
the meeting be adjourned. Motiop carried, and so ordered.
