Request for a five year extension of a previously USE approved use permit allowing on -sale liquor, PETMIT patron dancing, live entertainment, and private NO. 1233 parties at the Newport Beach Tennis Club. MINUTES INDEX Commissioner Heather stated that she had been contacted by some of the residents in the area and they felt that 7 swimming meets, 7 tennis meets, and the two outdoor luaus or barbeques per year would be satisfactory without. Modifications Committee approval. Mr. Ted Peterson represented the Tennis Club and stated that he talked with Mr. Pegg.prior to and the meeting and they had agreed on this number of meets. Mr. Bernard Pegg addressed the Commission and stated that he was representing only himself and he felt that 7 scheduled tennis meets.and 7 scheduled swimming meets would be satisfactory. Motion x Following a further discussion, approval was Second x recommended subject to the fallowing conditions: All Ayes 1. The closing time for the bar, restaurant, patron dancing, live entertainment for club members and guests, and permission to rent.facilities to private parties, shall be: governed by the closing time of 2:00 A.M. on Saturdays, Sundays and national holidays, and 12:00 Midnight on other nights. 2. Use of the swimming pool shall be con -. fined to the hours of 8:00 A.M; to 9:00 P.M. weekdays and 9:00 A.M. to 9:00 P.M. Saturdays, Sundays; and holidays, except for 7 scheduled meets per year. In addi- tion; two outdoor luaus or barbeques per year with activities to 12:00 Midnight shall be permitted in the swimming pool area. 3. Use of tennis courts shall be confined. to the hours of 7:00 A.M. to 10`00 P.M. weekdays and "8:00 A.M. to 10:00 P.M. Saturdays,;Sundays and holidays except for 7 scheduled meets per year.. All court lights will be out by 10:00 P.M. except for the 7 scheduled meets. 4. The use of outdoor loud speakers shall be limited to.the 7.scheduled tennis meets and the 7 scheduled swimming meets • and.the outdoor luaus and barbeques permitted under Conditions No. 2 and 3 abovwe.. The use of outdoor.loud speakers for paging is prohibited at any time. 5. The Club's management and owners are responsible for the quiet and orderly behavior of the club members and guests in the parking lot, particularly during the one hour period following club closing. Parking shall be controlled and the lot will be emptied of all members and guests.cars.within one hour after closing. 6. All of the above regulations. are to be observed by Club owners, employees, members and guests. 7. Extension of this use permit is for a period of one year. Commissioner Adkinson disqualified himself prior to consideration of the following item as he had represented Mr. Guy LeValley prior to the submission of this application. Item #2. Request to.permit the serving of alcoholic bever- USE ages in conjunction with a restaurant located PERMIT within 200 feet of a dwelling district. Robert.Bogey and Co., Malibu Owner: Guy LeValley, Newport Beach Chairman Dosh reviewed the application and sug- gested conditions of approval, as well.as 3 letters of opposition which had been received prior to the meeting. MINUTES INDEX Hewicker stated that the applicant's attorney had handed to him that evening 5 letters in favor of the application as well as two petitions, one with 14 signatures and the other with 4 signatures, all in favor of the applicant's request. Mr. Tully Seymour, the applicant's attorney, addressed the Commission and explained the pro- posed operation, stating that it would not be a nuisance either from a parking or noise standpoint as it was, not a night club type of operation and live entertainment was not contemplated, and the building would be.sound proofed. He stated that their principal business would be at.the dinner hour, between 6 :00 and 10:00 P.M., but they would also serve lunch. Mr. Seymour reviewed the park- ing situation with the Commission and stated that because of the type of-operation and the 390 public parking spaces in the immediate vicinity, it was not anticipated_.that there would be a park- ing problem. • Mr. Gary. Wilder, the applicant, as well.as the architect, John.Adams;Jerde, addressed the Commis- sion and displayed drawings showing.the off -site parking in relation.to the restaurant, as well as renderings of.the proposed remodeling of the build- ing.. The following persons addressed the Commission in favor of the application: Mrs. Frankie LeValley, Rae Anne Prescott.of 2234 Channel'Road; Mr. Lewis Fanta, 1912 W. Oceah.Front; Mr. Tom Hyans, 217 - 19th Street. The following persons. spoke in opposition: Mr. Bob Seiling and Mr. A. Stahlheber, the adjacent neighbor at 2006 Court Avenue,. who stated he was concerned about the noise at night. He also stated that the new fence along.the alley was constructed to preserve an existing tree.. He pointed out that -the house faced on Miramar Avenue and that, therefore, the alley and "L" Street would be considered side yards. A discussion..ensued in which it was noted that although in this particular case "L" Street had become a side yard due to the fact that the house, which had been constructed in 1927, faced on Miramar Avenue, the Districting Map indicated a 10 foot setback on "L" Street. Community.Development Director Hogan read into the record Section 20.47.0606, the Section of the Code.on which this application had been referred to the Commission and pointed out that the Commis - sion should approach this as.if it were.a new application because it.was a complete replacement of a structure, whether a fence or a.building, and that each application should stand on its own merit. He noted further that if a policy should be established, then the Code should be amended to . reflect this policy. Chairman Dosh reviewed the application with the Commission and Zoning Administrator Laycock noted that subsequent to the filing of the application, the property had been resurveyed and the net area was found to be 65;109 sq.ft. rather than 63,597 sq.ft. as indicated in the staff report and therefore the proposed 54 unit apartment complex conformed with the required R -3 density. It was pointed out that the variance did not request a waiver of square footage but rather a.reduction in parking requirements. Mr. Alan Davison, representing Sequoia Pacific Realco addressed the Commission and stated that the parking being provided for the project was.in excess of the proposed off - street parking require- ments for residential districts which had been recommended to the City Council for approval by the Planning Commission on June 17, 1971. (The City Council did not adopt.the ordinance but referred it back to the staff for further study,) Mr. Davison noted further that 39 of the units were bachelor units and that the other units were, not excessive in size, and that to further allevia e the traffic problem, they had dedicated 12 feet on 54th Street to the City. Commissioner Adkinson stated that the application to reduce the parking was based on conjecture that the ordinance would be changed but that according to his. recollection, when the ordinance was recom- mended -to the City Council at the last meeting of the "old" Commission on June 17, 1971, it.had been his impression, and he believed the impression of the other Commissioners at.that time, that the Page 8. INDEX A ordinance was to apply only to developments of 4. units or less.and that the larger complexes, such as this one,.were to comply with the parking ratio as it now exists. He further stated that if that were not the case, he would like to review that portion of the discussion and forward to the City Council his own letter setting forth his views at the time the matter would again be referred to the Council. He also stated that he did not intend to infer that it was the staff's error, but rather that it was an error on the part of the Commission. Community Development Director Hogan stated that the Council had no quarrel with the Commission's recommendation regarding parking standards for this type of development, but that the main concern expressed was regarding duplexes in the older areas such as Balboa Island and Balboa Peninsula. The following persons spoke in opposition to the granting of this variance based on the parking problem presently existing in the neighborhood: Mrs. Lorraine Buffington of 5403 River Avenue; Mr. Arthur Jones representing Mr. and Mrs. Stephen - Mc Nash on the corner of River Avenue and 54th Street and others.in the 5300 block; Mr. John Durio of 215 JoAnne Place; Mr, Paul Balalis of 5309 River Avenue; Anne Schmitz who lives in Lido Sands. A discussion followed in which the Commission questioned the advisability of a- variance based on the conjecture that an ordinance might-be adopted and that the application should be based on the, x ordinance as it now.stands. Therefore, the.applica x tion was denied. Item #7. Mr. Carl Thomas represented the applicant and questioned the need.for some of the suggested con - ditions. He .al so stated that the use of the property had been held up because of the freeway situation; that they hoped ultimately to_.develop the entire parcel. INDEX Mr. Eric Lassen.of the Irvine Company addressed th Commission and stated that from the earlier dis- cussion, it seemed there.had been some misundersta ing as it was the impression of the Irvine Company d- that the Planning Commission had adopted certain modifications to the parking requirements for multi - family projects, as follows.: 1 space per 1 bedroom efficiency unit. 1.5 spaces for 2 bedrooms 2 spaces for 3 or more bedrooms and that this application was submitted on that understanding. The Commission noted that each P -C zone was con- sidered on its own merit and that in this particular instance, the applicant had provided the amount of parking considered to be adequate for the site; the opinion was expressed that the proposed off - street parking ordinance did not apply to this particular P -C zone and also that developers should be cautioned against asking the Commission to approve changes based on an ordinance that might never be adopted as the Commission could be criticized for assuming that all of its recommenda- tions would be adopted by the City Council. Mr. Lassen stated that as it seemed there had been some misunderstanding, perhaps the hearing should be continued for the purpose of clarification; Community Development Director Hogan agreed, statin he felt the staff also needed clarification. . x Following a further discussion, the application.was x continued until February 3, 1972 at the request of the staff and the applicant. Item #11. Request to amend a portion of Districting Map No. 11 from a C -1 District to an R -2 District. Tucker, Santa Ana. Chairman Dosh reviewed the application with the Commission and Assistant Community Development. Director Hewicker explained the staff's recommenda tion of denial. Mr. Don Prescott represented his wife, Rae Ann Jackson Prescott and stated that the area was im- proving and they would like to make further im- provements; that the property no longer had a, reasonable function as "C -1" nor could it have in the future as, with the parking requirement, they could build only 750 sq.ft. of commercial area on each lot. He stated further that they believed with the view of the bay, the lots would lend themselves to quality residential development. Upon being questioned as.to whether this would be. considered "spot zoning ", the staff pointed out that this entire block up to the commercial area on Main Street was utilized for residential purposes at this time, however, staff felt they might be premature in recommending a zone change to R -2 when one of the reports.they had written, but whit had not been adopted by the Planning Commission,. recommended that all of the area between Adams Street and "A" Street should remain as a. "commer- cial node ". Rae Ann Prescott, the owner of the lot addressed the Commission and stated they were at a point where they could not do anything to further improve. their house, which was 60 or 70 years old, and the house next door had .5 units on it which had outliv d their usefulness. x Following a. discussion, Amendment.No. 311 was x recommended to the City Council for approval. x x x x x x Request to amend a portion of Districting Map No. 13 from.a C -1 District to an R -2 District. Chairman Dosh reviewed the application with the Commission, as well as two letters which had been received, one from Carroll Beek.which was.neither for nor against and another from Ross Miller of 110 Pearl Avenue who stated he had no objection to the application. There was a discussion as to whether this- property should be zoned R -2 or R -3, to-conform to the ad- joining property; however it was the consensus of opinion that R -2 was the normal zoning for water- front property on Balboa Island. There was also a discussion regarding the requested zero setback and it was felt that a residential building should have a residential setback. Community Development Director Hogan pointed out that if the Commission did not establish a front setback line that the setback would automatically be 20 feet and the applicant.would have to apply for a.variance.to reduce the setback: Mr. Vic Sherreitt, the applicant, addressed the Commission and asked that he be allowed to maintain the same setback as the property on either side of the subject lot, which is zero. He stated that if he were required to set back.5 feet he would be at - a disadvantage and his view would be restricted.
