of said facilities. Furthermore, the City
shall not be held responsible for any future
problems with the subject utilities in con-
junction with the conversion of the existinc
duplex to a two unit condominium complex.
4. That the dwelling units shall be inspected
and brought into compliance with the applic-
able building standards of the City at the
time the building was constructed.
5. That one accessible garage space and one
tandem garage space shall be maintained for
each dwelling unit on the site at all times.
6. That each tenant of the proposed condominiur
shall be given 120 days written notice of

advised that the new lease requires the enclosul

parking area. Mr. Ray advised that condition
No. 10 relative to combining the two lots could
not be met because the other property owner, Bi'
Welter, has refused to buy, sell, or enter into
any joint ownership, and felt that the intent o'
the ordinance had been met because of a long -tei
lease which goes beyond the year 2,000.
Dennis Hurowitz, 415 Narcissus, appeared before
the Commission and voiced concern with the expal
sion of the restaurant and increased parking wh-
would add further congestion to the area as wel'
as reduce the value and rentability of his pro-
perty because of the adjacent proposed parking
lot with its noise and lights. He further
commented on the proposed wall between his pro-
perty and the proposed parking lot and felt tha-
it should be higher in order to provide privacy
•
for his tenants.
Planning Commission discussed increasing the
height of the wall within the setback area as wl
as an increase in the overall height in order ti
provide more privacy and liveability on the
adjacent property.
Assistant City Attorney Coffin commented on the
requirement to combine the lots and advised thei
was no way this requirement could be waived
unless the zoning ordinance was changed.
There being no others desiring to appear and be
heard, the public hearing was closed.

Motion was made that Planning Commission make tl
following findings:
1. That the proposed commercial development is
consistent with the General Plan and is
compatible with surrounding land uses. The
offsite parking lot use in a residential
district is not in conflict with the Genera
Plan.

provided for the proposed development.

3. The offstreet parking spaces for the expand(
restaurant on a separate lot from the build-
ing site is justifiable for the following
reasons:
(a) The parking lot is actually the expans'
of an existing offsite parking lot that
is directly across a 14 foot wide alley
from the main building site;
(b) The proposed development will not creal
undue traffic hazards in the surroundil
area; and
(c) The parking lot site is owned by the s<
owner as the restaurant site and will t
maintained as an offstreet parking lot
for the duration of the restaurant use
on the adjacent building site.

4. That the Police Department has indicated thl
they do not contemplate any problems.
5. That the establishment, maintenance or operl
tion of the use of the property or building
will not, under the circumstances of the
particular case, be detrimental to the heal
safety, peace, comfort and general welfare I
persons residing or working in the neighbor,
hood of such proposed use or be detrimental
injurious to property and improvements in V
neighborhood or the general welfare of the
City and further that the modification requ

1. That development shall be in substantial
conformance with the approved plot plans.
2. That the boundary wall between the proposed
parking lot and the adjoining residential l
shall be of solid masonry construction and
shall be constructed to a height of 7 feet
up to a point 5 feet behind the front pro-
perty line. The remaining portion of the
wall between the front property line and a
point 5 feet back shall be 3 feet in height
3. That an offsite parking agreement shall be
approved by the City Council, guaranteeing
that a minimum of 24 parking spaces shall b
provided on Lots 1 and 3, Block 440, Corona
del Mar, for the duration of the restaurant
on the property in question.
4. That the offsite parking area shall be pave
with asphalt, concrete or other street sur-
facing material of a permanent nature. Par
ing spaces shall be marked with approved
traffic markers or painted white lines not
less than 4 inches wide.
5. Wheel stops shall be provided.so as to keep
parked automobiles from encroaching into th
adjoining 14 foot wide alley.
6. A 2 foot wide landscaped planter shall be
provided adjacent to the proposed boundary
wall between the new offsite parking lot
and the adjoining residential lot. Said
landscaped area shall be planted with a
groundcover that shall not exceed 3 inches
above a 6 inch high curb so as not to
obstruct the front overhang of parked auto-
mobiles. Bougainvillea or other vine of
sufficient variety, number and size shall
be planted in cutouts between parking stall
so as to screen the subject boundary wall.
Trees, shrubs, or vines shall also be plant
in the proposed 5 foot wide planter areas
along the front property line so as to
screen the offsite parking lot from Narcis
Avenue. A landscape plan shall be submitte
to and approved by the Director of Parks,
Beaches, and Recreation incorporating the
abovementioned landscape requirements. Sai

ance with the approved plan, and the land-
scaping shall be permanently maintained.
7. That the trash storage area shall be provide

8. That all exterior lighting and signs shall
be approved by the Director of Community

wine shall be approved for a period of two

Commissioner Hummel advised he had not observed
one instance where a residential lot adjacent t
commercial property and used for parking had no
done damage to the value of the residential pro
perty adjacent to the parking and progressively
down the block. He felt that if it was the
intent to provide parking on property adjacent
to commercial uses, they would have been zoned
that way and that construction of a wall betwee
the two uses was a nuisance no matter how high.
Also, he could not see why the parking lot shou
be allowed a curb cut on the residential street
where it would not be granted for a residential
use because the property abutted an alley. He
felt that the operation should remain low -key a
opposed expansion of the parking.

mended and felt that the 5 foot front yard setb�

Commissioner Hummel commented on the parking anc

was just under that which would require an addi•
tional space per unit and felt that the applicai
was playing a numbers game with the square foot
in order to reduce the parking requirement.

Planning Commission discussed the effect of the

sidewalk along 5th Avenue and the responsibilit,
of the City to pay for 50% of the cost of sewer
relocation.

Motion was made that Planning Commission recomm
to the City Council the approval of Amendment N
478 changing the zone from C -1 -2 to R -2 and
establish a 5 foot setback on Dahlia Avenue.
Commissioner Hummel commented on the buildable
area which has been allowed in the past through
restrictions of the Coastal Commission and felt
even that was too much for the small lots in
Corona del Mar. He felt that approval of this
project would open the door to other constructi
which was not consistent with development in th
old Corona del Mar area and opposed the project
Commissioner Balalis requested that the motion
modified relative to the front yard setback on
Dahlia Avenue in order to reduce the buildable
area which would be allowed. Staff advised tha
if a specific setback was not established, it
would automatically be set at 20 feet according
to the zoning ordinance.

benefits of occupancy and use of existing
properties within the area.
3. The proposed development does not adversely
affect the public benefits derived from

expenditures of public funds for improvemen
and beautification of streets and public
facilities within the area.
4. The proposed development promotes the maint
ance of superior site location characterist

remainder. (Relocation will require constrl

Commissioner Seely felt that this particular
parcel was not of the same character as the res
of old Corona del Mar and that the project as .

this location.
Commissioner Hummel reiterated his feeling that
the proposed units were too large for these
small lots and would be detrimental to the
community.

Community Development Director Hogan advised of
defect in the legal advertising of this request
in that a portion of the project is located in
the Unclassified District due to an exchange of
land between this property and the golf course.
He advised of the need to change the zoning on
the strip of land presently located in the
Unclassified District as well as readvertise the
entire project. He also advised of the alter-
native actions available to the Commission in
connection with this project.
Mr. Hogan commented on the rezoning of the golf
course to Open Space as designated in the City's
General Plan.
Environmental Coordinator Foley reviewed an
aerial photo of the property in question which
designated both the original property line and
the amended property line subsequent to the
exchange of land. He also reviewed the various
tradeoffs which have been made.
Planning Commission discussed the tradeoffs and
voiced concern with the possibility that open
space in one location was being traded for some-
thing other than open space in another location.
Planning Commission also discussed the extension
of Backbay Drive including a possible future
connection to Coast Highway.

population in mind, the Parks, Beaches and
Recreation Director agreed that the proposed 1.1
acres of recreational facilities more than met
the standards.
Public hearings were opened in connection with
these requests.
Bob McLain, 1470 Jamboree Road, Newport Beach,
applicant, appeared before the Commission in
connection with these requests. He advised of
past projects which have been constructed in thl
Newport Beach area and reviewed the proposed si-
and location of the project. As to the propose
development on the site, Mr. McLain advised tha
the number of dwelling units per acre had been
substantially reduced; that 53% of the property
would be landscaped and the remaining 47% would

contain the units, streets, recreation area., et,
that the architecture was representative of tha

landscaping would be of a tropical nature with
palm trees, bridges, lakes, etc. He commented
on marketing factors with respect to availabili

the development, advised of a suggestion to

Mr. McLain answered questions of the Commission
relative to landscaping and providing plants
which would require less water than those of a
tropical nature in the areas away from the
streams and waterfalls.

requested that these items be continued in order
to allow their association the opportunity to
review the project more fully and make a report
of their findings.
Burr Allegaert, 2200 Aralia Street, President,
East Bluff Homeowners Community Association,
appeared before the Commission and advised of
his understanding that all environmental impact
reports relative to projects along Jamboree Roa
would be made available to the homeowners assoc
tions for review prior to the hearing. It was
also his understanding that official notice wou
be provided to the homeowners association. He
requested a continuance of this project in orde
that the EIR could be reviewed.
Forrest Smith, owner and operator of the Irvine
Coast Country Club, appeared before the Commiss

and pointed out that this project would complet
the boundary line surrounding the Country Club.
He further advised of hi---s delight with the pro-
posed development and welcomed the project as a
neighbor.
Jean Watt, 4 Harbor Island, appeared before the
Commission representing SPON and requested a
continuance of the project in order to allow ti
to review the EIR and make a statement. She
advised of their concern with the traffic and
circulation as a result of future projects and
the need to determine the future of the Circula
tion Element. She also commented on the future
of the Open Space Element and the need to resol
these issues before further projects were appro
ed.
Sue Ficker, 110 9th Street, Balboa, appeared
before the Commission on behalf of the Central
Newport Beach Community Association and commend
the project itself, but voiced concern with the
drainage system and the quality of water which
would run into the bay. She felt that new
standards were needed in this regard and read

letters from the Department of the Interior and
the Department of Fish and Game relative to
water quality. She advised that the Central
Newport Beach Community Association was opposed
to any project that would contribute to the
pollution of the bay.

Hal Thomas, 908 West Balboa, appeared before tF
Commission and advised of his background in wate
quality, including 208 Water Quality Planning it
Los Angeles. He commented on the information
relative to the sump pumps and felt they would
not be very effective, however, he felt there we
alternatives which would be more effective and
should be explored.
At this point, Planning Commission discussed th(
subject of storm water runoff and studies under
way as to what may be done to clean up non -sour(
runoff into the bay.
Fred Sawyer, 15 Bear Paw, Irvine, consultant to
the City of Newport Beach, appeared before the
Commission to comment on the grease traps and
pointed out that they have been used in industry
for more than 40 years and have worked satisfac-
torily where the movement of water is fairly
controlled and were certainly worth trying in
•
this development. He further commented on
drainage into the bay from other points and its
effect on the entire bay as well as being unablf
to obtain the necessary information and analysis
from the Department of Fish and Game in order tI
determine the type of pollutants present. It w<
his feeling that neither this project nor others
like it could solve the problem of pollution in
the bay and that it was important.that some
study be given to drainage up- stream in order ti
preclude unjust penalization of projects around
the bay.
Bob Millar, Vice President, Little Balboa Islam
Property Owners Association, appeared before th
Commission and commented on the problem of traf
Ken Clissett, resident of Eastbluff and Directo
of the Eastbluff Community Association, appeare,
before the Commission to comment on the additioi
traffic and noise which will be generated by th
project and encroach into present residential
areas as well as the City's responsibility to
establish and enforce regulations dealing with
the problem of noise.

be taken to placing old Corona del Mar, north of
the Coast Highway, within the same constraints a
