HomeMy WebLinkAbout06/15/1938JANE 15, 1935 THE NEWPORT BEACH CITY PLANNING COMMISSION met in regular session Wednesday, June 15, 1935 at 7:30 p.m..in the Council Chambers, City Hall. • In the absence of Chairman Hopkins it was necessary to elect a temporary chairman. ``Com. Briggs moved that Com.Schnitker act as temporary chairman. Seconded by Com. Findlay. Motion carried. ROLL CALL - Commissioners present: Briggs, Schnitker, Williams, Patterson, Findlay. Commissioners absent: Hopkins, Seeger, Whitson. Consultant Tilton attended. i 110 MINUTES Com. Briggs moved that the minutes of June 1,1938; be approved as written and the reading be dispensed with as all members had received copies thereof. Seconded by Con. Findlay. Motion carried and so ordered. HEARINGS - SECOND HEARING CONTINUED (ON AMENDMENT TO ALLOW 'FISH- SMOKERS) As ordered at the meeting held May 25th, Mr. Tilton reported that he had conferred with Attny. Thompson on the matter of amending the ordinance to allow fish - smokers as a home industry. Fig opinion was that there is no easy way in which to allow this use except possibly to allow it as an accessory home - use. It would be materially detrimental to property values to change the ordinance to allow this type of industry any - where in the city. The only way would be to provide a special place in the city for such activity where there are similar uses at the present time. As a small home occupation there should be no objection to it. If it is found that there is a demand for more of this type of activity than at present, it will be up to the commission to find a place in the or-rd- inane for it. For the present, however, the best way seems to be to allow it to go on as it is, as a non- c6nforming use. Later it might be worked in with the fishing villiage which Mr. Hopkins has suggested as a home occupation. Fish curing can become a serious problem if not properly controlled. Com. Patterson said that it would be difficult under our zoning ordinance to set up a special district for a certain type of activity. Mr. Tilton said the only place would be where there are similar types of activity. It might be allowed in the M-1 zones. Chairman inquired if anyone present wished to speak on this matter. No response. Cali. Williams said that after' hearing Mr. 'Tiftosise rwpe .j her opinion was that this type of industry might become a nuisance if made a permissible use and it would be very difficult to segregate and control; therefore, she moved that no change be made in the ordinance to allow fish - smokers. Seconded by Com. Patterson. Passed by the following Roll Call vote: Ayes: Schnitker, Briggs, Williams, Patterson, Findlay. Noes: None. So ordered by the Chairman. Com. Briggs moved that the commission recommend to the City Council that the petition for rezoning of the area 1y ing between the Westerly line of 19th St, and the Easterly dine of 30th St. and the Northerly line of Central Ave. and ; the Bay Front from C-2 to 9-1 to allow fish- smoking as a home industry be denied. Seconded by Com. Patterson. Motion carried and so ordered by the Chairman. FIRST HEARING (ON REZONING CITY PROPERTY FRONTING ON THE NORTH CHANNEL) The request from the City Council for rezoning from 0 -2r'to M -1 of that parcel of city property fronting on the North ` Channel between the Bay and the Coast Highway was read by ' the Chairman. He also read a copy of Mr. Smith's applica tion for lease of this land to erect boat ways, machine shop and trailer camp as submitted by the Council with their application for rezoning. Chairman declared the hearing open for discussion. Com. Patterson said that as he had stated before, the City has only 3 areas on the water front; one between 15th' St and l9th St where the camp grounds are, the second, now under a 15 year lease on the North Bay opposite Balboa Is. and the site under discussion. In his opinion, the city should hold that property in its present status or the city will find that they have no water frontage to take care of the transient public. The city will soon have to set aside certain areas to take care of these people. Also, he is opposed to the city going into competition with private business, Mr. Lew Wallace was present to express his opposition to leasing this land to private interests. He said that Mr. Irvine had been opposed to assigning any water frontage to the city because he had forseen exactly what has come up; that the city would loose control of the property. Mr. Irvine felt that it would be better for himrto keep control of this water frontage. Finally, he gave about 1,800 feet of this land to the city with the understanding that it would be kept for public use. The other frontage in this - parcel was acquired, by court action; Mr Irvine did not oppose the action at the time because he had been assured that it would be used for park purposes. In justice to Mr. 'Irvine the city is "honor bound" to keep this property as it is and make no change in the 'zoning laws. We have 2,70o feet of water frontage in our control and it should be kept that say. If dolphins were put in at this location for the large yachts which come into our harbor and a pier provided in this location for them to load and take on pro;- visions, the city would benifit financially more than by leasing, this valuable land to a private individual. The taxable income derived from it in this way would be more than we could get from any other rental. "I am opposed to leasing it at any time to anybody." Mr. Granger Byer was present and said that he concurred with Mr. Wallace's statement in every r$spect. "This land should be retained by the.City and no change in the zoning made at this time." Mr. Tilton said that there was one other point which he would like to mention and that is that this land is one 'of the last remaining pieces of capital which the city has. ' Like any private business, it is poor policy to expend the last bit of capital. This is a very valuable piece of lani and should be kept as one of the assets of the city. we should be thinming about how this area canbe developed. Com. Findlay said that he was opposed to leasing any water frontage. Com. Patterson moved to dontinue the hearing on rezoning this area to the next regular meeting to be held July 27:' • _ Seconded by Com. Findlay. Motion carried and so ordered. PLANS FOR DEVELOPMENT OF OCEAN FRONT AT BALBOA Mr. Tilton presented the plane and drawings of the pro - posed development of the ocean front at Balboa. Be stated that he has revised the plan so that it is now in shape to be turned over to the City Council, having added the public pier on the Bay as part of the development as instructed by the commission. The plan has reached a point now where it can be sent to the Council for action. The function of the Planning Commission is to suggest and plan the use of land; with this drawing complete, our work is done. It is up to the City Council whether the funds can be found to carry out the plan. Mr. Tilton explained the plan to those present and invited them to inspect the drawings. After general discussion, Com. Findlay moved that this preliminary plan be submitted to the City Council for their consideration as a suggestion from the Planning Commission for the improvement of the Ocean Front. Seconded by Com. Patterson. Motion carried and so ordbred by the Chairman. 1• Com. Findlay moved that the proposed project for the im- provement of the city water system and repAbcement of sewers along Central Avenue as explained by Com. Patterson be ap- proved by the Planning Commission. Seconded; by Com.Briggs Motion carried and ad ordered by the'Chairman. " A Mr. Sampson appeared before the commission to receive their approval of a sign which he intends to place upon a building he is erecting on Coast Highway. Com. Patterson moved that the request of the Sampson Advertising Company be referred to the Architectural Committe, Seconded by Com. Briggs. Motion carried. So ordered. ADJOURI=T - On motion of Com.
