COMMUNICATIONS 1. Presented to the Commission was a communication Approved dated January 14, 1959 signed by Donald D. Harwood, Motion attorney for William Cagney, requesting therein that Second ; 1x, ; Use Permit No. 390 which expires on February 1, 1959 be extended for six months or until and including July 31, 1959. The request for extension of said Use Permit was approved. 2. On January 12, 1959 the City Council considered Approved ; a communication dated January 6, 1959 signed by Walter B. Mellott wherein it was requested that an extension of time of six months be approved in which to file the final map on the remaining 12.09 acres of tentative map, Tract 1645. The request of Mr. Mellott was approved by the City Council subject to a favorable recommendation of the Planning Commission. The Planning Commission approved the request of Mr. Mellott to extend the time for filing the final map of Tract 1645 for a period of 6 months. On January 15, 1959 by memorandum to the Planning Department, the City Clerk advised that Council Action on January 12, 1959 directed that the matter of Use Permit 338 and Variance 391 be referred to the Planning Commission and that a formal hearing be conducted to determine whether the permits should be revoked under Section 9106.4 of the Newport Beach Municipal Code. II I I 1 I After a discussion regarding this matter Commissioner Hayton moved that the Commission hold a public hearing on February 19, 1959 to determine whether or not the Use Permit and Variance should be revoked and that the Planning Director be requested to give written notice to the Permittee as provided by Section 9106.43 of the Municipal Code. Said motion was seconded by Commissioner Keene and carried.
