MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, JANUARY 17, 1952
' ROLL CALL: Commissioners Present: Briggs, Copelin, Longmoor, Pleger, Rudd, and
Wightman. Commissioners Absent: Ellerbroek, Reed, and Smith,
MINUTES: Commissioner Rudd asked that a correction be made in the, minutes of the
meeting of December 20th, The letter from the Lido Isle Community Association
was not protesting to the kbtual installation of the business there, but
stated that they objected only to launching ramp for public and called atten-
tion to having a fleet of forty boats and parking facilities for such thought
t,o be inadequate,. No other corrections. Commissioner Rudd moved, seconded by
Commission ^x Briggs that the minutes of the meeting of December 20� 1951 be
approved as corrected. Motion carried,
PUBLIC USE PTIRMITS.
HEARINIS Application of Clyde Hennell Company for "U" drive boat rental etc., at 3310
Via Lido, Newport Beach. This had been,set over from December meeting for
further consideration and to give the applicant time to submit corrected and
complete data on business to be carried on there. Chairman asked i£ these
papers were on hand at this time, but nothing had been submitted.
Secretary Copelin read a letter protesting to the granting of the application
from the Secretary of the Griffith Company - -also from Mrs. T. W. Taylor, pro -
testing. .Mr. Holloway, 218 Pearl Ave, Balboa Island, President of First
Church of Christ Scientist, was present and read their letter of protest which
had been sent to the Commission.
Commissioner Pleger made a m:)tion that the hearing be closed, seconded by
Commissioner Wightman and carried.
Chairman asked what action they wished to take and Com,aissioner Copelin made
a motion that, the application be DENIED, seconded by Commissoner Wightman
and carried by the following roll call vote, to-wit:
AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Ruddy and Wightman..
NOES: -None
ABSENT: Commissioners: Ellerbroek, Reed, and Smith.
Application of Foster - Kleiser Company for a Use Permit to erect an outdoor ad-
vertising structure on Lots 16 and 17, Blec4 160, River Section. Property
owned by Donald & Cecile Conover. This application had come in at 4:30 P.M.
and since the Commission hadn't had time to look it over or investigate, the
Chairman asked qtr, Larson, representative„ if it would be 'agreeable to lay the
matter over until the February meeting. Mr. Larson said it would be perfectly
alright. Chairman appointed Commissioners Copelin, Rudd, and Pleger a committee
to investigate the application and make a report at the next meeting.
VARIANCES:
Application of certain property owners for a change in the front yard setback
from twenty five (25) feet to twenty (20) feet on Lots 1 to 8 inc., in Block
637 of the Canal Section. (3700-02-04-06-08-10-12-14 Channel Place, Newport
Beach). Chairman Longmoor declared the hearing open and asked if anyone
wished to speak for or against.
Mrs. Wagner, 3711 Channel P1, Owns lots 1, 2, & 3 on the corner and wants to
build on the corner lot. Would be definite hardship if we had to abide by
setback.

Commissioner;:Copelin stated that similar cases had come before the Commission
and that a policy had been established that where an entire block came in on
Channel property that a request for a 20 foot setback be permitted. Some of
the lots had 30, 35 and 40 foot setbacks.
Commissioner Copelin moved the hearing be closed, seconded by Commissioner
Rudd and carried.
Commissioner Copelin then made a motion that the application be GRUTED,
seconded by Commissioner Wightman and carried by the following roll call vote,
to-wit:
AYES: Commissioners: Briggs,, Copelin, Longmoor, Rleger, Rudd, and Wightman.
NOES: None
ABSENT: Commissioners: Ellerbroek, Reed, and Smith.
APdENDIMITS:
First Hearing
Application of Arthur 0. Hovey and other property owners to amend the zoning
ordinance #635 of the City of Newport Beach so as to cause Lots 1 to 8 inc.,
in Block 329, CDM.and Block "D" of Acreage, CDM (that portion bounded by
Avocado and Carnation Avenues and Pacific and Bayside Drives, to be rezoned
from and R -1 to R -2 zone classification.
Chairman declared the hearing open and asked if anyone wished to speak for or
against.
Mr. Hovey, 1602 Pacific Dr spoke. Said that lots were so long - -some being
over 200' that they think they are entitled to the R=2.
Mrs. G. House, 1606 Pacific Dr. Speaking also for judge Westover and Ed Sea-
man and Mr. and Mrs. Weiss, would like the petitiongtanted.
Commissioner Pleger spoke of one main disadvantage to R -2 there is that Bay -
side Drive is so narrow, that an R -2 zone would only add to its congestion
there. They were now trying to figure out how to widen it.
Miss Hiebsch, 602 Narcissus, owner Lot 18, 181 16, Block 329. Bought property
with idea of building two units. Didn't know it wmld be changed. Feels in-
justice has been done.
Chairman stated that there was a lot of controversy in rezoning it but it was
rezoned on the basis of use at the time.
Commissioner Copelin brought up the matter of the legality of the application.
After getting an opinion from the planning consultant, they had decided that
the only legal application was that of Mr. Hovey's. The names attached didntt
mean a ti,.ing. The Chair suggested that each property owner fill out an appli-
cat;on andhave it notarized and submit to the Commission. One $25 filing fee
would be acceptable.
Commissioner Pleger made a- motion that this first hea-,ing be continued to the
February.meeting, seconded by Commissioner Rudd and carried.

Firsk Hearing on application of Nelson Stafford and other property owners to
amend the ordinance so as to cause Lots 1 to 12 inc., of Block 12, in Tract
' #27 be changed from their present zoning of R -1 to an R -2 classification.
Chairman declared the hearing open and asked if anyone wished to speak for or
against. No one rose. This application was also declared illegal and sep-
arate notarized applications would have to be filed.
Commissioner Pleger made a motion that the first hearing be continued to next .
regular meeting, seconded by Commissioner Wightman and carried.
SECOND HEARING on Resolution of Intention #486 regarding commercial incin- '
erators in the City. Chairman opened the hearing and asked if anyone wished
to speak for or against.
-Cox, 607 Cliff Dr, protests request because it impairs property value, health,
and beauty of area. Have enjoyed a recess for brief period from dirt, soot,
etc., which arose anytime of the day or night.
- -Dean Ward, 217 Santa Ana Ave, Nuisance, fire hazard. Any new incinerator,
_ regardless of type, will always be a nuisance. No room for incinerators in
City of Newport Beach. No incinerators d1lowed in the County. Costa Mesa
with two or three lumber companies does not have any incinerators. W. & H.
Lumber Cc is a major industry.
- -Walter Spicer, representing W & H lumber Co. Said incinerators in L. A.
are satisfactory. There are incinerators allowed in the County. Company
is on C- 1property. As such would be normally entitled to machinery necessary
' to conduct business. Very necessary adjunct..
- -Homer Mellott, Mgr. W & H Lumber Company. We tried to cooperate with people
involved in Heights. Very much concerned about inconvenience and did every-
thing we could. When complaints came out, made agreement that would not burn
incinerator during certain hours and did not fire until after Q:OD. Can be
operated without any mmenaas to surrounding community.
Commissioner Wightman moved the hearing be closed, seconded by Commissioner
Pleger and carried.
Commissioner Copelin then made a motion that the Commission recommend to the
City Council that they adopt a complete and separate ordinance to handle in-
cinerators and that incinerators not be handled under a Use Permit but on a
Conditional Permit and that the City Engineer and City Council be responsible
for any action taken on incinerators and that this body recommends to the
City Council that this program be adopted.
Motion seconded by Commissioner Wightman and carried by the following roll
call vote, to-wit:
AYES: Commissioners: Copelin, Longmoor, Pleger, Rudd, and Wightman.
NOES: Commissioner Briggs
ABSENT: Commissioners: Ellerbrokk, & -firth, and Reed.
Cpmmissioner Briggs stated that he thought the Commission was reversing their
' . policy. Did not and could not accommodate commercial incinerators. 'It is a
serious matter for us to reverse ourselves and change our opinion regarding a
matter which was established so recently and following thcnough study and
public hearings for several years.'

INFORMAL DISCUSSION:
Mrs. Ida hnrphy, owner of The Arches Motel, 224 Newport Blvd., appeared '
before the Commission with her problem. She had been informed t1v t the
Highway Department would be to ing over her property. for the Freeway.
Only salvation to continue in business would be to buy two lots in back.
Mr. Nelson was instructed to get a map and show area and houses there and
the proposed widening 6f the highway.
There being no further business to come beofre the Commission, Commissioner
Pleger made a motion for adjournment, seconded by Commissioner Rudd and
carried.
