THE NEWPORT BEACH CITY PLANNING COMMISSION met in regular
• session Wednesday, January 18, 1939 at T :30 P.m. in the
Council Chambers, City Hall; Chairman Hopkins Ir esiding.
Meeting called to order by the Chairman.

ROLL CALL -
Commiseioners present: Hopkins, Seeger, Briggs, Estus,
Patterson, Whitson.
Commissioners absent: Findlay, Hodgkinson, Williams
excused.
Building Inspector Nelson attended.
MINUTES -
Chairman called for the reading of the minutes of -
December 21, 1935•
Com. Whitson moved that the reading of the minutes of
December 21, 1939 be dispensed with, as all members had
received copies thereof, and that they be approved as
written. Seconded by Com. Estus. Motion carried and so
ordered by the Chairman.
REPORTS OF COMMITTEES -
Subdivision Ordinance Committee.
Com. Estue,chairman of this committee, reported that
the committee is going over the sample ordinance and will
have a report at the next meeting. He stated that the
sample ordinance is long and that the committee may be able
to out it down some.
Com. Seeger stated that the sample ordinance (San Diego'
County Ordinance) was went by request of the committee, IV
Mr. Tilton and in Mr. T11ton's opinion was one most suited
to the needs of a small city. This ordinance sets up a
working scheme for considering a subdivision map.
Chairman Hopkins stated that, although this commission
rarely has a subdivision map to consider, some plan should
be incorporated in an ordinance which will insure the use
working standards for every subdivision which comes before
the commission.
Committee of Tract 1011.
Com. Estus reported that the committee (Estus, Briggs,
$eager) had attended the meeting of the Orange County Planning
Commission held Dec. 28. The Orange County Planning Com-
mission had approved the tentative map of the Strobridge
subdivision (Tract 1011) with the provision that the Court y
Supervisors look into the sewage disposal situation.
Com. Seeger reported that the committee re- stated this
commission's objections to the subdivision as stated in the

written report, calling attention to the water supply,
sewage disposal lot areas, and drainage of proposed canals.
Mr. Strobridge had stated that he was not dependent upon
this city for water supply, Com. Seeger explained that
the tentative map had been approved and that a notation
had been ordered attached thereto calling attention to
the fact that sewage disposal had not been provided for.
Mr. Strobridge had suggested the use of septic tanks in
the subdivision and had presented a map showing; the location
Of some 140 septic tanks in use in the City of Bewport Beach.
Com. Estue was of the opinion that the health officer
would not approve the use of septic tanks in this area am
the drainage is unsatisfactory.
Com. Patterson moved that the Committee on Tract 1011
be discharged. Seconded by Com. Seeger.
Motion carried and so ordered.
It was the opinion ofthe commission that septic tanks::
in this district would not be satisfactory and would perhape
pollute the waters of the Bay.
Cosa. Bstue moved that the Secretary be instructed to
write a letter to the City Council informing them that
no provision had been made for sewage disposal in Tract 1011
and requesting them to bring the matter to the attention
of the County Supervisors. Seconded by Con. Seeger.
Motion carried and so ordered by the Chairman.
COMMUNICATIONS -
Secretary read a communication from the Orange County
Planning Commission acknowledging receipt of the "3 mile
zone" map; also enclosing a carbon copy of .their letter to
the Orange County Supervisors which accompanied the ten-
tative map of Tract 1011.
Com. Patterson moved that these communications be filed.
Seconded, by Com. Betue. Motion carried and so ordered by
the Chairman.
HEA rNGS :-
VAEIANCB APPLICATION OP CiAIB C. PYLE.
Secretary read'the application of Clair C. Pyle for
permit to make addition to a non- conforming element (garage)
on Lot 29, Blk 13, Sec 4, Balboa Island. He stated that
the hearing had been advertised, plans posted, postcard
notices sent to surrounding property owners and all other
.requirements of the ordinance complied with.'
Mr. Pyle was present and .explained that the proposed
addition is an apartment over the existing garage which
is non - conforming in that it.does not set 5 ft. from the
alley. He is requesting a rear yard setback variance so
that he will not have to make the addition set back 5 ft.
from the alley.
The application' was discussed by the commissioners.

It was their opinion that a variance was not necessary
since the building is on an alley and already exists
but that, since the building is non - conforming, a, special
permit must be granted to allow addition thereto.
Secretary stated that he had a telephoned protest
from Wilbur J. Lake, owner of Lot 5. Blk 13, Sec 4, object -
ing to the building of an apartment house adjacent to his
property.
Chairman ruled that this protest was not in order,
as the construction of an apartment house is not tinder
consideration at this time.
Com. Patterson moved adoption of Resolution NoPe151,
recommending to the City Council that a permit to /construct
and make addition to a non - conforming element located upon
Lot 29, Blk 13, Sec 4., Balboa Island be granted to Clair
C. Pyle and thattle same be transmitted to the City Council
by the Secretary and a copy filed as a part of the minutes
of this meeting.
Seconded by Com. Estus.

Noes: None.
Motion carried and so ordered by the Chairman.
APPLICATION OF PHILTON G. BALATON FOR REZONING AND VARIANCE
• Secretary read the application of Philton G. Balaton for
a 5 ft, 50% front yard setback variance on Lots 1,2,3, 4
and 5. Blk 5, Seashore Colony and also a re- classification -
of part of Lot 3 and all of Lots 4 and 5 from an H -3 to a
0-1 zone. He stated that the matter had been advertised,
but the plans had not been posted due to the fact that Mr.
Balaton had been delayed in getting them. The hearing had
been advertised previous to receipt of plans on assurance ,
of Mr. Balaton that he would have them in time to poet
same.
Chairman Hopkins ruled that no action could be taken
on this application since the plans had not been posted'
as required by Ordinance 440. He also ruled that the
application for rezoning was out of order, since `applica-
tion for rezoning must be made to the City Council and re-
ferred by them to the Planning Commission.
It was suggested by the Chairman that the matter might:
be expedited if 2 separate applications were made, one
for the variance and the other for rezoning.
It was the opinion of the commission that an additional
application fee should not be charged.
Cam. Patterson moved that this application for rezoning
be submitted to the City Council as prescribed by Ordinance
440. Seconded by Com. Estus.
Motion: carried and so ordered by the Chairman.

GOOD OF THE CITY -
Chairman Hopkins suggested that this commission
should begin some corrective work. It is evident from
the number of applications received for rezoning from the.
• West end of Newport that this section should be studied
and if it is thought necessary, a business district should
be created in this district. We are called upon to grant
these requests without having given the problem as a whole
any consideration and without proper planning for the future-
good of the City. If our ordinance is becoming obsolete
it is because we allow it to become so. It must be changed
to keep pace with the City's growth.
Another problem which the commission should study is
the width of alleys and the possibility of securing easements
from property owners to round off entrances to these albs.`.
Now is the time to work on these problems before the property
is built up. He referred specifically to alleys on the
Peninsula.
Come. Patterson and Whitson stated that procuring
easements for widening alleys had been attempted at differ-
ent times with little success.
The Commission was of the opinion that study should be
given these problems.
