AT 7:30.P.M.- IN THE COUNCIL CHAMBER OF THE NEWPORT BEACH CITY HALL
ROLL CALL: Commissioners Present: Copelin, Ellerbroek, Longmoor, Rudd and Wight-
man. Commissioners Absent: Daniell, Johnson, Pleger, and Smith.
MINUTES: Commissioner Rudd moved and Commissioner Copelin seconded his motion '
that the minutes of the meeting of December 15, 1949, be approved as sub-
mitted to the Commission. Motion carried.
PUBLIC
HEARINGS: Variance: Application of R. E. Bernasconi for a variance on Lots 7 and
8 (All Ex'Nly 96') Block 34, Re -Sub of Corona del Mar (1118 Ocean Boule-
vard) so that they may be allowed a reduction from 20 to 10 feet in the
setback on Ocean Boulevard, and a reduction from.10 to'5 feet back yard
adjacent to the Northerly boundry. Chairman Longmoor declared the hearing
open and asked if anyone wished to speak for or against the granting of
the application. Mr. Rudd, who was on the investigating committeg, sug-
gested that the application be granted. Commissioner Copelin moved the
hearing be closed and Commissioner Ellerbroek seconded the.motion. Motion
carried. Commissioner Copelin then moved that the application be granted.
Commissioner Rudd seconded.the motion and was passed by the following roll -
call vote, to-wit: AYES: Commissioners Copelin, Ellerbroek, Longmoor,
Rudd, Wightman. NOES: None ABSENT: Daniell, Johnson, Pleger, &
Smith.
Variance: Application of Howard A. Neighbor for a variance on Lot 16,
Block 4, Section 5, Balboa Island (123 East Bay Front) so that he may extend
a portion of the building 18 inches from the North property line. The
Chairman declared the hearing open and asked if anyone wished to speak in
regard to it. The applicaht was not present. The Chairman then asked for '
the committee's recommendation on the application, and Commissioner Eller-
broek said that both he and Mr. Rudd hesitated about encroaching upon the
side yard and felt that the application for a variance should not be granted.
He also stated that the house was non- conforming now. Mr. Nelson, the
Building Inspector, agreed with the recommendation. Commissioner Copelin
made a motion that the hearing be closed, seconded by Commissioner Ellerbroek,
and carried. Commissioner Ellerbroek then moved and Commissioner Rudd
seconded his motion that the application be denied.. Carried by the following
roll -call vote, to -wit: AYES: Commissioners Copelin, Ellerbroek, Longmoor,
Rudd, and Wightman. NOES: None ABSENT: Daniell, Johnson, Pleger, Smith.
Variance: Chairman Longmoor declared the hearing open on the third variance
application of Franklin D. Windle on Lot 2, Block 433, Canal Section (409
Clubhouse Avenue) for a 50% front yard variance and asked if anyone wished
to speak for or against it. Mr. Windle was present and said that he would be
happy to answer any questions regarding the application. Commissioner Cope -
lin said that it was one of those things that come, up along the Channel
Front where the setbacks have been made at 30, 40, and 45 feet; ,and, there-
fore, deny the property owners the right of their property. He said.that he
and Mr. Nelson had investigated it, and could see na reason why it 'should not
be granted. He said the Committee recommends the granting of the application
and made a motion that the hearing be closed. Commissioner. Ellerbroek sec-
onded the motion and was carried. Commissioner Copelin then moved that the
application be approved. Commissioner Ellerbroek seconded the motion and it
was carried by the following roll -call vote, to -wit: AYES: Commissioners '
Copelin, Ellerbroek, Longmoor, Rudd, Wightman. NOES, None ABSENT: Dani-
ell, Johnson, Pleger, and Smith.

Variance: Chairman declared the hearing open on the application of Howard F.
Legg for a variance on Lot 34, Block S., Tract 673, Corona del Mar, (510 Hazel
Drive) so that he may be allowed a setback of three instead of five feet on a
proposed addition to his house. Mr. Legg was present to answer any questions.
The committee's recommendation was for its approval. Commissioner. Wightman
made a motion that the hearing be closed, seconded by Commissioner Copelin
and carried. Commissioner Rudd then moved that the application be granted,
seconded by Commissioner Ellerbroek and carried by the following roll: =call
vote, to-wit: AYES: Commissioners Copelin, Ellerbroek, Longmoor, Rudd,
& Wightman. NOES: None ABSENT: Daniell, Johnson, Pleger, and Smith.
OLD The application of Keith 0. Burnham for a laundryette at 111 Agate Avenue,
BUSINESS: Balboa Island, which was set over ffom the December 15, 1949 meeting for
further study, was then brought before the Commission. Mr. Burnham had also
been requested to file a copy of the lease on the parking lot and archi-
tect's drawings showing a Bide entrance off the parking lot with the Commis-
sion, but no papers had been received by the Commission.
Therefore, Commissioner Rudd moved that the application again be set over to
the February 16th. meeting. Commissioner Copelin seconded his motion and it
was carried.
COMHUNI- Chairman Longmoor read the letters and petitions regarding:- (1) A. W. La-
CATIONS: Shelle petition for reclassification and change of.zoning from R -3 to C -1 of
Lot 1, Tract 1080, Newport Beach, (2) owners of lots 1 to 6 inclusive, Block
20, First Addition to Newport Beach, for vacation by the city of that por=
tion of land lying between the property line of the lots and the Ocean front
' sidewalk. Commissioner Wightman moved and Commissioner Ellerbroek seconded
the motion that this matter be referred to the planning consultants for
further recommendation and consideration with the Master Plan. .Motion was
carried. Commissioner Ellerbroek made a motion that the Secretary write a
letter to the City Council advising them of their disposition in the matter.
Commissioner Wightman, seconded the motion, and carried.
NEW New recommendation on zoning on Balboa Coves. ,Chairman Longmoor explained
BUSINESS: that Balboa Coves was now zoned as R -1, and that the Council was drafting a
resolution to change the property to C -1 upon a former recommendation of the
.Planning Commission, but the planning consultants felt it would be unwise
now to make it C-1 property. The Chairman asked the Commission what they .
wished to do about it. Commissioner Ellerbroek made a motion, seconded by
Oommissioner Wightman, that the Chairman write a letter to the City Council
making their recommendations and suggesting that the Council defer action
on the matter at the present time as the tract in question was the object
of further study in connection with the zoning plan. Motion carried.
ADJOURN- There being no further business, Chairman Longmoor said he would entertain
MENT: a motionfor adjournment. Commissioner Copelin made the motion to adjourn
and Commissioner Wightman seconded the motion. Motion carried.
