A variance to the Zoning Code is also requested so as to waive a portion of the required off-street. parking space! for said restaurant use. Zone: C -1 Applicant: Hassan Hassan, La Habra Owners: John P. Myers and Maxine Myers, Los Angeles Public hearing was opened in connection with thi! matter. Burt Ward, Attorney, appeared before the Commiss- on behalf of the applicant and commented on the operation of the business as it was originally established and subsequently changed. He concur) with the requirement for 23 parking spaces to be provided under the in -lieu parking fee requiremer but requested that the 1977 fee be waived becaus( the restaurant portion of the business was not established until after June, 1977, and the addi- tional fee would create a hardship on the applicant. Hassan Hassan, applicant, appeared before the Commission and answered questions regarding the peak hours and type of operation which he advise( was 50% walk -in and take -out. Community Development Director Hogan advised of e letter received from Louise S. and Loren Greeley in opposition to approving more facilities which serve alcoholic beverages. The letter pertained both to this request and the next item on the agenda, Use Permit No. 1853. Motion X Motion was made that Planning Commission make th following findings: 1. That the proposed use is consistent with the Land Use Element of the General Plan and is compatible with surrounding land uses. 2. The project will not have any significant environmental impact, providing that parking demands are met. A Municipal lot is located across Newport Boulevard from the site and will be useful to the restaurant - delicatesse use at all times. Furthermore, adequate offstreet parking spaces are provided on the subject property during evening hours and on weekends when the office uses on the site ar closed. 3. The Police Department has indicated that the do not contemplate any problems. 4. The approval of Use Permit No. 1852 will not under the circumstances of this case be detr mental to the health, safety, peace, morals, comfort and general welfare of persons resid and working in the neighborhood or be detri- mental or injurious to property or improveme in the neighborhood or the general welfare o the City. and approve Use Permit No. 1852, subject to the following conditions: 1. That development shall be in substantial conformance with the approved plot plan, floor plan and elevations. 2. All trash or storage shall be located within the building or be shielded from view by six foot high walls or fences. 3. That all mechanical roof -top equipment shall be screened in a manner meeting the approval • of the Department of Community Development. Page 5. That there shall be not less than 16 transfe able parking permits purchased from the City on an annual basis in the adjacent Municipal parking lot for the development. Said requi ment for the in -lieu parking fee shall be waived at a later date if an offsite parking agreement for the required parking spaces is approved by the Planning Commission and the City Council. 5. That this approval shall be for a period of years, and any extension shall be acted upon the Modifications .Committee. Commissioner Balalis commented on the operation the business and availability of parking during the evening hours. He felt that the requirement for transferable parking permits should be reduc to 8 since there was ample unused parking in the Municipal Lot across the street and excessive in• lieu fees would create a hardship on this small business operation. Motion X Following discussion of the circumstances surroui ing this particular case and the findings which must be made to justify granting a variance waiv, a portion of the required parking, the above mot was amended to provide that Conditions No. 4 and read as follows: 4. That there shall be not less than 8 transfer• able parking permits purchased from the City on an annual basis in the adjacent Municipal parking lot for the development. Said requii ment for the in -lieu parking fee shall be waived.at a later date if an offsite parking agreement for the required parking spaces is approved by the Planning Commission and the City Council. Further that this shall be a reduction of 5 spaces from the 13 spaces tha would normally be required at a ratio of one space for each 50 square feet of net public area. 5. That this approval shall be for a period of one year, and any extension shall be acted upon by the Modifications Committee. Page 6. Absent X In connection with the granting of a variance to the parking requirements, Planning Commission ma the following findings: 1. That there are exceptional or extraordinary circumstances applying to the use of the property in that approximately 50% of the applicant's business is of a walk -in nature which does not require parking. 2. That the granting of the reduction in parkin(. • is necessary for the preservation and enjoy - men.t of the property rights of the applicant in that said business caters substantially to a local clientele and does not require a large number of parking spaces. Said busine! could not afford to operate in this location if additional parking were required. 3. That the granting of the reduction in parkin will not, under the circumstances of the particular case, be detrimental or injurious to the neighborhood in that there are suffi- cient parking spaces in the City Hall parkin(. lot after the hour of 5:00 P.M. when the business is operating at its peak and patron! requiring a parking space will not have to park in the adjoining residential areas. City of Newport Beach January 19, 1978 ROLL CALL Request to remodel the existing Pieloon Restaurai facility and change the operational characterist of said restaurant use to include the service of on -sale alcoholic beverages. Location: Lots 3 through 8, Block 431, Lancaster's Addition to Newport Beach, located at 3110 Newport Boulevard, on the northeasterly corner of Newport Boulevard and 31st Street in Central Newport. Zone: C -1 Applicant: Hershy's Restaurant (Ebb Tide Foo Newport Beach Owner: The Deutsch Co., Los Angeles Community Development Director Hogan reviewed a change in staff's recommended condition No. 2 relative to parking which would provide that the requirement for 1 space for each 40 square feet net public area could be amended if the operatio characteristics were changed to provide for beer and wine only. Public hearing was opened in connection with thi matter. Hirsh McMullen, resident of Park Newport, applic appeared before the Commission and requested tha the use permit be approved as submitted which wo include the full scale alcoholic beverage operat He answered questions of the Commission relative to the proposed operation, addition of a bar, reduction in the amount of net public area, and rearrangement in the number of tables which was not increased. Commissioner Balalis commented on the proposed operation of the restaurant and felt it would no intensify the use but would merely provide the ability to serve cocktails along with food in a restaurant whose use was primarily an eating establishment. Although the number of seats has been increa from 66 seats to 75 seats (including 7 seats at the bar), the "net public area" is.being decreased from 1,418 sq. ft. ± to 1,358 sq.f . . Furthermore, the existing pie sales use in t building will be removed. 5. Adequate parking spaces exist on the site fo the existing and proposed development. The service of alcoholic beverages will have no significant impact on the parking demand. 6. The approval of Use Permit No. 1853 will not under the circumstances of this case be detr mental to the health, safety, peace, morals, comfort and general welfare of persons resid ing and working in the neighborhood or be detrimental or injurious to property or improvements in the neighborhood or the gene welfare of the City. and approve Use Permit No. 1853, subject to the following conditions: 1. Staff also reviewed a requi for possible changes in the general office floor area in Koll Center Newport. Eric Welton, 2845 East Coast Highway, appeared before the Commission in connection with 78 -1 -B and answered questions relative to the proposal.
