All Ayes 0 Motion All Ayes • MINUTES INDEX was asked for his consent to continue this matter to the meeting of February 15, 1973, pending a decision on the appeal. He felt there were different circumstances connected to this request as opposed to the matter now under appeal and requested that the'matter be heard, but would be willing to have the Commission consider rezoning to R -1.5. Mr. Smith was advised that in order to consider R -1.5, the matter would have to be re- advertised, to which he then consented to a continuance and readvertisement. Following discussion, Planning Commission continued this matter to the meeting of February 15, 1973 and requested the staff to readvertise the matter to cover the R -1.5 District in order that either District could be considered. Item #B5 Request to amend a portion of Districting Map No. 11 from a C -1 District to an R -2 District. AMEND - MENT Location: Lots 9, 10, 11, 12, 13, and 14, N 'U—56 Block 6, Balboa Tract, located at CONT. Item #B7 Proposal to amend Section 20.08.190 of the Newport AMEND - Beach Municipal Code, Automobile Storage or Parking MENT Space, to require two garage spaces for each NO. 358 single - family dwelling. APPROVED Initiated by: The City of Newport Beach Following a brief review of the proposed amendment to the ordinance, public hearing was opened. There being none desiring to appear and be heard, the public hearing was closed. Zone: C -O -Z Applicant: Giles Svehlek, Newport Beach Owner: Same as Applicant Assistant Community Development Director Hewicker briefly reviewed the staff report with the Plan- ning Commission and answered questions regarding valet parking. Planning Commission discussed valet parking, occupancy loads, and off -site parking agreements. Mike Hallenin, representative of the applicant, appeared before the Planning Commission to answer questions relative to the request. He stated concurrence with the recommended conditions as written in the staff report and had no objections to an entrance sign being required advising those customers who wished to park their own cars where additional parking was located. Dick Wandrock of the Ancient Mariner appeared before the Planning Commission to advise them of past problems relative to "Dry Dock" customers and employees parking in their lot, cars hitting their fence and the probable need for wheel stops. Mike Hallenin again appeared before the Planning Commission and stated the new owners were not aware of the problems as stated by Mr. Wandrock and was sure they would be willing to resolve any conflicts relative to the parking, the fence and had no objections to any wheel stop requirements. He also stated that the name of the new restaurant would be the Monterey Still. Page 6. That the operation of the restaurant Monday through Friday shall be limited to the hours between 4:00 P.M. and 2:00 A.M. 2. That the hours of operation may be adjusted by the Director of Community Development upon submittal of satisfactory evidence as required by Section 20.38.040 of the Municipal Code. 3. That a valet service shall be provided during all hours of operation. 4. That satisfactory restraints shall be provided to keep automobiles on the property as deter- mined by the Community Development Department. . 5. That a diagram shall be provided at the entranc of the restaurant showing the location of the off -site parking for the benefit of the customers. 6. That a satisfactory off -site parking agreement shall be executed. ADDITIONAL BUSINESS Motion X Planning Commission adopted Resolution No. 789 Item #10 All Ayes setting a public hearing for February 15, 1973, to consider the adoption of Residential Growth. Limits Component of the Newport Beach General Plan. Motion X Planning Commission adopted Resolution No. 790 Item #11 Ayes X X X X X setting a public hearing for March 1, 1973, to Abstain X consider rezoning the Balboa Peninsula to R -1 and Absent X R -1.5 Districts. Commissioner Martin stepped down and refrained from discussion and voting on this item. Motion X Planning Commission adopted Resolution No. 791 Item #12 All Ayes setting a public hearing for a special meeting on March 22, 1973, to consider rezoning Corona del Mar from R -2, R -3, and R -4 Districts to an R -1.5 District. Advance Planning Administrator Gunn appeared before the Planning Commission and reviewed the boundaries proposed as indicated on a wall map which basically followsthe first public street behind the bluff line on top of the plateau. Planning Commission discussed the various exclusion areas within the proposed boundaries. Motion X Following discussion, motion was made to recommend Ayes X X X X X to the City Council that the boundaries as discusse Noes X be approved as the boundaries for the Coastal Absent X Conservation Zone. Motion X In connection with recommended exclusion areas, Item #14 motion was made that the areas consisting of Newport Shores, Lido Isle, Peninsula Point, Bay- shores and Park Newport be included as the residen- tial areas subject to exclusion. Motion X Following discussion relative to residential Ayes X X X exclusion areas, a substitute motion was made Noes X X X that within the proposed boundaries as previously Absent X recommended, there be no exclusions. Motion failed due to a lack of majority votes. Motion X Another substitute motion was made that the staff Ayes X X X X be directed to prepare a recommendation to the Noes X X City Council providing residential exclusion areas Absent X which were consistent with Proposition 20. Since the motion carried, there was no need to vote on the original motion as made by Commissioner Glass. Motion X Planning Commission discussed commercial exclusion All Ayes areas within the proposed boundaries after which motion was made that no commercial areas be excluded. Motion X Planning Commission adopted Resolution No. 792 Item #15 All Ayes setting a public hearing for March 15, 1973, to consider adoption of the Land Use Element of the General Plan. Page 8. Commissioner Agee requested and received permission to be excused from the next four regular meetings. Commissioner Glass requested and received permission to be excused from the meeting of February 15, 1973. There being no further business, Planning Commission adjourned at 10:00 P.M. JAC ELINE E.
