Beach met in session at 7:45 P. M., February 2, 1928s,
at the Newport Harbor Yacht Club.
Members present: Briggs, Pensions Sloan, West and
Williamson.
Members of tha Los Angeles Planning Commission
ppresent: Whitnall, McNitt and Doctor
Aronovici.
L. W. Briggs was nominated by Eugene
Pension to be president of this,Commtssion second -
ed by Harry Sloan and elected by acclamation,
Attorney Franklin West explained the
1927 Act covering the activities of the Planning
Commission.23r. IbNitt stated that we should operate
under the new law.
Messrs MCNitt Whitnall and West agreed
that the duties of the Piannin g Commission and a
Park Commission being practically identical, that
the duties of a'Park Commission be assigned to the
• Planning Commission.of this City.

President that he could secure base maps of the
City from the City Engineer.
The President requested that qtr. Whitnall
make a study of the entrances to the city in con -
ference with Mr. Cortelyou, State Engineer, and
report as soon as possible.

President Briggs stated thLt this area
is looked upon as a recreational and pleasure center
and not as a commercial port. Eugene Fenelon support -
this statement quoting the, Harbor Board of which he
is a member. Sloan and Williamson believed that
commercial development would follow in due time.

ment on their property outside the city kimits.

The 'Planning Commission of the City of Newport Beach met
in session at 7 :45 P.M. Sarah 1, 1928, at the Newport Beach
City Hall.
Members present: Briggs, Fettelon, Sloan, Williamson, Greeley,
Dr. Riohter, City Attorney West.
Members of the Los Angeles Planning Commission present; McNitt
and Whitnall.
Minutes of the meeting of February 2 were approved as read.
Several communications regarding information requested by Mr.
Whitnall were referred to him.
A letter from Walter S. Hilborn, representing Mr, and Mrs.
King C. Gillette, regarding the renting from the city of
the triangular parcel of land adjoining their property on the
peninsula, was read. A map of Tract $518; was studied
and Mr. Hilburn explained that the parcel in question would
be used for yard purposes only.
Mr. MoNitt suggested that in all cases where application for
lease is made, the applicant should specify the exact use for
which the property is intended.
Mr. Whitnall added that in addition to stating the exact use
of the property, the applicant should give the exact location
and description of the property in his application. He
suggested the consideration of two matters - (1) The policy
of the city of Newport Beach in leasing lands. (2) Consider
whether the land in question is necessary in carrying out the
plans of the zoning commission.
Motion by Mr. Williamson, seconded by Mr. Sloan and carried:
That the recommendation of the Planning Commission to the City
Council be that it would be impossible at this time to make
an affirmative answer to the request of Mr, and Mrs. Gillette
as the zoning experts are not able, at this time, to determine
whether the land in question might be needed for other pur-
poses; that the matter be left open until the zoning experts
make their final report.

Letter from C. G. Rodger in regard to the le in five
hundred feet of tide land on the upper��ia "�n�s fiad. Due
to illness of Mr, Rodger, Mr. Cubbon appeared for him and
explained the proposed plans.
The City Attorney explained that the tidelands can be leased
for purposes of navigation and commerce only. That any
lease or alienation of tidelands would have to be with the
proviso that the property would be leased for a maximum of
25 years, That the land or buildings thereon be not used
for any purpose that would be an obstruction to navigation.
After considerable discussion motion was made by Mr. Sloan,
seconded by Mr. Greeley and carried, as follows: That the
proposal of Mr. Rodger be favorably considered by the City
Council, subject to the approval of the Planning Commission
and the Zoning Commission, and provided that the City Council
can deliver the lease.
It was the concensus of opinion that when the tidelands
question is settled arrangements be made for leasing lands
for industries that will be mutually beneficial, if and when
it is determined what the city has to offer.
.Application from Frank L. Matthews for leasing a piece of land
at the end of Fourth Street, on Bay Ave. for a boat selling
headquarters. Mr. Matthews explained the proposal in
detail.
Following motion made by Mr. Sloan, seconded by Dr. Richter
and carried: That Mr. Matthews be permitted to construct
his building on the land referred to,(measurement of land.
being 16 feet by 25 feet,)subjeot to the present zoning ordi
ranee; subject to the building inspector; subject to arbitrary
revocation by the City Council at any time.
on discussion of this mtion it was brought out that it would
be very inconsistent to recommend any action on this matter
until the tidelands suit is settled and until the zoning ex-
perts have completed their report - and the motion was abro-
gated by Mr, Sloan, seconded by Dr. Richter and carried, as -
follows: That the motion just made in regard to Mr. Matthew's
application be recinded, and that a recommendation similar to
the one on the Gillette matter be made.
Communication in regard to application for abandonment of
•Bay Ave; from F to L Sto was read and Mr, Gibbs explained the
matter to the Planning Commission and the Zoning Commissioners
present.

Mr. Greeley and carried: That the Planning Commission
Instruct Mr, Whitnall and his associates to consult with
City Engineer Sressly in the matter of the proposed
abandonment of Bay Ave. from P to L Streets and to make
a detailed report to the Planning Commission at an early
date.

Gentlemen:
Herewith report of the Planning Commission on
the four applications referred to us by the -City
Council.
In the matter of Mr. Hiiborn's application in
behalf of Mr. and Mrs. Gillette to lease a
triangular parcel of around lying Southerly of
Lots 1 and 2, in Block "P ", of Tract 1518: We
find it impossible at this time to make an
affirmative recommendation as Mr. Plhitnall and
his associates have not proceeded far enough
with the basic physical plan of the entire City
to determine whether the land in question might
be needed for other purposes. ti,e further recon
mend that the matter be left open-Until the
zoning experts have filed their final report.
`ve are of the same opinion in the matter of the
application by Frank L. Matthews to lease for

five years :a parcel of land approximately sixteen
feet by twenty -five feet at the Northerly end of
the West half of 4th Street. We further recommend
that the Matthews application be left open until
the ownership of the land in question is decided
either by Decree of the Superior Court of Orange
County upon completion of the Tide Land Suit now
before said Court or by some other means.
In the matter of the application to lease 500
feet of frontage on the County Channel considerable
discussion was had." A ruling was requested from
the City Attorney as to the Constitutional uses
for which City owned Tide Lands can be leased.
It was,noted that there was no definite descrip-
tion of the location of the land sought to be
leased„ which should be known, as portions of
City owned Channel Frontage in this district
might be classed as Tide Lands and portions as
Uplands. Our recommendation is that 14r. Rodger 's
application; be favorably considered by the City
Council subject to the approval of the Planning
and Zoning Commission upon the proviso that the
City Council can legally deliver the lease.
It was the concensus,of opinion of the Planning
Commission that after the Tide Land question is
settled the City Plan should include arrangements
for leasing some portions of City owned lands
for industrial purposes that will be mutually
beneficial if and when it is determined what the
City has to offer.
In the matter of the application for the Abandon-
ment of Bay Avenue from "F" to "L" Streets, the
following action was taken by the Planning
Commission: I,r. Whitnall and his associates
were instructed to consult with City Entineer
Kressly and to secure from him all necessary
data required in the compiling of a detailed
report to be made to the Planning Commission at
an early date.
As there is considerable detail to be studied in
connection with this request we will require

sufficient time for this report to come in
_before making our definite recommendation.
