FEBRUARY 15, 1939
THE NEWPORT BEACH CITY PLANNING COMMISSION met in regular
session Wednesday, February 15, 1939 at 7:30 p.m, in.the-
• Council Chambers of the City Hall; Chairman Hopkins pre-
siding.

Meeting called to order by the Chairman
ROLL CALL -
Commissioners present: Hopkins, $eager, Briggs. Williams,..
Patterson.
Commissioners absent: Estus, Whitson, Findlay,
Hodgkinson.
MINUTES -
Chairman asked the pleasure of the commission regarding
minutes of the meeting held January 18, 1939•
Com. Patterson moved that the reading of the minutes
of the regular meeting held January 18, 1939 be dispensed
with, as all members had received copies thereof, and that
they be approved as written. Seconded by Com. Briggs.
Motion carried and so ordered.
REPORTS OF COMMITTEES -
Subdivision Ordinance Committee
In the absence of the chairman ofthis committee, Coma
Patterson reported for the committee. He stated that the
Orange County Planning Commission is preparing a new ordin-
ance for adoption by the County and that it was the opinion ,
of the committee that any ordinance adopted by Newport Beach
should conform to the Orange County Ordinance; therefore,
the committee is waiting until this ordinance is complete
and then they will secure a copy by which to pattern the
ordinance for this City.
Chairman Hopkins accepted tkis report as a progress
report.
HEARINGS: -
VARIANCE APPLICATION OF RELEN R. RUNTER
Application of Helen R. Hunter for a 50%, 5 ft. front`
yard setback variance on Lot 8, Bik 1, Section 1, Balboa
Island was read by the Secretary. He stated that the
hearing had been advertised, plans posted and postcard
notices sent to 11 surrounding property owners, represent-
ing 20 lots in the vicinity, and that all other requiremeate
of the ordinance had been complied with. Re also stated
that no verbal or written protests had been received
unless there are some present here tonight; whereupon, Mr.
Batch, representing the Bartholomas Oil Corporation pre-
sented a written protest which was read by the Secretary.
Plans for the proposed building and plot plan were ex.
amined by the members of the commission and discussed.
Com. Patterson stated that under the ordinance the
commission is permitted to grant 50% front yard variances`
and in his opinion this was a just request and would not be
Injurious to adjoining properties.
Com. Seeger said that it has been the policy of this
commission to grant 50% front yard variances on the Bay
Front.
Com. Patterson moved the adoption of Resolution Ho.
152 recommending that a 50%, 5 ft. front yard setback
variance be granted to Helen H. Hunter on Lot g, Blk 1,
Sec 1, Balboa Island and that the same be transmitted to
the City Council by the Secretary as the recommendation
of this commission and a copy filed as part of theminutes
of this meeting.Seconded by Com. Seeger.
Discussion:
Chairman Hopkins pointed out the fact 'that, if the owner
Of this lot is to enjoy the full benefit of her property,
this variance is necessary, because of the unusual shape
and size of the lot. The plans show the rooms to be not
any too large or numerous and because of the existing,
building on the rear of the property, if she is required
to keep the 10 ft. setback, the size of the rooms will
have to be cut down. He also drew the attention of the
commission to the fact that the health of the neighbors or
occupants will in no be harmed by a reduction of the
• setback to the limits of the request since the exposure
Involved is an unlimited exposure.
Mr. Hatch, speaking for the Bartholomse oil Corporation,
stated thatthe letter of protest which he presented is
self- eaplanitory and stated their reasons for protesting.
He stated that it is the contention of the protestant that
no variances to the ordinance should be granted, as such -
variances injure adjoining properties.
Com. Seeger stated that, from his view- point, little
consideration should be given this protest, as the protest -
ant was the first one in the block to build closer than
10 ft. to the front property line, his house having approx-
imately a 3 ft, front setback. Com. Seager explained that
due to the carve in the street at this point, each house
is independent of its neighbor and as the adjoining property
owner, he has no objection to the granting of this variance.
Com, Briggs stated that houses on the water front do
not have to keep the setback to insure sufficient Tight
and ventilation to neighboring houses. In his opinion the
variance should be granted.

protest from Mr. Charles 0. Butcher, owner of Lots 14 & 15,
Elk 4, across the street on Walnut.
It was Attny. Thompson's opinion that Mr. Balaton is
asking for a variance on property to build a non- conforming
use.
Chairman Hopkins explained that they are planning to
construct only half of the court now. If granted this
variance he will proceed with construction on Late 3 & 4
which are now C-1.
Mr. Thompson stated that the plans for an auto court
must be approved by the commission. If a variance is ap-
proved, you are approving the tentative plans.
Mr. Balaton explained that the plane had been change&;
since they were submitted with the application. The number
of units has been changed to 3. There will be only one
cabin on Lot 5.
The Chairman instructed Mr. Balaton to submit a corrected
drawing to the Secretary for filing with the application:,
also that he submit for approval by the Commission his plans
for the court at the next meeting.
It was the opinion of the commission that no action
should be taken on the variances applied for on Lot '5 until
the application for re- zoning of the lot is heard and action
taken thereon.
Com. Patterson moved the adoption of Resolution No. 153,'`
recommending that a 50¢, 5 ft, front yard setback variance
be granted to P. G.- Balaton on 1/2 of Lot 3 and all of
Lot 4, Elk 5, Seashore Colony, and that the same be' trans-
mitted to the City Council by the Secretary as the recom-
mendation of this commission and a copy filed as a part of
the minutes of this meeting. Seconded by Com. Williams.

Motion carried and so ordered by the Chairman.
REZONING APPLICATION OF P. G. BALATON
Secretary read the application of P. G. Balaton for
rezoning of Lot 5, Elk 5, Seashore Colony from R -3 to C-1
classification which was referred to the Planning Commission
by the City Council.
Com. Briggs moved that this application be sent to hear-
ing, first hearing to be held Feb. 24, 7:30 p.m. and
second boaring to be held Mar. 6, 7 :00 p.m, in the Council
Chambers of the City Hall. Seconded by Com. Patterson.

Chairman Hopkins instructed the Secretary to advertise
the hearings for the above dates.
COMMUNICATION TO CITY COUNCIL - RE: TRACT 1011.
Secretary read the communication to the City Council
ordered at the last meeting in reference to the Strobridge
subdivision known as Tract 1011. and calling the Council's
attention to the fact that the Planning Commission objected
to some of the features of this subdivision principally
the sewer conditions.
Com. Patterson moved that this report be accepted and
filed. Seconded by Com. Briggs.
Motion carried and so ordered.
ADJOURNMENT -
On motion of Com. Briggs, seconded by Com.Patterson
and carried the meeting adjourned to February 24, 1939.
