Motion was made that Planning Commission make the
following findings:

ordinances of the Ci.ty, all applicable general
or specific plans and the Planning Commission
is satisfied with the plan of subdivision.

refrained from deliberation on this matter becau

The report from the Grading Engineer relative to
the geological report received. at the previous
hearing was distributed to the Planning Commissi
for review. Staff also advised of the possible
need for an environmental report in connection
with this request should the Planning Commission
make the finding that the requirements for a
variance had been met.

Gordon Glass, Architect, appeared before the
Commission in connection with this matter and
distributed a drawing which indicated the proble
involved in the development of the site because
of the topography.
Al Stover, 2316 Pacific Drive, appeared before t
Commission and reiterated the objections express
at the previous public hearing and felt that
approval of this request would set a precedent f
future development on the bluff.

Roger McKinnon, Applicant, 3207 Ocean Boulevard,
appeared before the Commission and introduced
Robert Altivers, architect, who gave a slide
presentation in connection with the proposal.
He commented on the goal to upgrade the dwelling
and make it more compatible with that of the
Newport Beach area. Mr. Altivers also projected
the floor plan on the screen and reviewed the
new construction and alterations proposed, inclu
ing the areas in question which would exceed the
height limit placed on the property when the
structure was remodeled in 1957 under Variance
No. 420.
Tom Atkinson, 3225 Ocean Boulevard, appeared
before the Commission in favor of the request as
he felt it would upgrade the neighborhood and
that any loss of view would be very minimal.
Ed Maloney, 3200 Ocean Boulevard, appeared befor
the Commission in opposition to the request and
.
presented pictures showing the views which would
be lost if the increased height were allowed. H
also presented a petition with 61 signatures in
opposition to any construction above the curb li
which could set a precedent.
Dr. McNalley, 3228 Ocean Boulevard, appeared bef
the Commission in opposition to any modification
the existing structure which would add to the
obstruction of views.
Mrs. Michael McNalley, 3228 Ocean Boulevard,
appeared before the Commission to comment on the
view along Ocean Boulevard and opposed any addi-
tional construction which would increase the
existing view obstruction created by the garage
and trees.
Roger McKinnon appeared before the Commission in
response to the concerns expressed and commented
on the need for a safer entryway located adjacen
to the garage which has partially obstructed the
view for 40 years.
There being no others desiring to appear and be
heard, the public hearing was closed.
Commissioner Frederickson concurred with the nee

MINUTES
Commissioner Haidinger questioned the other non-
conforming features of this request and staff
advised that should the modification request be
denied,. the applicant would have to submit a new
application for the interior alterations because
of the existing nonconforming features. Staff
further commented on the setback encroachments and
parking which were felt to be minor in nature and
pointed out that the Commission could approve the
modification with the provision that the height
of the structure not be increased.
Commissioner Hummel concurred that the parking
and setback encroachments were not objectionable
but did not feel that the height of the structure
should be increased beyond that which presently,
exists..
Motion was made that Planning Commission deny
Modification No. 2188, based on the following
findings:
That the proposal, as submitted, would elimi-
nate views of the harbor jetty from the. public
walk along either side of Ocean Boulevard.
2. That the denial of the request, as submitted,
will not deprive the applicant of a reasonable
use of his property.
That the granting of the request would be
detrimental to the enjoyment, peace and
comfort of persons who use the public walks
in the area and would not be consistent with
the legislative intent of the Municipal Code.
Commissioner Balalis felt tt would be better to
approve the request with the condition that the
height not be increased and eliminate the need to
submit a new application, pay another fee, send
out public notices, and hold another public
hearing.
Following discussion, Commissioner Frederickson
withdrew his motion to deny.
Motion was made that Planning Commission make the
following findings:

severe hardship on the applicant.
4. That the granting of the modification will not,
under the circumstances of this particular

joyment, peace, comfort and.general welfare
of persons working or.residing in the neigh
borhood and is consistent with the legislative
intent of the Municipal Code.

Robert Kalatschan, son of the applicant, appeare
before the Commission in connection.with this
,matter and concurred with the staff report and
recommendations with the exception of the requir
ment for 12 offstreet parking spaces. He advise
that the business proposed, which was a take -out
hamburger stand, would rely on people who are
already in the area, either beachgoers, shoppers
or local residents, and that this was not the
type of business which would attract people from
outside the area. He felt that two parking spat
for his employees would be sufficient.
Peg Forgit, 2205 West Balboa Boulevard, appeared
before the Commission in support of the applican
request and felt that the type of business .being
established would not require: additional parking
spaces.
John Shea, 2214 West Oceanfront, felt that this

Tom White, 1022 Bayside Cove, applicant, appeared
before the Commission and commented on the type of
operation proposed. He concurred with the staff
report and recommendations except for the placement
of sidewalk behind the curb because of the desire
to retain the greenbelt, however, he realized
there was nothing he could do about this require-
ment and would have to live with it.

Beaches and Recreation. Said landscaping
shall be implemented in accordance with the
approved plan and the landscaping shall be
permanently maintained.
That all signs shall meet the Planned Communit
Development Standards and shall be approved by
the Director of Community Development.
Convenience signs such as "entrance" or "exit"
shall have a maximum area of six square feet.
Said convenience signs shall not include the
name or logo of the restaurant use.
All exterior lighting shall be approved by
the Department of Community Development.
All mechanical equipment and the storage of
cartons, containers and trash shall be shielde
from view within a building or within an area
enclosed by a wall or fence.
7. That a washout area for trash containers shall
be provided in such a way as to allow direct
drainage into the sewer system and not into
the storm drains.
8. That a resubdivision be approved by the Plan-
ning Commission and a parcel.map be filed to
establish one building site where two parcels
now exist.
9. That a 6 foot wide P.C.C. sidewalk be construc
ted immediately behind the curb along the Birc'
Street frontage and extended to the end of the
curb return on Von Karman Avenue.
10. That the two driveway approaches be the curb
return type with a radius of 15 feet.
11. That access ramps at a location satisfactory
to the Public Works Department be provided in
the curb return and the existing traffic
island at the intersection of Von Karman

Request to consider proposed amendments to the
Newport Beach General Plan.
Staff advised that the results of the traffic
study and model report would not be available
until March or April and consequently final acti
on this General Plan Amendment would have to be
delayed pending that information. However, the
issues not dependant on the traffic model inform
tion could be addressed at this time. Staff
briefly reviewed the three parts of the proposed
General Plan Amendment.
Public hearing was opened in connection with
General Plan Amendment No. 78 -1.
Part 1.- 78 -1 -A: A proposed amendment to the La
Use and Residential Growth Elements to change th
.
designation on the 17.2 acre Caltrans parcel at
northwest corner of Superior Avenue and West Coa
Highway from "Multi- Family Residential" to "Medi
Density Residential" and establishing a maximum
number of dwelling units to be permitted on the
subject site.
Dr. Todd Bailey, 18 Encore Court, Newport Crest,
appeared before the Commission and advised that
the area south of Newport Crest was the last pla
available for a greenbelt and felt that the City
should give this some consideration.
David Shores, 12 Tribute Court, Newport Crest,
appeared before the Commission on behalf of the
Newport Crest Homeowners Association and advised
they felt that the property in question should n
be developed in any way. However, if a.ny develo
ment should occur, it should not be any greater
than 4 dwelling units per acre.
Louise Greely, 16 Swift Court, appeared before t!
Commission on behalf of the Newport Crest Home-
owners Association and advised of their support
in reducing density throughout Newport Beach. T

Peggy Cheetal, Encore Court, Newport Crest,
appeared before the Commission and advised that
most of the homeowners shopped in Costa Mesa
because of the traffic problems in Newport Beach.
Dorothy Parker, Newport Crest, appeared before
the Commission and compared Newport Beach with the
City of Tokyo, Japan wherein small parcels of land
were developed and soon there was no more open
space left.
David Sims appeared before the Commission on behal
of the California Department of Transportation and
advised that a reduction in the density would
effect the market value of the property and
encouraged the Planning Commission to adopt the
designation of "Medium Density Residential." He
answered questions of the Commission with respect
to acquisition of the property and the effect of
zoning on the value of the property.
John Butler, 912 West Balboa Boulevard, appeared
before the Commission on behalf of the Central
Newport Beach Homeowners Association and advised
that any development would have a detrimental
impact on traffic and therefore were opposed to
any development of the subject property.
Planning Commission discussed the disposition of
this part of the General Plan and a straw vote
was taken on the matter.
Motion was made that Planning Commission recommend
a density of 2 dwelling units per acre on the
subject site.
Planning Commission discussed density of the
subject property and the role of the Planning
Commission to establish land uses, following which
a substitute motion was made that Planning Commis-
sion establish a density of 5 dwelling units per
buildable acre or a total of 64 dwelling units
overall.
Part 2 - 78 -1 -B: A proposed amendment to the Land
Use and Res ential Growth Elements to designate a
2.3 acre parcel, adjacent to the Newport Terrace
development (former City dumpsite) and currently
in the City of Costa Mesa, for "Medium- Density

Testimony regarding Castaways Commercial site:
Marvel Caliva, 216 Kings Place, appeared before
the Commission representing the Cliffhaven
Community Association. She advised that the site
in question would be an ideal spot for a park;
that the designation of the site should be low
density of 4 dwelling units or less per acre if
developed; and that a hotel on the site would have
an.adverse effect on the already impacted traffic
situation.
Hal Thomas, 9081fi West Balboa, appeared before the
Commission and recommended that all the sites
under consideration around the bay be designated
as open space.
Jean Watt, 4 Harbor Island, appeared before the
Commission to comment on the loss of open space
and what she felt was the basic concerns of people
throughout the City. These concerns included.less
regionally intensified commercial uses; lower
residential density (4 dwelling units per acre)
in order to achieve more open space; phasing of
development in order to work towards a more
systematic solution with respect to transportation
Steve Sherrill appeared before the Commission to
comment on the Castaways site and felt that Newpor
Beach needed a hotel of outstanding character on
the waterfront. He further felt that if the
entire site were residential, the traffic impact
would be much greater than if a portion of the
site were developed commercially because residen-
tial traffic has definite peaks whereas commercial
does not.

development within the City and the choice of th

resort community. Therefore, he advised of his
position to oppose most commercial expansion and

cial enterprises such as that indicated for the

Commissioner Balalis felt that phasing of develo
ment was the most important aspect and that
decisions regarding development should not be
made until the results.of the traffic model were

Testimony regarding Bayview Landing Site:
Dick Reese, Vice President of Planning, The Irvi
Compqbny, appeared before the Commission to comme
on this site as well as all the remaining sites
and presented the Planning Commission with copie
of a presentation made to the City Council at
their last meeting which essentially took a
position with respect to the concept of a mora-
torium but in effect was a commitment to master
planning and orderly development within the City
of Newport Beach. He requested that between the
formal public hearings, work sessions be held on
specific sites in order to determine the enviror
mental constraints of the site and explore diffe
ent types of density and land use. He advised c
specific site plans under way, the Company's
desire to reach a compromise and move ahead on 1
specific sites, and commented on phasing of
development and street improvements.
Hans Dickman appeared before the Commission to
comment on traffic and parking.

Laura McLellan, 527 Westminster, Newport Heights,
appeared before the Commission in opposition to
the reduction of density in the "Newport Heights
R -2 District" because she felt the value of the
property would be reduced. .
Roland Landrigan, 535 E1 Modena, President of the
Newport Heights Community Association, appeared
before the Commission and advised that the reduc-
tion in density in the "Newport Heights R -2
District" was requested by the Association because
they felt the Heights was primarily a single famil
area and it was their desire to retain this low
density throughout the Heights area and reduce the
impact of traffic and additional.density as much
as possible.
Ken Cluse, 521 Westminster, commented on the mix
of development in the "Newport Heights R -2 Distric
and felt that the area would deteriorate if the
possibility of redevelopment were removed by down-
zoning.the area.
Diane Berry, 507 Orange Avenue, appeared before
the Commission in connection with the "Newport
Heights R -2 District" and commented on the traffic
problems in the area and the need for upgrading
the community and reduction in density.
Jerry Hampton, 535 Riverside Drive, owner of
property at 467 Westminster, appeared before the
Commission in opposition to the change of zoning
in the "Newport Heights R -2 District."
Neil Powers, owner of property at 517 and 521 Bols
appeared before the Commission in opposition to
downzoning of the "Newport Heights R -2 District."
He commented on the mixed number of units on the
various properties and disputed the Association's

family residential.

"Parking Needs and Economic 'Feasibility Study for
the Central Newport Beach Area."
Senior Planner Talarico presented the draft report
of the Parking Program Feasibility_ for the Central
Newport Beach Parking Study prepared by Wilbur.
Smith and Associates and briefly commented on the
contents thereof. Staff recommended that the
report be forwarded to the Central Newport Parking
Committee for review and report back to the Plan-
ning Commission.
Milbeth Brey, Chairman of the Central Newport
Parking Committee appeared before the Commission
and advised of their willingness to participate
in the review of the parking study and report back
to the. Commission as soon as possible.
• Carl Ackerman appeared before the Commission to
comment on the report and felt that many of .the
recommendations were questionable.
Motion X Following discussion, motion was made to refer the
All Ayes Draft Report of the Parking Program Feasibility
for the Central Newport Beach Parking Study to the
Central Newport Parking Committee for review and
report back to the Planning Commission.
ADDITIONAL BUSINESS:

All Ayes City Council to investigate the possibility of the
acquisition of the Caltrans property on the bluff
west of Superior Avenue.
