MINUTES OF THE PLANNING COMIISSION, THURSDAY, FEBRUARY-17, 1955 - 7 :30 P.M.
Chairman Longmoor called the regular meeting of the Planning Commission to order.

MINUTES: Minutes of the meeting on January 20, 1955 were corrected to mention
the Planning Commission's request of the City Attorney for his opinion on the
status of the Master Plan under the•City Charter and as to whether a new
recommendation must be drafted if the entire Master Plan is to be adopted. The
minutes were then approved on motion of C. Rudd, seconded by C. Reed, and carried.

FINDINGS: The two building sites as proposed offer a far better

and is a more progressive development.

FINDINGS: This application is consistant with the planned development

FINDINGS: The house next door is already constructed to within two Tract

on a building site containing an existing duplex on property described as V - #197

NOTE: The existing duplex is constructed across the common lot line Block 234,
making the whole property one building site and was done so in 1947 when CDM Tract
the Code was interpreted to mean a certain number of units could be
built per lot regardless of location on the property and appears to be
' similar to the 2nd unit at the last meeting in an R-1 district and Granted
granted.

FINDINGS: The proposed unit would be constructed on a lower elevation
of the lot facing Bayside Drive and would be clear out of view of the
adjacent houses to the south. The property contains 7311 square feet,
which is about twice the size of adjacent lots. Allowance of this
Variance will not establish a precedent. Due to the topography of the
ground the third unit would be constructed on ground which would be good
for no other purpose and will in no way interfere with any other property.

FINDINGS: Similar overhangs are already in existence on adjacent and Balboa Island

FINDINGS: The next door neighbor Mr. Bircher protests that the 15
foot setback will obstruct his view. The patio yard between

not be acting in the best interest of the property to grant such

FINDINGS: The house as proposed can be constructed with a 47 foot front

FINDINGS: Six letters of protest were received and five persons arose Tract #673
from the audience and protestdd at the hearing. The entrance of two
garages off Goldenrod is in variance with the architectural practice
of the neighborhood and unnecessary where an alley is altilable. DENIED
Three units in that location on such an R-2 parcel would be an abuse
of the R-2 zoning restrictions. No hardship is involved since the
applicant bought the property under the present restrictions and
apparently understood at the time of purchase that he could only
construct one more unit.

FINDINGS: The lot sizes proposed by Mr. Hellman eachhave an area
of 8250 square feet and a width of 55 feet. Subdivision Ord. #650
requires a 5,000 sq. foot area and a 50 foot width. The street is
in and paved with suitable curbs. Water has been brought to
the property next door. The property will be in the same position
regarding sewers as it is now.

FINDINGS: The six units proposed, by Mr. Babbitt offer an attractive Lots 21, 22
addition to the neighborhood. Each has its own patio and is well Block J
designed, garage facilities are off the alleyand one legal space for Tract #518
each unit. There are other multi -unit dwellings in the.same area.

' As per request of last meeting. RE: Section 707 of the City Charter -
It is the considered opinion of the City Attorney that if the Planning
Commission desires to recommend a master plan for the City of Newport
Beach, that it will be necessary to draft a new recommendation and that
the recommendation that was passed by the City Planning Commission several
years ago does not become effective merely by';the adoption of the
City Charter.
It should also be noted that before recommendation can be adopted by
the Planning Commission, that a public hearing must first be had in
accordance with Section 707A of the City Charter.
