Planning Commission discussed at length the matter of parking and conditions which should be imposed if the request were approved. Zone: P -C Applicant: Emkay Development Co., Inc., Newport Beach Engineer: Raub, Bein, Frost & Associates, Costa Mesa Owner: Same as applicant Bob Bein of Raub, Bein, Frost & Associates appeared before the Planning Commission and requested that the dedication of Martingale Way be made in con- junction with the surrounding area on which they were processing a tentative map rather than as requested. City Engineer Nolan advised the City's. preference. X Following discussion, Resubdivision No. 330 was X approved subject to the following conditions: 1. That a parcel map be filed. 2. That all improvements be constructed as required by ordinance and the Public Works Department. 3. That the full width of Martingale Way adjacent to the resubdivision be dedicated and improved in conjunction with the tentative map encompas- sing the remainder of the property fronting on Martingale Way. 4. That a sidewalk with a minimum width of six feet be constructed immediately behind the curb and gutter along both the Corinthian Way and Martingale frontages. 5. Zoning Administrator Laycock presented additional information relative to illumination of streets outside of the parking lot. Planning Commission discussed condition No. 4 as recommended by the staff. Ernest Wilson, Architect for Emkay Development Co. appeared before the Planning Commission on behalf of the applicant and answered questions in connec- tion with the lighting of the parking lot. X Following discussion, Planning Commission approved X Use Permit No. 1547 subject to the following conditions: 1. That development be according to the approved plot plan and elevations except for minor modifications approved by the Director of Community Development. 2. That all controls and specific development standards contained in the Planned Community text be met. 3. That all illumination in the off = street park- ing area shall be shielded or directed so as to confine direct rays to the subject property. However, the illumination of the outer areas of the off- street parking lot adjacent to MacArthur Boulevard shall be reviewed by the Police Department during the design stage. 5. That the location and design of all driveways shall meet the approval of the Traffic and Parking Engineer. 6. That all improvements be constructed as required in conjunction with Resubdivision. No. 313, specifically including the remaining, public improvements along the Birch Street and Corinthian Way frontages. Item #4 Request to permit a duplex to be constructed on a lot having an area of 1,540 sq. ft. where the VARIANCE NO. 1017 ordinance requires at least 2,000 sq. ft. Further request a zero sideyard setback for one side of a DENIED two car garage with one corner of the opposite side of the garage encroaching 1 1/2 feet (+) into the street sideyard setback in order to allow a rectangular garage on an irregular parcel. Location: Lot 21, Block 24, Newport Beach Tract, located at 129 - 24th Street on the northwest corner of 24th Street.and West Balboa Boulevard. Zone: R -2 Applicant: Garland B. White, Newport Beach Owner: Same as applicant Garland White, applicant, appeared before the Planning Commission and stated he had nothing further to add and agreed with the staff's report. Commissioner Hazewinkel questioned whether or not the applicant met the criteria required for a variance and Planning Commission discussed the general area which consists mostly of substandard lots. In the course of discussion, City Engineer Nolan brought to the attention of the Commission that the property in question contained only 1,540 sq. ft. and not 1,660 sq. ft. as shown in the staff report. Mrs. White, co -owner of the property, appeared before the Planning Commission and questioned the zoning. Mr. White appeared and stated that the improvement as requested would be better than the improvement already located on the property. Zone: C -1 Applicant: Union Oil Co., Los Angeles Owner: Equitable Life Insurance Co., DesMoines, Iowa. Zoning Administrator Laycock presented additional information relative.to the conditions as recom- mended by the staff if the request were granted. R. B. Franks, Real Estate.Representative for the Union Oil Company, 18911 Si Studebaker Road, Cerritos, appeared before the Planning Commission and answered questions relative to signs, location of the telephone booth, and the matter of automo- bile rentals. Tom Sharp, Union Oil Dealer for the station in question, appeared before. the Planning Commission and requested that he be allowed to continue the operation of automobile rentals. He also discusse the location of the telephone booth. Page 6. Activities and operations shall be subject to the following restrictions: (a) In addition to the dispensing of gasoline oil, air and water, the following opera - tions.are permitted uses when.conducted entirely within an enclosed building with- out the use of an open flame and in such manner so as not to be a nuisance or of detriment to the occupants of adjacent properties. (1) Changing of engine oil and filters. (2) Lubrication of motor vehicles chassi . (3) The cleaning of component parts. • (4) Brake adjustment and replacement. (5) Automobile washing and polishing (not including mechanical car wash). (6) Front -end alignments. (7) Soft drinks, candy and cigarettes sold via dispensers. (b) The dispensing of gasoline, oil, air and water from pump islands, and the follow- ing activities and items offered for sale or rent permitted outside of.a building. (1) Automobile rental limited to three (3) cars. (2) Tire display as follows: One (1) rack containing not more than a number equivalent to four (4) tires per pump island, or not more than four (4 tires in racks on each pump island, and in no case no more than eight (8) tires on display outside the building. • (3) Trash areas, enclosed by walls, to be integrated with the design of the service station. Telephone facilities shall be recessed into the service station building unless a different location is specifically approved by the Planning Commission. (5) Any testing or servicing of automobiles which necessitates a running engine. (6) The sale and installation. of batteries and minor automotive accessories. (7) The sale, mounting and repair of tires. (8) The testing, adjustment and replace- ment of parts. (9) The servicing of air- conditioners. • (10) The servicing of air pollution control devices. (11) Lamp adjustment. (c) Operating provisions shall include the following restrictions. (1) Parking on site is prohibited except for such vehicles as are in the process of being serviced, those belonging to employees, service truc s owned by the establishment, and not more than three (3) rental cars. (2) No vehicle waiting for service shall be parked for a period longer than twenty -four hours on the station site unless in the process_of being serviced. No vehicle shall be considered to be in the process of being serviced for a period longer than one (1) week. (3) Gasoline tanker trucks shall not • obstruct the public right -of -way during delivery. The following development standards shall apply: (a) Parking - A minimum of ten (10) parking spaces shall be provided. All such park- ing spaces shall be marked clearly and shall meet all City codes and standards as to size. Five (5) of the spaces may be tandem spaces as shown on the approved plot plan. (b) Utilities - All utilities shall be instal- led underground within the exterior pro- perty lines of the site. (c) Drainage - All drainage to the street shall be by underground structures to avoid drainage across City walks or drive aprons, and shall be subject to approval by the Director of Public Works. (d) Noise - Buzzers and amplified signaling bells are to be located within the service . station proper and shall not generate noise beyond that of a normal residential telephone ring. (e) Landscaping - At least ten (10) percent of the site shall be landscaped with plan materials designed to provide beautifica- tion and screening. Planting areas shall include but not be limited to the followi g: (1) Five -foot wide planters between driveway approaches, separating pump islands for their entire length from the sidewalk or public right -of -way. (2) A planting area at.the "exterior" corner of the site from.curb cut to curb cut at the intersection. Plant materials shall be chosen for their screening qualities, beauty and durability. Plantings shall include a mixture of trees, shrubs and groundcovers. All planting areas shall be provided with • a permanent underground automatic sprinkler irrigation system of a design suitable for the type and arrangement of the plant materials selected. Page 9. (f) Lighting - All lighting fixtures shall be located so as to shield direct rays from adjoining properties. Luminaires shall be of a low level, indirect diffused type and shall not exceed a height of greater than twenty (20) feet above finish grade. (g) Permanent Exterior Signs - A Maximum of seven (7) permanent signs shall be per- mitted on any service station site as follows: (1) The existing 25 foot high pole sign. having.a sign area of approximately. 44 square feet shall be permitted • until such time as a service station ordinance is adopted after which thi sign shall be made to conform. (2) Two wall signs to be located on the exterior facades of the building and not exceeding ten (10) square feet each. (3) One sign advertising the price of ga and not exceeding eight (8) square feet. The sign shall be of material in harmony with those utilized in the building. (4) One sign identifying the operator of the premises and address of the buil - in and not exceeding a total of six (63 square feet. (5) All small signs advertising products for sale, trading stamps, credit car s and the inspection of pollution cont.ol devices, lamps and brakes, as auth- orized by the State, shall be cluste ed . into not more than three (3) sign groupings located on the building fa e and a total of which shall not excee twelve (12) square feet in area, exclusive of-.the additional space required for signs advertising State Page 10. (6) One double -faced sign, in a permanent frame, not exceeding an area of twel e (12) square feet for each side, for promotional purposes,.but excluding any reference to price. No rotating, flashing, blinking or signing with animation, flags, banners or other attention - attracting device shall be permitted on a permanent basis. Attention- attracting devices may be permitted for thirty (30) days, however, when connected with an opening or change in ownership or management of a service station. (h) Storage - All products and merchandise; . except as permitted in Condition 1 (b), shall be stored within the main building. (i) Additional Requirements - It shall be required as .a condition of this use permit that the grantee provide the oil company, the property owner and /or lessee each with a copy of the conditions,embod.ied in the permit, and receive a written receipt therefor, so that there shall be no perso operating the premises who is not aware of the conditions of operation. If, during any inspection of the premises, the City shall find violations of the require- ments of the use permit, it shall notify both the oil company and the operator of the station in order to assure compliance. 3. That the proposed 6 foot high slumpstone block wall adjacent to the alley shall be reduced to 3 feet in height within 15 feet of Avocado Avenue. 4. That a 10 foot radius corner cut -off be dedicated at Avocado Avenue and East Coast Highway, and . that the curb return be constructed with a 20 foot radius. 5. That the types and locations of street trees be provided to the specifications of the Parks, Beaches and Recreation Director and that the standard tree inspection fee be paid. Jean Belden appeared before the Commission in rebuttal of her application. Zone: C -1 -H Applicant: Anthony Schools, Los Angeles Owner: Shemloh Co., c/o Harbor Investment Co., Newport Beach Ted Devine of Harbor Investment Co., agent for the applicant, appeared before the Planning Commission to answer questions and presented additional information relative to parking and hours of operation. Since all of the facts were not.presented to the staff for analysis prior to the meeting, no recommendation.could be made and staff requested that the matter be continued to March 2nd with the approval of the applicant. Planning Commission recessed for five minutes to allow the applicants.an opportunity to confer relative to staff's request for a continuance. Ted Devine appeared and stated they did not wish to continue the matter. Maurice.A. Kimble, President of- Anthony Schools appeared before the Planning Commission and gave. a background summary on the operation of the schools. He stated that operation of an evening school only was not agreeable. Also, he did not. want to continue the matter to March 2nd.
