MINUTES OF TO PLANNING COWSSION MEETING, THURSDAY, FEBRUARY 18, 1954
Chairman Longsoor called the regular meeting to order.

The minutes of the Meting on January 21 1954 were approved capon
motion of Can. Briggs, "seconded by Con. Lind, and carried.
Application of Ed 'Fear to exceed the front yard setback of 35 feet
on "Lot 8, Block 439, Canal Section, was 4ithdrawn by applicant
before the hearing. The Couni.ssion recommended the refunding of
his application fee, minus the cost of legal publication.
Application of Jack B. Cunningham to reduce the front yard setback
of 20 feet as required on reversed frontage lots.F to a 10 foot
setback facing Old County Road which is at present unimproved and
to reduce a rear yard setback from 10 feet to 5 feet, and to fur-
ther allow the aide yard along Catalina Drive to be 4 feet in
place of 20 feet along the rear 20 feet of the lot. Said lot is
the southeasterly 60 feet of Lot 4, Block 1, Tract 27 and is on
the northwest corner of Catalina Drive and Old County Road. The
sidayard conditions are covered by Section 9103.15 of the City of
Newport Bach Municipal Code. The property to the rear and now
facing Clay Street is also a reverse frontage lot. A house across
the street on Catalina Drive has a 4 foot front yard setback.
The hearing was opened. Mr. Cunningham was present to answer any
questions. There were no protests either written or verbal. The
committee recommended granting of the variance.

FINDINGS: The now frontage of E'ly 601 of Lot 4 on Old County Road
is adjacent to a 3 foot existing setback; therefore, the 10' frontage
proposed herein improves the setback condition. The rear yard butts
against the rear of another reversed frontage lot facing Clay St. and
neither property will require an alley. Therefore, a 51 rear yard
setback will allow a greater use of the property. The requirement
of a 201 setback for a distance of 201 at the rear sideyard is not
needed to pro*eot the adjacent reverse frontage lot. thus, a sideyard
setback of 41 along Catalina Dr* would allay an improved use of the
property and not impair adjacent property.
The hearing was closed upon motion of Gom. Copelin, seconded by Com.
Smith, and carried.

Application of J. C. Stuard to permit construction and operation of
a duplex apartment over four garages across the front portion of Lots
V - #122 #14 & #150, Block 44, River Section and farther located at 130 and .
132 - 45th Street. The rear portion of said lots contains an existing
Stuard, J. C. duplex constructed across the common property line of said lots thus
creating one R-2 building site out of two R-2 lots as covered in
Lots 14 & 15 Sections 9107.16 and 9107.17 of the City of Newport Beach Municipal
Block 44 Code., Section 0103.23 prohibits the construction of more than two
River Section dwelling units on one R-2 building site.
GRANTED Chairman Longmoor declared the hearing open. Mr. Stuard rain present
to answer any questions. There were no protests. The Goadsittee
recommended the granting of the application.
FINDINGS= Mr. Stuard stated that the existing duplex was constructed
in July 1949 with the understanding from the Building Department that
two more units could be constructed at a later date, thus allowing
four units to exist on two R-2 lots. An investigation shows Mr.
Stuardss proposed plans to be an improvement to the property and
would tie the property together by having the garages for all units
in the one building.
The hearing was closed upon motion of Com. Copelin, seconded by Com.
Hayton, and carried.

FINDINGS: The existing building site is 35 feet % 40 feet with a

widening of Balboa Blvd. and for the convenience of the City, and
it is thus allowed as a legal building site. The reduction in
setback is needed to allow construction of an adequate building
.and will not adversely affect adjacent properties. There were no
objections.

Com. Budd, and carried.

Application of Foster & Elsiser Co. to construct and.uss:an outdoor

advertising sign to be located on the northeast corner of Balboa
Blvd., and 28th St. and 51 inside of the existing fence, and on
property now in a C-1 District. This structure will replace a

structure moved from the southeast corner of Balboa Blvd. and 20th
St.
Mr. David Larson representing the Foster & Eleiser Co. was present

and stated that the sign should not harm the adjacent property.
DENIED
FINDINGS; The Planning Commission believes that commercial signs
of the type proposed by the Foster & %leiser Co. detract from the
general appearance of the City of Newport Beach, and should be
gradually eliminated in the interests of better planning. They can
also provide a traffic hazard by distracting the attention of
automobile operators from existing road problems.
The Planning Commission has adopted a policy that wherever such a sign
has been removed it should not be replaced. $r doing this such signs
will eventually disappear from our highways.
Com. Copelin moved that the application be DENIED, seconded by Come

Application of Foster & Kleiser Co. to construct and use an outdoor
advertising sign to be located on the southerly side of the Coast
U. P. #125 Highway several hundred feet,easterly of its intersection with
Balboa Blvd. Said sign will back up on an existing sign structure '
Foster & Kleiser on this property and replaced one removed from Balboa Blvd., about
875 feet vast of 30th street.

FINDINGSs The Planning Commission believes that commercial signs

Application of Alan J. Miokle to permit the addition of 12 trailer
lots within an area now used by an existing trailer park at the end
U.P. #127 of 31st Ste on the Lido Peninsula. Said lots to be located on
Mickle Alan J. property which is not now being used by utilitiasi- or: >for trailer ,
sites and will not decrease the size of existing trifler sites
below the 850 square foot size required by the City Trailer.

FINDINGS: -The committee reported that these twelve lots vill.fit
GRANTED in with the existing property. The 12 lots as
proposed will be
located on property now being used for storage of unoce%ded
trailers and waste area within an.operating trailer park, and will
not eliminate any areas now being used for sanitary facilities.
No objections have been received.

Com. Smith moved that the hearing be closed, and set over for a second -
hearing on March 18, 1954; motion seconded by Com. Hayton and carried.
Application of the Dr. Forbes Farms, Inc. for approval of a tentative
map of proposed Tract #2096 to be located on property known as Linda Tentative Map
Isle, and lying southwesterly of the intersection of Bayside Drive of
and East Coast Highway. (The Coast Highway in now divided East and Tract #2096
Best by the Upper Bay Bridge.)

' Applicant requested that the hearing on this map be set over for hear-
ing on March 18, 19549 until after a Joint Harbor Committee meeting to
determine the width of the Upper Bay Channel in front of Linda Isle,
since it is possible the channel might be widened which would reduce
Lot 59 of Tract #2096.
Com. Briggs made a motion that the hearing on this map be set over to
March 18, 1954, motion seconded .by Com. Smith, and carried.
Application of the Irvine Co. for approval of a tentative map of Tentative map of
proposed Tract #2095 to be located on property now located in the proposed
City of Newport Beach and adjacent to Tracts #1140 and #1102, now Tract #2095
known as Bayshores. The City Engineer approved the map and reem-
mended that it be approved.
Com. Lind moved that the map of Tract #2095 be approved, seconded by
Com. Hayton, and carried.
Final Map of Tract #2094 was submitted for approval with a letter from Final Map
the City .Engineer approving the map, as required under Section 9253.41 of
of the City Code. Tract #2094
