Commissioners Absent: Dosh Minutes of the regular meeting on January 21, 1965 and adjourned meeting February 4, 1965 were approved on motion of Commissioner Rea, seconded by Commissioner Jakosky, and carried. :NP�rk�tk�nhtL- &��haiir#kt k+rir,ai�ar#k�4r* The tentative map of Tract 5854, being a proposed sub- Tract 5854 division of a Portion of Block 2, Lot 169, Irvine's Subdivision consisting of 3.2 acres divided into 12 R -3 lots located south of Flagship Road at the extension of Hilaria Way, was recommended to the City Council for approval subject to the following conditions: Motion x second x 1. A repro- ducible copy of the grading plan on a standard size sheet shall be furnished to the Public Works Department. 11. That a letter from adjacent property owners agreeing to the proposed grading be filed with the City prior to approval of the final map. CITY OF NEWPORT BEACH COMMISSIONERS u C, y o d ID r COUNCIL REFTERRALS Chairman Clemence appointed Commissioners Jakosky, Curtis and Rea as an Oil Ordinance Committee to submit recommendations to the City Council as soon as possible in connection with an Oil Code for the City of Newport Beach. ADDITIONAL BUSINESS The Commission considered a letter dated February 12, 1965 from the Law Offices of Kindel & Anderson, attorneys for Robert R. and Jean W. Sprague, regarding proposed multiple apartment building at 205 Carnation Avenue, Corona del Mar, California, which is hereby incorporated by reference and made a part hereof as though set forth in full. The Commission considered only item I. A. which states: "Newport Beach Municipal Code 9107.28 provides as follows: "'HEIGHT OF BUILDINGS.' The vertical dists[nce from the average level of the highest and lowest point of that portion of the lot covered by the building to the topmost point of the roof." In determining the "lowest point of that portion of the lot covered by the building," the Building Department says that 6.3 feet above mean sea level is the "lowest point" and shuts its eyes to what the lowe4t point is in fact. In fact, the lowest point of that portion of the subject property covered by the building is at least 10.43 feet below the point arbitrarily decided upon by the Building Department. Therefore, the Building Department's "average level" of the lot is at least 5.215 feet higher than the actual average level, the level provided for in Section 9107.28. We appeal from the Building Department's decision to issue a building permit which allows the building to be at least 5.215 feet higher than the maximum height allowed by Code."
