Place: Council Chambers COMMISSIONERS ---------- - - - - -- --* -------- --------------------------------------------------------- ------- ROLL CALL Commissioners Present: Clemente, Copelin, Hayton, Keene, Lind, Rudd, Smith, Sturtevant I � I ' Commissioners Absent: Longmoor 1 � MINUTES Minutes of the regular meeting on January 15, 1959 were approved on the motion of Commissioner Copelin, seconded by Commissioner Rudd and carried. 1 ' r PUBLIC The matter of Variance 46391 and Use Permit 46338 was HEARING referred to the Planning Commission by the City V -391 Council on January 12, 1959 to determine whether said UP -338 applications should be revoked under Section 9106.43 of the Newport Beach Municipal Code. ; Commissioner Sturtevant requested that the following statement be made a part of the record. ; 1 , ' r "At the time of the original hearings in the matter ; of Variance 46391 and Use Permit 46338 I was not a ; member of this Planning Commission. During those hearings I expressed an opinion supporting the • application for the variance and use permit. I ' I wish the record to show that I have never had nor ; do.I now have any interest whatsoever in any ; Company or project in which Mr. Cedric Roberts has or has had any interest. I have never had any ; business relations with Mr. Roberts. In expressing ; my opinion at the original hearings, I did so voluntarily and without any compensation whatsoever.: r I do not feel that my action in so expressing my i opinion in the matter before I became a member of i this Commission imposes any legal or moral responsibility on me to disqualify myself from acting as a Commissioner in this present hearing. However, so that I may not embarrass Mr. Roberts or this Commission by so acting I now request that I be excused from this hearing and that the record show that I have not acted in this matter at this � hearing.
