Public hearing was opened in connection with this,
matter.
Ed Kirk appeared before the Commission on behalf
of Mari ners Savings and Loan Association and
concurred with the staff report and recommendations.
There being no others desiring to appear and be
heard, the public hearing was closed.

Motion was made that Planning Commission make the
following findings:
1. That the proposed map is consistent with
applicable general and specific plans.
2. That the design or improvement of the proposed
subdivision is consistent with applicable
general and specific plans.
3. That the site is physically suitable for the
type of development proposed.
4. That the site is physically suitable for the
proposed density of development.
5. That the design of the subdivision or the
proposed improvements are not likely to cause
substantial environmental damage or substan-
tially and avoidably injure fish or wildlife
or their habitat.
6. That the design of the subdivision or the
proposed improvements are not likely to cause
serious public health problems.
7. That the design of the subdivision or the
proposed improvements will not conflict with
any easements, acquired by the public at large
for access through or use of, property within
the proposed subdivision.
8. That the discharge of waste from the proposed
subdivision will not result in or add to any

violation of existing requirements prescribed
by a California Regional Water Quality Control
Board pursuant to Division 7 (commencing with
Section 1300) of the Water Code.
and recommend to the City Council that Tentative
Map Tract 8737 be approved, subject to the follow-
ing conditions:
1. That all applicable conditions of Use Permit
No. 1718 and Resubdivision No. 451 shall be
complied with.
2. That all public improvements be constructed as
required by ordinance and the Public Works
Department. -
3. That the boundary of the final map be checked
by the County Surveyor before being submitted
to the City for approval.
4. That Section 19.16.030 of the Subdivision
Ordinance regarding map scale be waived
provided maps drawn accurately to a scale of
1" = 100' are furnished to the Public Works
Department.
5. That the remaining public improvements along
Superior Avenue and Hoag Drive (Hospital Road)
be completed as required as a condition of
approval for Resubdivision Nos. 408 and 451.
6. That the subdivision agreement and bonds
provided in conjunction with Resubdivision
No. 408 guaranteeing completion of the require
public improvements be amended to extend the
time for completion an additional 12 months.
7. That all vehicular access rights to Hoag
Drive and Superior Avenue be dedicated to the
City of Newport Beach except for three drive -
way approaches: one along Hoag Drive, one
along Superior Avenue approximately 200 feet
northerly of Hoag Drive, and one joint drive -
way along Superior Avenue at the northerly
corner of the tract. The locations of the
driveways shall be shown on the final map.
8. That a water capital improvement acreage fee

of $900 per gross acre be paid.
9. That the subdivider be responsible for 12k%
of the cost of the future traffic signal at

Hoag Drive and Superior Avenue. A separate
agreement with appropriate accompanying
security shall be provided guaranteeing the
required cost sharing.
10. That there shall be submitted a declaration.
of covenants, conditions and restrictions
setting forth an enforceable.method of.
insuring the installation and continued
maintenance of all services to be carried
out by the management company. Said services
shall include, but not be limited to, install-
ation and maintenance of the structure, the
landscaping, the parking areas and all other
common areas. Said C.C.& R.s shall be
reviewed and approved by the City Attorney
and the Director of Community Development.
11. That the applicant shall install temporary
and permanent erosion and siltation control
systems. A program for temporary erosion
control shall be implemented immediately.
