HomeMy WebLinkAbout02/20/1947274 The Newport Beach City Planning Commission held a regular meeting, Thurs- day, February 20, 1947, with Chairman Allen presiding. ' ROLL CALL Commissioners presents Allen, Copelin, Ellerbroek, Johnson, and Rudd. Commissioners absent: Baltz, Longmocr, Pleger, and Shits. MINUTES Commissioner Johnson made the motion, seconded by Commissioner Copelin that the minutes of the regular meeting of January 16, 1947, end thos of the Special Meeting of February 6. 1947, be approved as read. Motion car- ried and so ordered. C0MG5'�ICATI0NS Secretary Ellerbroek presented the statement of the American Society of Planning Officials for one years membership, beginning January 1, 1947, in the amount of $10.00. Commissioner Rudd made the motion, seconded by Commissioner Copelin that the Commission recommend same to the City Coun- cil for payment. Motion carried. " PUBLIC HEARINGS Public hearing upon the matter of the application of Grant K. Phillips for a 50% setback variance for Lot 12, Block 26, Balboa Tract, was de- clared, same having been Ailed and advertised for hearing at the Special Meeting of February 6, 1947, at which time it was tabled for - Further study, that considering a letter of opposition faom an adjacent property owner, Mr. Winslow E. Lincoln, Commissioner Copelin reported for the committee, after investigating the property, that the Commission grant only 2 feet variance. Building Inspector Nelson agreed, as did Secretary Ellerbroek. Commissioner Johnson opposed granting any variance, to which Chairman Allen agreed. Commissioner Rudd made the motion, seconded by Commissioner John - ROLL CALL VOTE son that the application be denied. Ayes: Allen,.Copelin, Johnson, and Rudd. Noes: Fllerbroek. Motion carried, and so ordered. Public hearing upon the application of K. P. Wallace for a 50% front yard setback variance for Lot 27, Block A 55, Corona Del Mar, was declared, same having been duly filed and advertised. However, in the absence of Commiss- 1•ner Baltz, chairman of the committee to investigate the property, and the receipt of several protests gegarding this, Commissioner Johnson made the motion, seconded by Commissioner Ellerbroak, that the matter be tabled to the next meeting for action. Motion carried, and so ordered. Public hearing upon the application of A. R. Benedict for 50% front yard setback variance for Lot 24, Block 5, Section 3, Balboa Island, was heard, and carefully considered. Chairman Allen and Commissioner Ellerbroek re - ported on the matter, having checked the property, stating that the grant- ing of a 50% setback variance would bring the house on this lot to the same setback line as the others in the block. Commissioner Johnson madeethee ROLL CALL VOTE motion, seconded by Commissioner Rudd that the application be gpproved. Ayes: Allen, Copelin, Ellerbroek, Johnson, and Rudd. Noes: None. Motion carried, and so ordered. Public hearing upon the application of A. B. Haigh, for a 50% front yard setback variance for Lot 8, Clubhouse Tract, was heard, same having been duly filed and advertised, and being a a re- application from the Special Meeting of February 6, 1947. Mr. Haigh was present, explaining his plans and sketches, as well as a petition carrying the names of seventeen ad- jacent property owners, and also stating that the City Council advised him to re -apply and request the Commission to review the.matter. However, the views of the Commission were the same as before, i.e., the granting of this would be setting a precedent. After much discussion, Commissioner 275 Johnson made the motion, seconded by Commissioner Ellerbroek that the ' application be denied. ROLL CALL VOTE Ayes: Allen, Copelin, Ellerbroek, Johnson, and Rudd. Noes: None. Motion carried, and so ordered. Mr. S. Be MacAfMvy, present, submitted a letter <.f application to FEW BUSINESS amend the City's Zoning Ordinance to permit "Self- Service Laundries" in 0-1 and C-2 zones. After discussion, Mr. MacAlLevy was advised to post the filing fee if he distred his application to be considered for action. Mr. Ernest S. Pitney, present with a large group of citizens of approxi- mately one hundred, that filled the Council Chamber, presented a petition of many names of people opposed to making a parking lot at Newport on the Ocean Front, stating that they felt that the ocean front should be kept for use as a public beach. Chairman Allen stated that he was at a lots to handle the matter, since same came from the floor, and had not been re- ferred By the City Council. 'Mayor 0. Be Reed was present and explained that the business men of Newport were to have been present to submit a petition in favor of such a parking lot, and that the Council wanted the Commissions views and recommendations for the land use. Others present in addition to Mr. Pitney, opposing the proposition, were R. C. Mitchell, Mr. Huki11, Bert Mills, Mr. MCGowan, and D. We Holtby. After much dis- cussion, Commissioner Copelin made the motion, seconded by Commissioner Rudd, that the Commission recommend that the' ,land use of the ocean front- age be withheld for recreational purposes only. ROLL CALL VOTE Ayes: Allen, Copelin, Ellerbroek, Johnson, and Rudd. ' Noes: None. Motion carried, and so ordered. Attorney Vincent J. Blomberg and K. D. Reid, his client, were present to request a solution to a problem over Mr. R:eid's property on Marine Ave- nue, Balboa Island, known as the Beverly Apartments, which is at present being remodeled, and the difficulty being over a disagreement in the Building Department over the permit for this work. Mr. Blomberg and Mr. Reid explained that the present six existing apartments are being remodel - ed into eight by making apartments out of the garages, and rearranging the property to permit parking space for the cars. However, the plan, according to the Commission, is not workable, even though sufficient parking space for cars ham been provided to comply with the ordinance. Also, the Commission pointed out that permission for cutting the curbing at the center of the property and at each side was in error, and would present a traffic hazard, so recommended as the only solution, with the reconstruction now already under way, that the new entrance at the cen- ter be closed, as ell as the one on the south side, leaving the one on the north, and further recommended that Mr. Reid follow throggh with his option on the adjoining lot on the north, to use same for parking for his tenants. Mr. Henderson, of the Harbor Investment Company, presented the final map of Tract 1136, previously approved by the Commission. The zoning of this tract was the important factor, due to the original map having been mis- placed. Commissioner Rudd madeethe motion, seconded by Commissioner Johnson that the map be approved as presented, and that the proposed zon- ing classify all lots in the tract under R -1 zoning, except Lots 1, 2, 3, 41 51 6, 7, 8, 9, 10, 11, 12, 139 17, and 18, which are classified C -1. Ayes: Allen, Copelin, Ellerbrosk, Johnson, and Rudd. ROLL CALL VOTE Noes: None. Motion carried. Commissioner Rudd made the motion for adjournment, seconded by Commiss- ADJOURNMENT ioner Copelin.
