HomeMy WebLinkAbout02/21/19521.91. MINUTES OF THE PLANNING COMMISSION MEETING, THURSDAY, FEBRUARY 219 1952 ' ROLL CALL: Commissioners Present: Briggs, Copelin, Longmoor, Reed, Rudd, and Wightman. Pleger arrived late. Commissioners Absent: Ellerbrosk, and Smith. MINUTES: Upon motion of Commissioner Reed, seconded by Commissioner Rudd, the minutes of the last regular meeting of January 17, 1952 were approved as submitted to the Commission. Motion carried. USE PERMITS: Application of Hal Harnole for the manufacture and sale of ceramics at 2620 -A & B Newport Blvd. (Lot 11, Block 224, Section A) Chairman Longmoor asked if anyone wished to speak for or against the application. Francis Horvath spoke in favor of the application, and Commissioner Copelin said that he had looked it over and since there have been ceramics in there previously, could see no reason why it should not be approved. Chairman asked the square footage - -11250 sq. ft. The Use Permit would be limited, to the 1,250 sq. ft. The rear part of the lot is for parking and further devel- opmsnt; however, if they would want to expand further, will have to apply for another Use Permit for any expansion. Commissioner Reed made a motion that the heaping be closed, seconded by Commis sioner Wightman and carried. Commissioner Copelin then made s motion that the application for Use Permit for the 1,250 sq. ft. be granted, seconded by Commis- sioner Rudd and carried by the following roll call vote,, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, & Wightman. NOES: None ABSENT: Commissioners; Ellerbroek, Pleger, and Smith. Application of Foster - Kleiser Comnanv. for erection of an outdoor advertising structure at Lots 16 & 17, Block 160, River Section. Chairman asked if anyone wished to speak for or against. Commissioner Copelin suggested that no outdoor advertising signs be permitted in the City of Newport Beach except to replace another sign which has been removed. Also didn't think this application was a replacement moving from C. D. M. down to 60th Street in Newport Beach. Commissioner Rudd said that he would like to see them naturally die out, and not be replaced once they have been removed. Briggs concurred with Copelin & Rudd. Commissioner Copelin made a motion that the hearing be closed, seconded by Com- missioner Reed and carried. Commissioner Copelin then made .a motion that the application for erection of a board at above mentioned location be denied, seconded by Commissioner Reed and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longcoor, Reed, Rudd, & Wightman, NOES: None ' ABSENT: Commissioners: Ellerborhk, Pleger, & Smith. Application of oster -K ei er Company to erect advertising board at 1119 Coast Blvd, Corona del Mar, Lot 2, Block F. Tract323) Chairman asked if anyone wished to pseak for or against.: None.. Commissioner Copelin made a motion that the hearing be closed, seconded by Commissioner Reed and carried. 192 Commissioner Rudd then made a motion that the above application be denied, seconded by Commissioner Copelin and carried by the following roll call vote, to -wit. AYES: Commissioners: Briggs, Copelin, Longmoor, Reed, Rudd, & Wightman. NOES: None ABSENT: Commissioners: Ellerbroek, & Smith. NO VOTE: Commissioner Pleger. Application of Frank J. Jordan for permission to install pet shop at 1210 Coast Highway, Corona del Mar, (Lot. 3, Blbck M. Tract 323). Mr. Jordan was present and submitted additi &nal paper of canvass of surrounding property owners ap- proving of the application. Chairman asked for further details of the intended business. Mr. Jordan stated that he has been in business about fourteen years —San Marino, Beverly Hills, Van Nuys, specializes in trimming & bathing, high grade dog sup- plies, poodles, tropical fish. Doesn't handle birds or board dogs or keep any animals overnight. Handle food, pet supplies, and leather goods. Commissioner Reed asked the applicant if he intended to raise any other animals other than his two poodles. Ans: no. Commissioner Pleger asked if he would be agreeable to have a stipulation put in the Use Permit limiting bhe number of animals he would be allowed to keep there. Ans: Would not.be discriminated against. Only agreeable if others would not be allowed. Commissioner Rudd made a motion that the hearing be closed, seconded by Commis- sioner Copelin and carried. Commissioner Pleger would like to recommend appli- cation be approved subject to restirctions approved by Or. Jordan and Commission. Chairman stated that he didn't think you could legally limit the number of animals.. Pleger removed his motion and made a new motion that the application be approved. Motion seconded by Commissioner Reed. Commissioner Copelin would like to have included in the Use Permit that the appli- cant is agreeable to not boarding any animals overnight. This was a greeable with Mr. Jordan. Use Permit not transferable. Commissioner Pleger amended motion to include not allowing any boarding of any animals overnight. Commissioner Reed agreed to the amendment on his second of the motion and the Use Permit was granted with the above stipulation by the following roll call vote, to -wit:. AYES: Commissioners: Briggs, Copelin, Longmoor, Bleger, Reed, Rudd, and Wightman. NOES: None ABSENT: Commissioners: Ellerbrzosk and Rmith. Application of Lido Park (Alan J. Vickie) for additonal eighteen (18) trailer spaces. Chairman read letter of application, and asked if any6ne wished to speak for or against. Commissioner Copelin made an explanation of the application to . the rest of the Commission saying that a member of State Housing, upon inspection there, 'insisted that they get this Use Permit for the additionalspaces.. Building Permit was taken out bedore new ordinance was passed. Purely a routine matter. Commissioner Wightman made a motion the bearing be closed, seconded by Commissioner Reed and Carried. Commissioner Reed then made a motion that the application be granted, seconded by Commissioner Copelin and carried by the following roll call vote, to-wit: AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, and Wightman. NOES: None ABSENT: Commissioners: Ellerbroek, and Smith. I I 193 VARIANCES: Chairman declared the hearing open on the application of Hazel M. Owens for a 50% rear yard variance for overhang on proposed garage apartment on Lot 31, Block 13., Section One, Balboa Island, (124 Topaz Avenue) Committee report made by Commissioner Reed who had looked it over, said it seemed to be in one of the older sections of the island and couldn't see how the granting of this would work any injury. After discussion, the 50% asked for was right,.but he would be only getting 18 inches. Commissioner Pleger made a motion that the hearing be closed, seconded by Commissioner Reed and carried. Commissioner Rudd then made a motion that the application for Variance be granted, seconded by Commissioner Pleger and car- ried by the following roll call vote, to-wit- AYES. Commissioners: Briggs., Copelin, Longmoor, Pleger, Reed, Rudd, & wightman. NOES: None ABSENT: Commissioners: Ellerbroek and Smith. AMENDMENTS: Chairman Longmoor opened the let Hearing (set over ffom January meeting) on the application of Arthur .0. Hovey and other oronertv.owners to amend the zoning ordinance of the City of Newport Bead'h so as to cause Lots 1 to 8 inc., in Block 329, Corona del Mar and Block "D" of Acreage, C. D. M. (that portion bounded by Avocado and Begonia .Avenues and Pacific and Bayside Drives, to be rezoned from an R-1 to R-2 zone classification. Asked if anyone wished to speak for or against. -- Harthur Hovey again spoke on behalf of the applicants. -- Althea Pease, 1711 Pacific Drive, bought property because it was quiet resi- dential 'section of single homes and hopes it will stay that way. very much against having it go to multiple dwellings. -Mrs. Elliott, 1706 Bayside Drive, had just learned.-of the petition and wanted to find out what was going on. - -Clara B. Giddings, 95 So. Holliston, Pasadena, owner of 17 in 329, stated that this lot was not in the petition but wanted to call attention to the fact that they have filed a petition asking for rezoning of the other half of Block 329 back to R-2 as it was before the recent ordinance was enaeb6dd - -H. W. Thorne, Pasadena, interested in Block "D" area. would like to go on record as protesting vigorously any encroachment of R -2. (couldn't find any record of his being a property woner or tenant).g.j. - -Dr. Odle, 115 Bayside Drive (lot 1, 329) Thinks if either one of-the ap- plications is approved, the whole block should be rezoned: Prefers to have it remain as is, but if it's to be donei wants all of it changed. -- Robert W. Campbell, 1705 Pacific Drive. Owns 60' on Pacific Drive. Do not see any reason for rezoning the district -- satisfactory the way it is. -- Miss.'Hiebsch owns Lot 18 & 18' of 162 Blk 329. Feels that the whole section should be changed back to its original zoning. Definitely in favor of it. Also think if part is rezoned, the whole block should be rezoned. Commissioner Copelin made the suggestion that we pass this over to the second hearing and in the meantime have the Chair appoint the Commission as a whole to go out and study the problem. The Chair recommended that the Commission pass a Resolution of Intention to change all blocks aid also suggested that a communication be directed to the City Council asking what their plans are in regard to Bayside Drive. Commissioner Pleger thought suggestions very good and further suggests that since it appears that most of the objection is in Block "D" that that block be dropped from the Resolution. Chairman stated that he was afraid it couldn't be dropped out now because it was already in. 194 Commissioner Copelin suggested that those people who put in a protest write a letter to the Commission to be put.on file. Commissioner Briggs made a motion that the first hearing ... be closed and set ' over until the second wring at the next regular meeting of the Planning Commission. Motion seconded by Commissioner Pleger and carried. Commissioner Pleger then made a motion that a Resolution of Intention be passed far the consideration of the rezoning from R -1 to R -2 on property bounded by Pacific Drive and Second Avenue and Acacia and Carnation Avenues excepting Block 330, or Blocks 329, 429, and 430. Commissioner Rudd seconded the motion and carried by the.following roll call vote, to -wit:. AYES: Commissioners: Briggs, Copelin, Longmoor, Pleger, Reed, Rudd, and Wightman. NOES: None ABSENT: Commissioners; Ellerbroek and Smith. Mr. Hovey was asked to file a letter with the Commission agreeing to an- ex-tension of time. The Chairman then opened the first hearing, set over from the January meeting, ohnthe application of Nelson Stafford and other vroverty owners to amend the zoning ordinance so as to cause Lots 1 to 12 inn., of Block 12 in Tract #27 to be changed from their present zoning of R-1 to an R -2 classification. Asked. if anyone wished to speak for or against, Mr. Stafford was present and stated that the lots run from 150 to 410 (incorrect) feet through from street to street. At the time that the present zoning ordinance was under consideration they were informed that those lots were to be R- 2—when zoning ordinance came out, they were still zoned R -1. Stated that the owners had no intention of.dividing'or subdividing the lots whatsoever, just want permission to build two units on one lot;'. After further discussion, Commissioner Pleger made a motion that the.first hearing be closed and set over until the second hearing at the next regular meeting of the Planning Commission in March. Motion seconded by Commissioner Wightman and carried. Chairman would like to appoint commission as a whole to take a look at this for the second hearing. ADJOURNMENT: There being no further business to come before. the Commission, Commissioner Reed made a motion to 'adjourn, seconded by Commissioner Pleger and carried.
