THE NEWPORT BEACH CITY PLANNING COMMISSION met
in special session at 7:30 p.m. in the City Hall,
r'ebruary 23rd, 1937. In the absence of Chairman
H. L. Parks, Commissioner Palmier presided.

MINUTES: The minutes of the meeting of January
20th, 1937, were read and approved as
read.
PUBLIC HEARING (MANNING SIEMON) SECOND HEARING:
The Chairman announced the baring open on the
request of Manning Siemon petitioning for the re-
commendation of the Commission for amendment of
the Zoning Ordinance in a manner to show Lot 16,
Blk. 14, Sec. Four of Balboa Island in an R -2 Dis-
trict rather than in a 0-1 District as now shown.
There being no protestants'present and no further
written protests the Chairman declared the hearing
closed.
MOTION: It was moved by Com. Schnitker, seconded
by Com. F. W. Briggs and carried, that the Commis-
sion recommend in favor of the petition, and the
Secretary file a letter of transmittal to the City
Council accordingly.
Considerable discussion ensued regarding a desired
front yard variance to seven feet on this lot re-
sulting in advice by the Attorney and Consultant
that under the present zoning, C -1, the ten foot
front yard requirement does not apply and, there-
fore, consideration of a variance from the require-
ments of the zoning petitioned for is out of order
at this time.
A discussion by various commissioners of way and
means to save time fox the petitioner resulted in
the following action:
As
MOTION: It was moved by Com. Schnitker, seconded
by Corn. F. W. Briggs and carried, that a public
hearing be held in the City Hall on Tuesday after
noon at one o'clock P.M. befo e the Planning Com-
mission on the request of Manning Siemon for a
reduction to seven feet, rather than ten feet, in
the front yard requirement, to apply to Lot 16,
Block 14, Sec. Four of Balboa Island in the event
the City Council does amend Ordinance # 440 plac-
ing the said lot in an R -2 District.
PUBLIC HEARING -- (AMENDED VALLELY PETITION) SECOND
HEARING: The Chairman announced the hearing open
on the proposed rezoning of Lots 5 & 6, Block 9,
Sec. One, and Lots 1 & 2, Block 7, Sec. One, from
R -2 to C -1.
There being no protestants present and no written
protests the Chairman declared the hearing closed.
MOTION: It was moved by Com. Patterson, seconded
by Com. Whitson and carried, that the Commission .
recommend an amendment to Ordinance # 440 according
to this proposal and that the Secretary file a
letter of transmittal to the Council accordingly.
PUBLIC HEARING -- (PROPOSED REZONING AT 15TH STREET):
The Chairman announced the hearing open on.the
proposed rezoning of .a strip of land 50 feet in
width lying westerly of and parallel to Fifteenth
Street between the first alley northerly of Cen-
tral Avenue and the U. S. Government Bulkhead Line,
between Stations 118 and 119, from R -j to C -1.
The purpose being to allow a lease for a Boat Livery
MR. BROPHY: President of the Otto G. Wildey Co.,
subdividers of the E1 Bayo Tract, objected to the
proposal on the ground that his company now holds
between seventy and eighty thousand dollars worth
of unsold lots in that vicinity and that the es
tablishement of a commercial pier for the purpose
of a Boat Livery would be very. detrimental to the
sale of this property. Further, that his company
takes pride in the E1 Bayo Tract development and
has refused many offers for the sale of the wester -
ly corner of their tract for business purposes. He
believed the piers constructed at street ends in
the tract have hurt the sale of property.
MC NALLY: Presented a design of the proposed
pier, suggested that Mr. Brophy inspect his pier
at Balboa and felt his enterprise useful -and con-
venient.
TILTON: Suggested an alternate location at
17th Street and Bay Front, to which Mr. McNally
objected as that street does not run through
to the bay from Central Avenue.
'+ LIND: Praised the E1 Bayo development, and sym-
pathized with Mr. Brophy's effort to protect a
residential area.
PATTERSON: Felt that an R -1 District should be
protected from exposure to an abrupt drop in the
standard of the use of property just across a
street, which is not good zoning practice.
PALMER: Also felt the E1 Bayo development wor-
thy of protection, but stated a pier of the Mc-
Nally standard might serve as a buffer between the
Camp Ground and the residential areas.
A second public hearing, as required by the Ordi-
nance, will be held on this proposal on March
16th, at 7 :30 P.M. in the City Hall.
PUBLIC HEARING-- (HOPRINS VARIANCE REQUEST) The
Chairman announced the hearing open onthe re-
quest of C. Harold Hopkins for a reduction to six
feet of the front yard requirement on Lot 13,
Block 26 of the Eastside Addition to the Balboa
Tract.
There being no protestants present, the Chairman
declared the hearing closed.
MOTION: It was moved by Com. F. 17. Briggs, se-
conded by Com. Whitson and carried, that the
variance be granted.
MRS. E. E. ESTES: Owner of Lot 1, Blk. 111,
Tract 234, being the N. W. corner of 11th St. and
Central Avenue, asked for an expression of the
Commission on the probability of a request for a
50% variance of the front yard requirement re-
ceiving favorable consideration. She plans to
construct a four - apartment building, and her plan
requires the extra five feet of length.
As this was not formally before the Commission
for action, the Secretary was instructed to write
. Mrs. Estes that, in view of the fact there are
no buildings in this block, such a variance would
be contrary to the standards of the Commission.
RICHARD DWYER (742 S. Hill St., Los Angeles)
Owner of Lot 17, Tract 742.
Lot is 30 x 75 and if held back ten feet the
front of his house would be 28 feet from the
new sea wall, which is built on the U. S. Bulk-
head line.
• Would like 50% reduction in front yard require-
ment, as his house plan measures 72 feet. The
rear yard requirement would not restrict him,
as the alley is 20 feet wide. If the Commission
can state that all property in this block, front
on the bay, will be held to the 10 -foot front
yard he will revise his plans; otherwise he wants
to protect himself by making application for var-
iance.
The Secretary was instructed to inform Mr. Dwyer
and others desiring similar information, that a
formal request for a variance is the only method
for determining such rulings.
A. J. TWIST: The Council referred a request for
a change in street naming from Pansy to Pine Road,
or some name other than Pansy. On motion the
Secretary was requested to notify the Council of
a recommendation to change the name from Pansy to
Poinsettia.
• R. G. BLAKE: Asked information regarding per-
mission to conduct a Wild West show at 617 Helio =:.
trope in Corona Del Mar. He was advised by the
Attorney that such uses were prohibited in an
R -2 District, and that his application should
properly have gone to the Council as an applica-
tion for a license. Mr. Lind offered to help
Mr. Blake find a lot on the highway in a business
zone which he could lease reasonably.
H. M. MOSHER VARIANCE: The Chairman set a var-
iance hearing for March 2nd, 1937, in the matter
of a 50% variance in side yard requirements on
Lot 12, Block 2, Section 1, Balboa Island,
MR. BERTHELET: of the Newport News, asked for
and received the consent of the Commission to act
as judges in the letter contest being conducted
by the newspaper in connection with Arbor Week.
HYER: Suggested an amendment restricting all
structures, including fences, for a distance of
five feet from:all ten foot alleys.
