Encroachment of 13' into a required front yard setback of 20'; 10' encroach- ment into a required rear yard setback of 101; and a 4' encroachment into both side yard setbacks of 4'. 5. The adjoining building has no setbacks on private road. Setback on Bay is about 10' on adjoining property. View is so important that any future adjoining commercial development not requiring setbacks would tremendously .handicap this development. Accessory garage building and cabana should be allowed the zero side yard as they comply in fire resistance with that of a commercial structure. No required lighting or openings are involved in the accessory structures. Precedence on the acceptance of C -2 setbacks has been firmly established in many other apartment projects fronting on Bay. 6. DISCUSSION: At the last regular meeting of the Commission, this application was set over in order that a committee appointed by Commissioner Longmoor could make a study of the requests made by the applican„ On Monday morning, February 24, 1958, the committee, composed o£ Commissioners Keene and Lind, City Engineer Webb and Planning Assistant Drawdy met with the applicant and other interested parties to discuss the several problems involved in the appli cation. The committee suggested that favorable consideration might be given the application by the Commission if the appli= cant would revise his plans to show the following: a) A 10' front yard setback from the bulkhead line to the balcony line instead of a requested 7'. b) A 4' setback from the side property line for the dwelling unit over the garage. c) A roof attachment from the main dwelling to the garage in order to make a contiguous building. • 0 -2- V -440 con't. 7. FINDINGS: The applicant in accordance with the recommendations of the Committee submitted an amended plot plan showing thereon all of the recommendations recommended by the Committee. Commissioner Lind stated that in his opinion the plan as now revised would not be detrimental to the general welfare of persons residing or working in the neighborhood and recommended approval. 8. On motion of Commissioner Lind, seconded by Comm. Keene, Variance Application #440 was APPROVED as amended by the following roll call vote, to wit: ALL AYES Comissioner Longmoor stated that at the last regular meeting of the Commission on February 20, 1958, time could not be given to final consideration on proposed amendments to the Planning and Zoning Law for the City of Newport Beach, and that this adjourned meeting was primarily for such purpose. A revised draft of the proposed amendments, dated February 17, 1958, was given to each Commissioner and Commissioner Longmoor requested recommendations for any changes. Commissioner Keene stated that in his opinion, residential uses should be pro- hibited in commercial and manufacturing zones. A discussion was held among the • Commissioners and on motion of Commissioner Keene, seconded by Comm. Sturtevant and carried, it was moved that residential.uses, namely, single family dwellings, duplexes, and dwelling groups be prohibited in the C -1 and C -2 Districts. changes A few other minor /were suggested by the Commissioners to assist the Planning Staff in interpretations and administrative procedures. On motion of Commissioner Copelin, seconded by Commissioner Rudd, it was moved that the Commission recommend to the City Council the adoption of the proposed amendments as revised at this meeting.
