Les Schunk appeared before the Planning Commission on behalf of his application and stated that he was in the business of selling tires and therefore requested he be allowed to display at_least.100 tires outside the building and have a minimum of 12 months to comply with the remaining conditions as recommended in the staff report. That..within 90 days of the effective date of this action, exterior sgns.,shall be limited to the following: (a)- One double -faced free- standing sign, not, exceeding a height of twenty -five (25) feet and an area thirty- six,(36) square feet for each side. (b) Two wall signs to be located on the . exterior facades.of the building and not ten (10). feet exceeding square each. (c) One sign identifying the operator of the premises and address of the building, to be located on.the building and not exceeding a total of six (6).square feet: (d) All small signs advertising products for sale, trading stamps, credit cards and the inspection of pollution control devices, lamps and brakes, as authorized by the State; shall; be clustered into not more than three (3) sign groupings located on the building face and a total of which shall not exceed twelve (12) square feet in area,.exclusive of the additional space required for signs advertising State - authorized services.. The sign background shall be of materials in harmony with those utilized in the building. That all products or merchandise, except as permitted in Condition No. 1, shall be stored within the main building or in a new building addition. 4. That landscape planting and sprinkler irriga- tion plans be.submitted to and approved by the Community Development Department, and the site ,shall be landscaped according to the plan and be- perma.nently maintained. 5.. That -Lot I.shall be paved except for that portion.which is landscaped and.a minimum:of seven parking spaces shall be provided.. All such parking spaces shall be marked clearly and shall meet all City codes and standards; as to size.and accessibility, Parking on ..site is ..prohibited except for such vehicles as. are.in the. process,.of being serviced, those belonging to.employees and service trucks owned by.the establishment. No vehicle waiting for service shall be parked for a.period longer than twenty -four hours on the site unless in the process of being serviced. No vehicle shall be con- sidered to be in the process of.being serviced fora period longer than one.(1) week., 6. Lighting - All lighting fixtures shall be located so as to shield direct rays from adjoining properties. Luminaires; shall be of a low level, indirect diffused type and shall not exceed,a height of greater than_ twenty (20) feet above finished grade. 7. That a driveway approach be required on.Iris Avenue for vehicular access.to Lot 1. The location and design of the driveway shall meet the approval of the Traffic and Parking Engineer. 8. David Doherty, applicant, appeared before the Planning Commission and stated that he was in complete agreement with the staff report and. recommendations. Staff's report on this application recommended that the Planning Commission initiate proceedings to change the zone from C -1 to R -3 in connection. with Lots through 16 of Block 12, East Side .12 Addition of Balboa Tract. Planning Commission discussed changing the zone to R -2 rather than R -3 and also suggested that the change include Lot 8. X Following discussion, Planning Commission approved X Use Permit No. 1583 subject to the following conditions: 1. The front yard setback shall be at least.5 feet. 2. The development shall conform to the plans as submitted (other than the required 5' front yard setback in condition No. 1), except for minor modifications approved by the Department of Community Development. 3. Item #10 Request..to amend a condition of approval so as to TRACTS permit the construction. of residential structures 7432; -& which are sound attenuated to achieve an average 7TT15 maximum interior noise of;60 DBA instead of the 7511�r previously approved 56 DBA level. He also pointed out that the Department of Housing and Urban Development requires that structures be sound attenuated to achieve a noise level of 60 DBA as compared to the 56 DBA required by-Newport Beach and also that flights over the areas in question have been relocated and are now at 800 feet instead of 600 feet. William Lusk, President of John D. Lusk & Son, appeared before the Planning.Commission to answer questions relative to this request. Planning Commission discussed this matter at lengt and questioned how the City of Newport Beach. X arrived at a 56 DBA noise level. Following X discussion, Planning Commission continued this matter to March 16, 1972, in order that Dr. John K. Hilliard could be present to answer further questions relative to sound attenuation. TO 6 Initiated By: City of-,Newport Beach Community Development Director Hogan presented. additional information as to what actions had been taken by the City Council subsequent to the February 17, 1972 Planning Commission meeting wherein proceedings were initiated to consider amendments to the Newport Beach Municipal Code relative to parking requirements for Industrial Zoned Districts. The following persons appeared before the Planning Commission in connection with.this public hearing; Sara Gadarian, 2414 Newport Boulevard; Bob Kausen, of .the Cannery Village Merchants Association; Blackie Gadarian, 2414 Newport Boulevard; Fleet Joiner, 4401:Seashore; William Clapet, Architect, 444.N. Newport Boulevar . Planning Commission discussed parking in the M -1 District and also the possibility.of requiring use permits for all non- manufacturing,uses.in the M -1 District. X Following discussion, Planning Commission continue X the public hearing in connection with Amendment No..316 to April 6, 1972.
