A seven foot (71) encroachment into a required twenty -two • foot (221) rear yard setback for construction of an additional room. 5. This variance was provided for in the recorded deed restrictions but not cleared for variance under the Newport Beach Zoning Ordinance. Building is under construction. 6. DISCUSSION Note findings. 7. .FINDI NGS 1.1hen this tract was first zoned, the subdivider asked for R -1 zoning but upon request of the Commission agreed to an R -1 -B District. Upon an investigation by the Building Department this dwelling was found to be in violation of the rear yard setback. The Commission feels an honest mistake was made and recommends,the approval of this application. 8. On motion of Commissioner Lind, seconded by Comm. Rudd, Variance application No. 345 was GRJNTED by the following roll call vote, to wit: ALL AYES #346 1. It is necessary to provide adequate living facilities. 6. DISCUSSION : Note findings. 7. FINDINGS Information secured from the Building Department revealed that when plans for this addition were submitted the applicant was advised that the second floor overhang could not be permitted with- out a variance. The contractor, without variance procedure, started the construction which was discovered by an inspector from the Building Department. The Commission does not wish to be placed in the position of legalizing a violation and recommends denial. 8. On motion of Commissioner Lind, seconded by Comm. Keene, Variance application No. 346 was DENIED by the following roll call vote, to wit: ALL AYES. • RESUBDIVISIONS #45 1. RANCHERS OIL COMPANY 2908 Ocean Blvd. Corona del Mar 2. Lots 4,5, & 6 Block 35 Zone R -1 3. Posted January 7, 1957. 4. Creation of two (2) building sites. 5. DISCUSSION This application was held over from the meeting of February 219 1957 so that the applicant could study the recommendation of the Commission to establish a 15' parcel of land fronting on Ocean Blvd. to be made a part of Parcel No. 1. New plans were submitted which show the 15' strip' as suggested. 6. FINDINGS This application has been amended as suggested by the Commission and in view of no protests being received the Committee recommended' approval. 7. On motion of Commissioner Rudd, seconded by Comm. Hayton • Resubdivision application, No. 45, as amended, was GRANTED by the following roll call vote, to wit: ALL AYES. 8. On motion of Comm. DISCUSSION: The Commission was advised that this.applica.tion was a renewal of Use Permit X215 which was approved January 199 1956 with the condition that it be for a period of one year only. 5. FINDINGS The Commission stated this establishment has con- tinued to be an attractive operation and recommended the continuance for a one year period. 6. On motion of Commissioner Copelin, seconded by Comm. Rudd, Use Permit #302 was GRANTED, subject to the above condition, by the following roll call vote, to wit: ALL AYES lJ Business at hand being declared completed, the meeting was adjourned on motion of Commissioner Copelin, seconded by Comm.
