The Newport Beach..City Planning.Commission held a regular meeting on Thursday, March 15, 1945, at 7 :50 p.m., in the Council Chamber, City Hall, Newport Beach, California, with Chairman Hope presiding. ROLL .CALL Commissioners present: Allen,. Ba1tz,.Campbell, Hopkins, Johnson, Is- bell, Nelson, Patterson, and Seeger. Commissioners absents None. MINUTES .. Commissioner Allen made the motion ,. .seconded by Commissioner Johnson thatthe minutes of the meeti.ng..of February 15, 19459 be approved as read. .Motion carried and so ordered. COMMUNICATIONS . Secretary Seeger read a letter from George B. Weis, 516 Sast.Ocean Front, Balboa, dated February 9, 1945, requesting a temporary permit for a variance for his property at the above address, R-5 zone,"which is adjacent to the business district, in order to conduct a real estate business, at that address. Commissioner Patterson .made the motion that the secretary be instructed to advise Mr. Weis of the conditions of the zoning ordinance and the regularions for his.real.estate brokers sign. Commissioner.Johnson seconded the motion, which carried. PUBLIC EARIN S. Chairman Hopkins announced the final hearing on the proposed Amendment to Ordinance No. 525, having to do with the.keeping of pigs, bogs, or swine in the City of Newport Beach. No protests, either verbal.or written were heard, and Chairman Hopkins declared the.hearing,closed. Commissioner Allen moved, Commissioner Baltz seconded that the Com mission recommend and approve the prohibition of the keeping, harbor- ins, or maintaining of pigs., shoats, bogs, swine, goats, sheep, mules, horses, and cattle within the corporate limits of the City of Newport Beach, and making it unlawful to do so, as an Amendment to.Ordinanca No. 525, Section 4,(a)l. ROLL CALL VOTE ..byes: Allen, Baltz, Campbell, Hopkins, Jobneon, Isbell,.Patterson, and Seeger. Noes: Nelson. Motion carried, and so ordered.. First hearing having to do with a variance of rear -yard setback require- ments from 101 to 51 in Block 14, Balboa Tract. The hearing was called as the result of residents and_property owners having petitioned the City Council for relief in this matter, and said matter having been.re- ferred to the City Planning Commission for action. Present for the meeting was John K. Elliott, who explained conditions, stating that the present situation penalizes his property and those adjacent. No pro- tests were heard or received, end the hearing was closed with Commiss- ioner Campbell moving and Commissioner Johnson seconding the.motion that the hearing be Continued to the second hearing. Carried and so ordered. First hearing upon the application of the Citizens Natio rTztmt; and Savings Bank of Los Angeles, a Rational Banking Association, for a permit granting a variance from the provisions of Ordinance No. 525, namely the elimination of front and rear yard requirements, provided for in Subdivisions (d) and (f) of Section 4, for certain parcels of land, described in tbe.application as *A" (Lots 1, 2, and 5, Tract 1026) "B" (Lots 59 6, 70 8, 9, 10, 11, Tract 1026); "C* (easterly balf.of Lot 14, Lot 15., and westerly half of Lot 16, Tract 1026); and "II" (that portion of Tract 1006, as shown on a Map recorded in Book 55, page 29 1 203 of Miscellaneous Maps, records of Orange.County,.California, EXCEPTING"' TFDsRN'ROM that portion indaudAd within the lines of Tract 7026 as shown on a Map recorded.in Book 55, pages 87 and 38 of -Miscellaneous Maps, Records. of Orange County, California, ALSO EXCEPTING THEREFROM that por- tion thereof lying southerly of a line parallel to the south line of Ocean Boulevard and distant '119.9 feet southerly therefrom. All of Block "A" in Corona Del Mar, as shown on a Map recorded in Book 5s page 41 and 42 of Miscellaneous Maps, Records of orange County, California, excepting those portions, if any, of said Block "A" heretofore or now lying below or seaward of the line of mean high tide of the Pacific Ocean.). Secre- tary Seeger read the application, which further stated that if the Plano - Ing Commission would not or did not recommend the granting of the permit or found that it has no.jurisdiction to make same that that.body.refer the application to the City Council of Newport Beach for action, a d fur - ther requested said City Council to consider this application a petition under Section 19, of said Ordinance No. 525 for an Amendment, settlement or change of regulations for front and rear yard requirements, as provid- ed in Ordinance 525 for the real property in Parcels A, B, C, and D. No discussion from members of the Commission and the meeting was declared open by the Chairmen. Present and representing the applicant were Attor- ney Stanley M. Reinhaus, and Mr. John S. Harris. Mr. Reihbaus opened the arguments by stating that he doubted if a petition were required for a variance, legally, but that he, in representing the company, was only Asking for relief. Mr. Harris presented and explained a contour map of the properties in question and stated that his company was only asking ' for the same rights as a private citizen.. First to be heard in protest was W. P. Grahams owner of property.on Ocean Boulevard, who requested clarification of the lengthy application, and then stated that "Properties Incorporated does not own that 251 setback now", that he thought the 251 setback should be restored, for "the people intend to build homes and are . we going to have a community for citizens or a real estate boom ?"j and to the question as to whether the granting of this variance would affect the (his) health, he questioned how it would affect the health of Properties Incorporated, and further that primarily all ordinances are based on health; that he was just trying.to protect his own interests— that the whole thing was a controversial issue, for Properties Incorporated should have thought of this when.they sold off the property. Next protest was heard from Mr. H. L. Ross, also a property owner, who emphasized the health, happiness, and comfort clause, stating that permitting building of houses nearer than present setback would obstruct view, cause garages, garbage cans etc., to face the street. Other residents voicing protests were John R. Thomson; Mr. and Mrs. Harold Cass, who emphasized their de- sire to retain the beautiful view, etc., and not let anything spoil it. Another protest was from Mr. A. A. Fempers who said "if a private owner had the same condition he would to take it ", for he was in the same posit- ion when he recently owned 6581 on the bluffs and could not get a setback variance. Also heard was Miss Ruth Simpson who asked about sewage.00ndi- tions, pertinent to health conditions. Commissioner Patterson asked Mr. Harris if the property was not subdivided at the time Properties Incorpor- ated acquired it, and Mr. Harris answered "noes but Commissioner Patterson Insist" that it was, and that it was his understanding that the subdivis- ion be put below, and not on top of the bluff or he would not have.recom- mended that the streets be vacated, but since no witnesses were present at that time, it seemed now to be Mr. Harris' word against his.. Commissioner Patterson also stated that there is no sewage system, sewage being taken care of by teas pools and septic tanks. Arguments "pro and con" continued heatedly, end the public hearing was finally declared closed by the Chair - ipan, and turned back to the Commissioners. Commissioner Allen moved and 204 Commissioner Johnson seconded the motion that the hearing be continued to the eeoond..hearing_.at..the next sleeting on April 19, 1945. Motion carried and so ordered. REPORTS OF MASTER PLAN COWITTEES. Commissioner Seeger requested action on the request from the City COUn- oil in the fora of a.motion by Councilman Earl Stanley for the Plann- ing Commission's recommendation for post -war plans for the 2300► of City owned property on Coast Highway, and also the City owned property known as the "camp grounds ". Commissioner Seeger, Chairman of the Master Plan Committee, reported that progress had been made but that there had been no formal meeting of the committee. Commissioner Campbell made the mot - ion, seconded by Commissioner Allen, to request the Master Plan Committee to bring to the next meeting sketches, plans, etc., showing post -war plans for uses for these areas. Motion carried and so ordered. WW_BUSINESS....,Application of R. G. Blake, dated March 15, 1945, presenting plans for a store building on Lot S,.Block,f, Tract 525, drawn by Mr. C. Rite, architect (formerly with Gordon Findlay). Commissioner Johnson.moved, and. Commissioner Allen seconded the notion that the matter be referred to the Chairman of the Planning Commission, and City Building Inspector Nelson, to work out final requirementa. Motion carried and so ordered. Commissioner Johnson gave a report of a meeting held on February 19s19+i8 at the Newport Harbor Yacht Club, attend d by representatives of the County Supervisors, County Planning Commission, County and City Engineers,, County and City Attorneys, the Harbor Commission, and Newport Beach City Council and Planning Commission, with Commissioners Johnson and Seeger representing the latter. Commissioner Johnson stated that the first ,steps to be taken should be the.clasaification of all land uses around the Upper. Bay and contiguous territory, seconds the advisability of having ail City and County Ordinances uniform, question of sonings and what.kind of a har- bor it is to beg the portion outside the harbor hen not been dedicated, and the question where authority rests. Land use should be established first, then the water use can be regulated. Commissioner Johnson.further stated that the greater burden of the work.should fall -on the shoulders of the County Planning Commission, due to the fact that the major .part of the area is outside of the City limits, but that full cooperation and assi- stance of the City Planning.Commission was offered and accepted at the meeting. Commissioner Johnson suggested that a committee.of two be appoint- ed to act with the County Planning Commission on the matter. ELWTION..OF Commissioner Seeger announced at.this point, that "as of now, the secre- SECRETARY taryship is vacated ", explaining that he had been filling in since his re- signation on October 19, 1944, and that it was impossible for him to con - tinue.longer, and made the motion that Commissioner Belts be nominated.for the secretesyshipe Commissioner Belts refused the nominations and.Com- . missioner Patterson moved,, and Commissioner Campbell seconded the motion that Commissioner Allen be nominated. Motion carriedi after which Com- missioner Campbell moved, and Commissioner Nelson seconded the motion that the nominations be closed. Written vote. was taken and Chairman Hopkins announced Commissioner Allen as the new secretary, and expressed his and the Commission's appreciation to Commissioner Seeger for his fine work for the past many years, allting that "as a secretary,, Commissioner Seeger has been exceptional." CIVIC. CENTER Mr. Davies and Mr. Pleger, architect of Long.Beach and Corona Del Mar, LP�ANNZNG were present to show brochures of Civic Centers,, and public buildings, in- cluding auditoriums, memorial buildings, schoola, *to., which their firm had handled, explaining their qualifications in relation to the proposed J 205 Civic Center for Ne*port Beach. Detailed plans, eto., including figures were given for the Civic Center now under their design for the City of Huntington Park, California. Commissioner Allen made the motion for. adjour ment, seconded by Con— ADJOURRU T missioner Balta. Motion carried and so ordered, and meeting adjourned to Thursday, April 19,, 1845.
