MINUTES OF THE PLANNING COMMISSION IEETING. FOR THURSDAY, MARCH 15th, 1951
AT 7:30 P. M. IN THE COUNCIL CHAMBER OF THE NEWPORT BEACH CITY HALL

CALL: Commissioners Present: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd,
and Wightman.
Commissioners Absent: Pleger and Smith.
MINUTES:, Commissioner Rudd made a motion to approve the minutes of the Planning Commi-
ssion meeting for February 16th, 1951 as submitted.to the Commission, seconded
by Commissioner Reed and carried.
PUBLIC Variance: Application of W. G. Johns for a 100% variance on.Lot 1. Block 7,
HEARINGS: East Newport, (111 8th Street). This.had' been set over from the February
meeting in order to get an opinion from Mr. Wise,the planning consultant, who
wrote "As fares the clothes line and sun deck, the owner could of course build
them on top of the garage as an accessory use to his residence, if the whole
sturcture does not exceed 15 feet in height. The 15 feet of course includes
any windbreak, etc, that he may want to construct." Mr. H. M. Johnson, 805 W.
Balboa Blvd, again was present and voiced his protest to the granting of the
application. However, his protest concerned the height of the additions and
not the extension of the garage which the variance involved.
Commissioner Copelin made a motion that the hearing be closed, seconded by Com-
missioner Briggs and carried.
Commissioner Reed moved that the application be granted to allow the lower
structure to be granted a variance of 100% to extend the garage two Eget, but
' any structure over and above that must conform with the setback regulations.
Motion seconded by Commissioner Briggs and passed by the following roll call
vote, to -wit:
AMES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: Commissioners: Pleger and Smith.
Variance: application of Ray H. Loomis on Wly z of 17, Wly J 18, Block 10,
Section 2, Balboa Island (200 -202 Ruby Ave) for R 50% variance or 3' 6 ".
Chairman Longmoor asked if anyone'wished to speak regarding same.
-- Arthur B. Landis, 235 Gower, L. A., owner of property at 204 Ruby. Stated pro-
test to granting of variance until he could find out what kind of building would
go up. Was afraid that a two story building would go up. Bommissioner Eller-
broek explained that the application for variance had no connection with what
type.building went up.
Mr. Loomis was present and stated that he plans to build a one story house, garage
and garage apartment.
- -John D, Eversoll, 201 Ruby Ave. Would like to object also until he saw Mr.
1 Loomis' plans.
Commissioner Copelin moved that the hearing be close:}, seconded by Commissioner
Wightman and carried.

Commissioner Copelin then made a motion to grant the application to change the
setback line from seven (7) feet to three feet six inches (31 6 "). Motion
seconded by Commissioner Rudd and carried by the following roll call vote, to -wit;
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and ;
Wightman.
NOES: None
ABSENT: Commissioners: Pleger and Smith.
Variance: application of Stewart Archibald on Lot 30, Block B, Tract 673, Corona
del Mar (528,Hazel.Drive) from the required five foot setback to a two foot set-
back. Commissioner Ellerbroek noticed that the plans called for a one foot set -
back; however, since most of the other homes in the area were using a two foot
setback, it was thought advisable "to conform with this. Commissioner Copelin
moved that the hearinig be closed, seconded by Commissioner Reed and carried.
Commissioner Ellerbroek moved that the application be granted and that the set-
back line be changed from five feet to two feet, seconded by Commissioner Wight -
man and carried by the following roll call vote, to -wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: Commissioners: Pleger and Smith.
Use Permit application of C. H. McKellips on Lot 7, Block 26, Balboa East Side
Addition 1713 East Bay Avenue) to provide servants quarters over the garage.
Secretary Copelin read the committee report of Commissioner Briggs which recom-
mended the granting of the application. Chairman asked if anyone wished to speak
in regard to the application,
- -Ray Middaugh, 507 "J" Street, registered his protest to granting permission to
build servants quarters over the garage saying that it would affect his view.
Chairman asked what action the Commission wished to take. Commissioner Copelin
made a motion that the application be granted with the stipulation that the con-
form with the setbacks of our present ordinance in regard to the alley. Motion
was seconded by Commissioner Wightman and carried by the following roll call vote,
to -wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: Commissioners: Pleger and Smith.
USE PERMIT application of Odette & Nelson to install four 6! x 6' bait recievers
off the float at 406 So. Bay Front, Balboa Island. Secretary Copelin Pead the
letter of application and the Chairman asked if anyone wished to speak foror
against.
- -G. H. Hurd, 119 Agate, Balboa Island. Stated thathe would like to protest. .
Is building at 304 So. Bay Front - -about one block from this.. Protests fDr two
reasons: (1) Doesn't want to see anything spoil Balboa Island, (2) Investing
money on the Island and is afraid it will reduce the property value. Also pro-
tests for beach contamination, sanitary reasons, and the attraction of seagulls
with the installation of such recievers.
Secretary Copelin then read two petitions that had been filed by property owners
with 25 signatures on requesting the granting of such permission and a letter

written by J. A. Beek stating that he would be responsible for the conduct of
bhch business:
Commissioner Copelin made a motion, seconded by Commissioner Ellerbroek, that a
public hearing should be held at the next regular meeting of the Planning Com-
mission (April 19) and that in accordance with the Ordinance #635 notice of such
hearing be given. Motion carried by the following roll call vote, to -wit:
AYES$: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: 'Commissioners: Pleger and Smith.
Use Permit application of C. N. Enfield for permission to operate electrically
powered tools not to exceed 1 H.P. per unit at 128 Agate, Balboa Island, (Lot 23,
Block 9, Section I, Balboa Island). The Commission could wee no objection to the
tools that he proposed using and upon motion of Commissioner Copelin,. seconded
by Commissioner Rudd and carried by the following roll call vote, to -wit:
AYES: Commissioners; Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightman.
NOES: None
ABSENT: Commissioners: Pleger and Smith.
Use Permit application of 14. W. Mann, 6608 Ocean Ft, Newport Beach, to build a two
car garage on pnr 5, all lot 6, Block "F" Seashore Colony Tract. Mr. Mann was
present and explained that they have four cars in the family and would like to
' build a two car garage on the vacant lot; however, the ordinance requires that a
building be erected also.
Upon motion of Commissioner Ellerbroek, seconded by Commissioner Briggs, permission
was granted to Mr. Mann to build a garage as shown by plan on Lot 6, with the under-
standing that Lots 5 and 6 are under his ownership and that at such time that Lots
5 and 6 become separate.building sites, this Use Permit is no longer effective.
Motion carried by the following roll call vote, to -wit:
AYES: Commissioners: Briggs, Copelin, Ellerbroek, Longmoor, Reed, Rudd, and
Wightmah.
NOES: None
ABS_NET: Commissioners: Pleger and Smith.
Resolutions of Intention Chairman stated that because of failure to advertise
the resolutions of intention adopted at the February meeting in the proper paper
and ten days prior to the meeting, they were declared void and new eesolutions
mat be adibpted.
Chairman read the resolution of intention to hold public hearings to replace the
old resolution #435 and upon motion of Commissioner Copelin, seconded by Commis- '
sioner Wightman and carried, the resolution was adopted.
Chairman then read the resolution of intention to hold public hearings to replace
the old resolution #436 and upon motion of Commissioner Copelin, seconded by Com-
missioner-Reed, and carried, the resoltuion was adopted.
Chairman then read the resolt1ion of intention to hold public hearings to replace
the old resolution #437 and upon motion of Commissioner Briggs, seconded by Commis-
sioner Wightman and carreid, the resolution was adopted.
There being no further business, Commissioner Copelin made a motion for adjournment,
seconded by Commissioner Rudd and carried. g•j•
