Commissioners Absent: Smith„ Lind MINUTES: The meeting of February 716, 1956 approved on motion of Comm. Rudd, seconded by Comm. Hayton, and carried. VARIANCES 1. SMITH_s L. J., Balboa Blvd., & "F" St., Balboa 2. Lot 3, Sec. 21 Eastside Add., Balboa Tract, R -3 Zone 3. Posted 2/P1/56. Published 2/3/56. Held over from Feb. meeting. 4. To establish a front set b ck of five (5) feet from the Southwesterly line of said property. (There is no dimensional set back on District Map). 5. If relief is not offered the remaining square footage for construction would not be adequate. 6. Discussion: No objections. 7. Findings: No beis for not approving. 8. Comm. Commissioner Rudd moved the Commission recommends the GRANTING of this Variance, seconded by Comm. Copelin, and carried by the following roll call vote, to wit:,ALL AYES B. To establish a sideyard setback of 21 -0 11on the West side of said property in order tb comply with Section 9107 -27 requiring 80 -0 11,in clear per car for garage. 5. To make use of R-4 Zone. 6. Discussion: Note findings. 7. Findings: The waiver of the side yard setback will in effect grant her permission to put 2 additional units on this lot. Despite the fact that this lot is in an R -4 Zone, the area is very congested and the size of the lot does not warrant 3 units. The Committee feels that with a lot of this size in a congested neighborhood set back re- quirements should not be relaxed to permit the crowding of another unit on a lot of this size. 8. Waive provision of time limit under Sec. 9106.111 8. Commissioner Copelin moved the Commission approve the GRANTING of this Variance, seconded by Comm. Discussion: Letter from Mr. John W..W6= protesting this Variance. 7. Findings: Applicant is asking for extension into rear yard set back of 221 for second story of proposed rooms over garage. There is one overhang in this block but not near this property. One of the adjoining neighbors is protesting. The building already on this lot has a side yard set back of 18 inches instead of the required 3 feet on the north side of lot. Due to the fact that the existing building does not comply with required set backs and there is a protest and no hardship evident, denial is re- commended. 8. Requesting a 101 front setback on an existing structure, which re- .quires 201 by District Map. 5. Additional dwelling area is required. 6. Discussion: Note findings 7. Findings: This is one of the older houses in the community and is the only one in the block that has not observed the required 20' set back. We are advised that, although the rooms may be small, the house now con- tains two bedrooms in addition to other usual room space, and we are not #282 Page - 4 - VARIANCE certain that any hardship now exists. We do not wish to discourage remodeling but do not feel that we should recommend approval of the application. 8. Applicant proposes to subdivide said lot into three (3) lots, each being 45' wide by 102.86 in depth. Each lot will contain 4590 square feet. 5. To dwelop dye property in accordance with its highest and best use by making three (3) separate suitable R -3 building sites. 6. Discussion: Note findings. 7. Findings: The property described in this application may be subdivided • into 3 lots subject to the following condiktions.. 1. That 51 front yard setback is established. 2. Findings: This type of business may be permitted in a C -1 district but the Committee feels that due consideration should be given to adjacent residential areas and for this reason we do not recommend approval of this application. 8. Sea Food, dated March 5, 1956, for electric sign to be located on City property, was read to the Commission. The Commission discussed the matter and suggested that Delaney Bros. apply for a Use Permit if a desire to erect sign.
